Protection For European Citizens Outside Europe

If you hold a Greek passport, you are considered a European citizen, meaning a citizen of a member state of the European Union (EU). Holding a Greek / European passport entitles you to travel and move from one EU country to another without visa or other requirements, to establish yourself in any EU member state, to work and enjoy the basic benefits of life on that other member state and to avoid any discrimination against you because you are not a national of that member state. So, if you hold a Greek passport, you can travel, move, study, establish yourself, set up business, and provide services in any European country member of the EU, much like USA citizens move from one state to the other within the USA.
Moreover, owning a EU passport can be beneficial in a foreign country, which is outside the European Union (a third country). Every EU citizen is entitled to consular protection for EU citizens abroad. Millions of European Union (EU) citizens travel or live outside the EU in places where their own country does not have an embassy or consulate. During their stay, they might need assistance from consular authorities, for instance if their passport is lost or stolen, if they are victims of an accident or if they find themselves in the middle of a political crisis which requires that they are evacuated. Thus, EU citizens in distress in a non-EU country have the right to enjoy the protection of the other EU countries’ embassies or consulates, if their own country is not represented.
For example, if you hold a Greek (thus EU) passport and you encounter a crisis in a non – EU country, in case there is not a Greek Embassy or representation in that country, you are entitled to protection from the Embassy/Consulate of another EU country, like the Consulate of Germany, France, Spain, Italy etc. in that country.
Other EU countries must provide unrepresented EU citizens with whatever assistance they would provide to their own nationals, such as assistance in cases of death, or serious accident or illness, in case of arrest or detention, if they are victims of a crime, and provide relief and repatriation in case of an emergency. This has actually been implemented in reality. An example one can remember is when Greek military and commercial ships successfully evacuated in the summer of 2014 not only Greek, but also other EU nationals from Libya during the chaos of civil war in that country.
The citizen can be redirected from one embassy to another, as EU countries present in the country can agree locally on who should take care of whom in order to ensure efficient protection for EU citizens. European Union Citizens can get information on assistance available by contacting the EU Delegation in the country in question.
European law guarantees that unrepresented citizens are duly taken into account and fully assisted in crisis situations. In such cases, a clear division of responsibilities and coordination is essential to avoid that EU citizens are neglected. If the assistance provided implies costs or fees, unrepresented EU citizens should not have to pay more than the citizens of the EU country which assists them. Citizens who are not able to pay these costs on the spot will be asked to sign a form by which they undertake to repay those costs to their own authorities.

What would possibly connect a court claim for a piece of property, with payment of the property tax for it? The answer is Greek law. The Greek administration has invented several ways to force property owners to pay property tax. Some call it extortion. Some others believe it is a reasonable measure to enforce the law. Even several courts in Greece have issued rulings stating that the law which says that if you have not paid your property tax, you can’t protect your property from trespassers at the court, is unconstitutional, because the law can’t deprive a property owner from his inalienable human right to seek court protection for his threatened private property, if the owner has not paid property tax.
The reality is that, as a lawyer, I have to advise a client who wishes to claim a property at the court, that one of the preconditions for our civil lawsuit action to be considered admissible by the court, is to produce written proof that this specific property has been filed at the E9 tax listing of properties and the ENFIA yearly property tax has been paid. This is a secure way to know that the court will accept to review our action. Every property owner in Greece, therefore, must know that listing his/her real estate properties to the E9 tax registry and paying the ENFIA property tax is a requirement for keeping their properties’ status updated. Moreover, property owners can’t sell or transfer the property to anyone, unless they have listed the accurately described real estate to the E9 tax registry and have paid the ENFIA.
This means that house, plot and land owners who own them with titles, deeds and survey maps dated before 2010, may have to retain a civil engineer to measure their properties again today, using a modern GPS – based system, in order to obtain their more accurate measurements, which they have to then update with their E9 tax filing. Because, when they are to sell or transfer them, or even declare them to the modern land registry called Ktimatologio, they have to describe them in a most detailed way, to ensure legal certainty and technical accuracy and to avoid or minimize disputes and court litigation with neighbours or relatives who may claim the same property for themselves.
Only yesterday sources at the Greek government revealed a plan that tax auditors will obtain access to the E9 tax listings of property owners and to their respective Ktimatologio land registry filings. Their aim will be to compare, for any taxpayer in question, the two property filing systems and confirm whether properties listed with the Ktimatologio land registry have also been listed to the E9, so that property taxes are paid correctly. If the auditors discover that a tax payer has omitted or “forgotten” to list in the E9 tax filing one or more properties registered with the Ktimatologio land registry, they will impose retroactive fines and taxes. In addition, any legal change, development, sale or transfer of the property in question will be put on hold, until the property is accurately described in both E9 tax filing and the Ktimatologio land registry.

Οι απόδημοι Έλληνες, που έχουν ελληνικό διαβατήριο και είναι εγγεγραμμένοι σε Δήμο στην Ελλάδα, έχουν βεβαίως το δικαίωμα να ψηφίζουν στις εκλογές που γίνονται στην Ελλάδα, είτε αυτές είναι βουλευτικές για την εκλογή κυβέρνησης και πρωθυπουργού, είτε δημοτικές / περιφερειακές, είτε ευρωπαϊκές για το ευρωκοινοβούλιο. Άλλο όμως να υποχρεώνεται ο απόδημος να πληρώσει για να πάρει το αεροπλάνο και να χάσει μέρες ή εβδομάδες από την εργασία του, για να μεταβεί στην Ελλάδα και να ψηφίσει και άλλο να αρκεί μία επίσκεψη στο Προξενείο της Ελλάδας στην χώρα κατοικίας του. Πρόκεται για την ισότητα, που το Σύνταγμα της Ελλάδος ορίζει ως μία από τις θεμελιώδεις αρχές της λειτουργίας τους κράτους και της αντιμετώπισης των πολιτών.
Στην περίπτωση των αποδήμων, πρόκειται για την ανισότητα εις βάρος τους. Ενώ είναι Έλληνες πολίτες, με πλήρη δικαιώματα, όπως ακριβώς και οι Έλληνες που ζουν στην Ελλάδα, ουσιαστικώς εδώ και πολλές δεκαετίες στερούνται του δικαιώματος να ασκήσουν το εκλογικό δικαίωμά τους, αφού για να ψηφίσουν πρέπει να ταξιδεύσουν στην Ελλάδα όταν γίνονται εκλογές. Οι περισσότερες ανεπτυγμένες και αναπτυσσόμενες χώρες του κόσμου παρέχουν την δυνατότητα στους πολίτες τους που κατοικούν εκτός των συνόρων της χώρας τους, να ψηφίζουν στο Προξενείο, ή διά της επιστολικής ψήφου.
Δυστυχώς στην Ελλάδα μόνο πριν από 18 μήνες περίπου ψηφίστηκε μετά πολλών κόπων ως προϊόν πολιτικού συμβιβασμού μεταξύ της παρούσας κυβέρνησης, που επιθυμεί οι ομογενείς να ψηφίζουν και της μείζονος αντιπολίτευσης, που φοβάται την ψήφο των ομογενών, για πρώτη φορά οι απόδημοι να μπορούν να ψηφίσουν και στο Προξενείο πλησίον του τόπου διαμονής τους. Όλοι όμως οι ομογενείς που έχουν ελληνικό διαβατήριο, ή κάποιοι ομογενείς; Έτσι όπως ψηφίστηκε ο νόμος, κάποιοι μόνο ομογενείς και δυστιυχώς μία μικρή μειψηφία αυτών.
Ο νόμος σήμερα προβλέπει ότι εκτός του ότι πρέπει να είσαι εγγεγραμμένος στο Δημοτολόγιο, πρέπει και να αποδείξεις ότι κατά τα τελευταία τριάντα πέντε χρόνια είχες παρουσία στην Ελλάδα τουλάχιστον δύο έτη, αλλά και ότι την χρονιά των εκλογών ή την προηγούμενη, υπέβαλες φορολογική δήλωση στην Ελλάδα. Με αυτές τις προϋποθέσεις, το μεγαλύτερο μέρος των αποδήμων που έχουν ελληνικό διαβατήριο, στερούνται της δυνατότητος να εγγραφούν στους εκλογικούς καταλόγους των Προξενείων και να ασκήσουν το συνταγματικό δικαίωμά τους να εκλέξουν βουλευτές και κυβέρνηση.
Η παρούσα ελληνική κυβέρνηση έχει υποβάλει πρόταση για τροποποίηση του νόμου, ώστε να μπορούν να ψηφίσουν στο Προξενείο (και ίσως και με επιστολική ψήφο) όλοι οι απόδημοι που είναι Έλληνες πολίτες, χωρίς άλλη προϋπόθεση. Δυστυχώς, το Σύνταγμα προβλέπει ότι για παρόμοια ζητήματα δεν αρκεί η απλή πλειοψηφία της κυβέρνησης (που έχει 158 βουλευτές επί 300), αλλά απαιτούνται τουλάχιστον τα δύο τρίτα των βουλευτών, ήτοι διακόσιοι βουλευτές. Η κυβέρνηση έχει περί τις 158 ψήφους και μαζί με το ΚΙΝΑΛ (22) και την Ελληνική Λύση (10) μπορεί να φθάσει τους 190. Χρειάζονται όμως ψήφοι βουλευτών και από άλλα κόμματα, για να γίνει η υπέρβαση και να δοθεί πραγματικό δικαίωμα ψήφου στους αποδήμους και όχι ψήφος με περιορισμούς και «δευτέρας κατηγορίας» που προβλέπεται από το νόμο σήμερα.

Γνωρίζεις Πού Βρίσκεται Το Ακίνητό Σου Στην Ελλάδα;

Πολλοί Έλληνες που κατοικούν εκτός Ελλάδος, αλλά και αλλοδαποί που έχουν ακίνητα στην Ελλάδα, χρειάζεται να δηλώσουν το σπίτι, το διαμέρισμα ή το οικόπεδό τους στην εφορία, στο Κτηματολόγιο ή στον Δήμο, ή θέλουν να τα πουλήσουν ή να τα δώσουν στα παιδιά τους. Συχνά, ο εντοπισμός του ακινήτου τους είναι εύκολος, διότι έχουν ένα σύγχρονο τοπογραφικό που αποτυπώνει την θέση και τα όρια του ακινήτου. Εάν δεν έχουν πρόσφατο τοπογραφικό, μπορεί να είναι σε θέση να υποδείξουν σε πολιτικό μηχανικό ή τοπογράφο την θέση που βρίσκεται το ακίνητο και τα όριά του, ώστε να συνταχθεί τώρα ένα ακριβές τοπογραφικό, με συντεταγμένες και πλήρη στοιχεία εντοπισμού.
Ο εντοπσμός ενός ακινήτου στην Ελλάδα είναι πολύ σημαντικός, διότι αν δεν μπορεί να βρεθεί το ακίνητο, ώστε να καταγραφούν η επιφάνειά του, η θέση του, τα όριά του, αλλά και τυχόν πολεοδομικές παραβάσεις ενός κτίσματος, δεν μπορεί να γίνει αποδοχή κληρονομίας, πώληση, γονική παροχή και άλλες μεταβιβάσεις του ακινήτου, ούτε σωστή δήλωση στην εφορία, ούτε και δήλωση στο Κτηματολόγιο, αλλά ούτε και διεκδίκησή του στο δικαστήριο. Εάν δεν μπορούν να γίνουν τα παραπάνω, τότε το ακίνητο χάνει την αξία του, διότι δεν μπορεί να μεταβιβασθεί, ούτε να δηλωθεί σωστά στις αρχές και μπορεί σε μερικά χρόνια να χαθεί οριστικώς από την κυριότητα του ιδιοκτήτη του, αν αυτός δεν ξέρει πού βρίσκεται.
Όσοι λοιπόν έχουν ακίνητα στην Ελλάδα και δε έχουν ασχοληθεί τευλευταία ή εδώ και πολλά χρόνια με αυτά, εάν δεν θέλουν να τα χάσουν ή να πληρώσουν αργότερα περισσότερα χρήματα για να τα εντοπίσουν και να τα δηλώσουν, καλό είναι τώρα να βρουν τα συμβόλαια που έχουν γι’ αυτά, τα έστω και παλιά τοπογραφικά και κάθε άλλο σχετικό έγγραφο, για να τα δηλώσουν όσο υπάρχει ακόμα προθεσμία, στις υπηρεσίες που πρέπει να δηλωθούν.
Πρέπει επίσης να εκμεταλλευθούν το γεγονός ότι ακόμα ζουν στην Ελλάδα συγγενείς, γείτονες στο χωριό ή φίλοι που τους εμπιστεύονται, ώστε εκείνοι να υποδείξουν τα αγροτεμάχια, τα οικόπεδα και τα σπίτια τους στον μηχανικό, για να γίνει ένα καλό και σύγχρονο τοπογραφικό και να καταγραφούν (για διαμερίσματα και μονοκατοικίες) τυχόν πολεοδομικές παραβάσεις, που συνήθως δεν απαιτούν μεγάλο κόστος νομιμοποίησης. Εάν γνωρίζουν πού βρίσκονται τα ακίνητά τους, πρέπει να έρθουν το συντομώτερο στην Πατρίδα, για να φωτογραφίσουν τα όρια των ακινήτων τους από κάθε γωνία και πλευρά και να μεριμνήσουν για την ακριβή αποτύπωσή τους με τοπογραφικό και δήλωση όπου απαιτείται, για να μην τα χάσουν στο μέλλον, είτε επειδή κανένας σε μερικά χρόνια δεν θα γνωρίζει πού βρίσκονται, ή διότι κάποιος γείτονας ή καταπατητής θα έχει προλάβει να τα δηλώσει εκείνος ως δικά του, ή επειδή το Κτηματολόγιο στην συγκεκριμένη περιοχή θα έχει “κλείσει” οριστικά και δεν θα επιτρέπονται νέες δηλώσεις, ακόμα κι αν κάνεις δικαστήριο για να αποδείξεις ότι το ακίνητο είναι δικό σου.

Many foreign residents wish to obtain the Greek citizenship and an EU passport, based on the fact that one or both of their parents were born in Greece. Such a case may involve bureaucratic and persistent work, but it is usually straightforward and can lead to the acquisition of the citizenship by the foreign-born person, if the legal conditions are met. For some applicants, though, it is one or more of their grandparents (and not parents) who were born in Greece.
In the case were the citizenship is claimed because of a Greek - born grandparent, apart from other requirements, the Greek administration has recently adopted the view that the child of the grandparent, meaning the parent of the present applicant, must today be in life, in order to be able to apply first for the citizenship. This means that if the applicant is the grandchild of the Greek - born grandparent, the parent of the grandchild, who is the child of the Greek - born grandparent, must first apply and once the parent gets the citizenship, the grandchild can then apply for the citizenship as well.
For decades and until a couple of months ago, the Greek administration dealing with citizenship applications, did not insist in most cases that the "intermediary" Greek (the parent) get the citizenship first, in order the grandchild to obtain it, too. Recently, however, a new law introduced in October 2020 has led the officials of the Greek administration to partially change the process, so that now it has become mandatory that the parent must first apply for and obtain the Greek citizenship, before the child can apply subsequently.
It is obvious, therefore, that in the case where the "original" Greek is the grandparent (the one born in Greece as a Greek citizen), only if his/her child is in life and can first get the citizenship, the adult grandchild can apply for the citizenship, as well. This means that those who wish to obtain a Greek passport, based on the fact that their grandparent was born in Greece, apart from satisfying several other requirements, like finding all the birth and marriage certificates and having all the names without significant spelling changes, one basic requirement is also to be able to have their parent apply for the citizenship, before they can apply themselves.
Those who do not satisfy the above or other conditions, cannot apply for the citizenship under the basic process. They can, however, apply through an alternative process, under article 10 of the Code of Greek Citizenship, provided they speak at least some Greek and know the very basics of Greek history and culture.

Resident of Greece Inherits Foreign Estate

If a resident of Greece or a foreign resident inherits property or any type of assets located in Greece, it is mainly Greek law which will determine the process of the transfer of the assets (movable or immovable) from the deceased to the heir. Only if the deceased was a foreign and not a Greek citizen, it is the law of his citizenship country which will determine who inherits what. But Greek law will still determine the process of the transfer of ownership of the estate located in Greece. If, on the other hand, the estate assets are located outside of Greece, it is usually the foreign law, meaning the law of the country where the assets are located, which is applicable for the legal transfer of the estate assets to the heirs.
When that process is completed, the resident of Greece will receive his/her share from the foreign estate, whether this is movables and cash, or ownership rights on immovable property located in the foreign country. The question which concerns many tax residents of Greece, who inherit foreign assets, is whether they have to declare their inherited share to the Greek tax authority and whether they have to pay to the Greek state inheritance tax.
The basic law governing such a situation is the Code of Inheritance, Donations and Parental Gifts in Greece. From the combined application of mainly articles 3 and 25 we reach the conclusion that a Greek taxpayer (meaning a tax resident of Greece), who inherits a foreign estate, will not have to pay inheritance tax in Greece at all, if the assets which he/she inherits are immovable property located in another country, outside of Greece. This means that if you are a tax resident of Greece and you inherit immovable property, (plots, buildings, apartments, houses etc.) located outside of Greece, you do not have to file an inheritance tax declaration in Greece, because you do not have to pay inheritance tax in Greece for inherited real estate assets abroad. However, you must consult with an accountant / tax advisor in Greece on how you will declare the foreign immovable property you inherited, in your tax filings in Greece.
If, on the other hand, the foreign estate which you inherited consists of movables and particularly cash (money at a foreign bank), a very important distinction must be made whether the deceased was a tax resident of Greece the last ten years before his/her passing or not. If the deceased, who left a balance in bank accounts at a foreign bank, was a foreign tax resident and not a Greek tax resident, for a minimum of ten years or more before his / her passing, the heir who is a Greek tax resident does not have to file an inheritance tax declaration in Greece because the heir does not have to pay inheritance tax, irrespective of the amount the heir received from abroad. When the amount of the inherited share is wired from a foreign bank to the Greek bank account of the Greek tax resident who is the heir, the Greek bank will enquire on the source of the money. The heir, who is a resident of Greece, will give to the bank copies of the basic documents of the foreign estate which prove the value of the estate and the value of the share the heir has received in Greece.
In case, however, the deceased was a tax resident of Greece the last one or more years, before his/her passing, the Greek tax resident who inherits the foreign movable assets must file an inheritance tax declaration to the Greek tax authority and be subject to payment of inheritance tax, depending on the rates and next of kin categories. Simple example: the child or spouse who live in Greece and inherit an amount up to150,000 euros each in a foreign bank by a deceased who was a Greek tax resident, do have to file the inheritance tax declaration, but will not pay inheritance tax, if they do not inherit anything else from that deceased, or if their combined share of Greek and foreign assets is not worth more than 150.000 euros. If the heir is a next of kin of the deceased, but not a child or spouse, the tax – free thresholds are lower than the 150,000 euros. No need to mention that the above is general information. For accurate advice on each separate case, one should consult with a professional, because each case has its own particularities.

Τι Γίνεται Αν Υπάρχουν Περισσότεροι Συγκύριοι;

Πολλές είναι οι περιπτώσεις στις οποίες ένα πράγμα, που συχνά είναι ένα ακίνητο, ανήκει σε περισσότερους από έναν συγκυρίους. Σε αρκετές από αυτές, δημιουργείται διαφωνία μεταξύ των συγκυρίων για το πώς είναι καλύτερα να χρησιμοποιείται το κοινό πράγμα. Χαρακτηριστική είναι η περίπτωση στην οποία ένα διαμέρισμα ή μία μονοκατοικία έχει καταλήξει να ανήκει σε δύο, τρεις ή περισσοτέρους ιδιοκτήτες, συχνά λόγω κληρονομικής διαδοχής. Οι περισσότεροι του ενός συγκύριοι διαφωνούν μεταξύ τους για το ποιός και πώς δικαιούται να χρησιμοποιεί το διαμέρισμα ή την μονοκατοικία, ή για το ποιός θα κατοικήσει σ’ αυτήν συγκεκριμένους μήνες του έτους, όπως π.χ. Ιούλιο και Αύγουστο. Σε άλλες περιπτώσεις, η διαφωνία μπορεί να αφορά το αν το κοινό πράγμα θα χρησιμοποιείται από τους συγκυρίους και με ποιόν τρόπο, ή για το αν θα εκμισθωθεί (νοικιασθεί) σε τρίτον για να αποφέρει εισόδημα στους συγκυρίους.
Εάν υπάρχει διαφωνία, προβάδισμα έχει η λύση που επιλέγει η πλειοψηφία των μεριδίων. Δηλαδή αν ένας συγκύριος έχει το 55% εξ αδιαιρέτου του κοινού πράγματος, ενώ τρεις άλλοι έχουν το υπόλοιπο 45%, την απόφαση λαμβάνει εκείνους που έχει την πλειοψηφία, δηλαδή το 55%. Αν αποφασίσει επί παραδείγματι να κρατήσει ο ίδιος το ακίνητο, η απόφασή του είναι νόμιμη και πρέπει να γίνει αποδεκτή από τους υπολοίπους συγκυρίους που έχουν την μειοψηφία του 45%. Θα υποχρεωθεί βεβαίως ο πλειοψηφών συγκύριος να αποδίδει το 45% ενός μέσου μισθώματος του ακινήτου στους μειοψηφούντες συγκυρίους. Η μειοψηφία μπορεί, ωστόσο, να εναντιωθεί στην απόφαση της πλειοψηφίας για την τακτική χρήση του κοινού πράγματος μόνο εάν η απόφαση της πλειοψηφίας δεν καταλήγει στην πιο πρόσφορη χρήση του κοινού πράγματος ή εάν ζημιώνει το πράγμα ή εάν η μειοψηφία θα επέλεγε μία λύση που θα ικανοποιούσε καλύτερα τα συμφέροντα όλων των συγκυρίων και θα απέφευγε την χειροτέρευση του κοινού.
Ο νόμος για την συγκυριότητα δεν αφορά μόνο σε ακίνητα, αλλά και σε κινητά πράγματα, όπως ένα αυτοκίνητο ταξί, το οποίο μπορεί, ως άδεια ταξί, να ανήκει όχι σε έναν, αλλά σε δύο ιδιοκτήτες. Η περίπτωση περιγράφεται στην υπ’ αριθ. 36/2021 απόφαση του Πολυμελούς Πρωτοδικείου Πατρών. Δύο ιδιοκτήτες απέκτησαν 50/50 μία άδεια ταξί και άρχισαν να την εκμεταλλεύονται σε δύο βάρδιες ημερησίως. Για αρκετά χρόνια η συνεργασία τους ήταν αρμονική. Μετά όμως από ένα μεγάλο χρονικό διάστημα ομαλής συνεργασίας, προέκυψαν σημαντικές διαφωνίες μεταξύ των δύο συγκυρίων του ταξί, τόσο ως προς την καταβολή των κοινών λειτουργικών δαπανών του αυτοκινήτου, όσο και για τον τρόπο διαχειρίσεως του ταξί και της αδείας εκμεταλλεύσεως αυτού, αλλά και για το εάν ο ένας εκ των δύο συγκυρίων μπορούσε ή όχι να προσλάβει άλλον οδηγό που να οδηγεί το ταξί στην δική του βάρδια.
Ο ένας εκ των συνιδιοκτητών του ταξί προσέφυγε στο δικαστήριο και απέδειξε ότι υπήρχε διαφωνία μεταξύ των δύο συνεταίρων, αλλά και ανάγκη να ρυθμισθεί η διαχείριση του κοινού πράγματος (ταξί) από το δικαστήριο, αφού ο δύο συγκύριοι δεν μπορούσαν πλέον να τα βρουν μεταξύ τους. Πρότεινε δε τον τρόπο κοινής λειτουργίας του ταξί που εκείνος θεωρούσε πιο πρόσφορο και επωφελή για αμφοτέρους τους συγκυρίους και για το κοινό τους περιουσιακό αντικείμενο.
Το δικαστήριο έκανε δεκτή την αγωγή του συγκυρίου και όρισε αναλυτικώς τον τρόπο με τον οποίο θα πρέπει από εδώ και στο εξής να γίνεται η κοινή χρήση του αυτοκινήτου, δηλαδή τις βάρδιες, τον τρόπο καταγραφής και καταβολής των δαπανών από την λειτουργία του ταξί και άλλα ζητήματα, απαραίτητα για την συνέχιση της εκμετάλλευσης του κοινού πράγματος από τους συνιδιοκτήτες του. Εδέχθη επίσης ότι είναι δυνατόν και επιτρεπτό οιοσδήποτε των συνιδιοκτητών του ταξί να προσλαμβάνει οδηγό, με τα προσόντα που ορίζει ο νόμος, για να εκτελεί την βάρδια του συγκυρίου που δεν μπορεί ή δεν θέλει να την κάνει ο ίδιος. Το Δικαστήριο, τέλος, όρισε ότι σε περίπτωση που ο έτερος συγκύριος του ταξί δεν συμμορφώνεται με την δικαστική απόφαση, θα πρέπει να καταβάλει χρηματική ποινή ύψους 500 ευρώ και θα μπορεί να του επιβάλλεται και προσωπική κράτηση ενός μηνός, για κάθε παράβαση της απόφασης.
