In the last six years, as the economic crisis was heading to an end, Greece has been experiencing a real estate boom. Values of immovable property have gone up, in most areas prices have reached the pre-crisis levels of 2009 (during the period of hardship there was a 40% average drop), and in some parts of the country prices have gone even higher. Within this climate, many Greeks and foreigners focus on out-of-city-limits parcels of land as suitable opportunities for investment.
Zoning regulations in Greece divide land into two main categories. Land inside the city, town or village limits, where smaller in size plots can be developed into houses or buildings, and out-of-city-limits tracts of land, where in general you are not allowed to build unless you own a parcel of minimum of 4,000 square meters provided additional building requirements are met. The general rule for decades has been that if you own a parcel of minimum 4,000 s.m. you are allowed to build a home of about 150 – 200 s.m. possibly with some additional underground space. That is why from 1928, when building on parcels outside the town or village limits was allowed for the first time, until the beginning of 2023, the general public knew that such a parcel had value if it had a minimum size of 4,000 s.m. while exceptions permitted building on even smaller parcels, if they faced one or more roads etc. However, there were cases where even parcels which did not have direct access to any type of road (“blind” parcels, as they are called), could also be built upon, provided they had a minimum size of 4,000 s.m.
In the beginning of 2023, however, the Supreme Administrative Court of Greece (equivalent to the Conseil d' État in France), issued one and then more rulings which created a small revolution, by adding for the first time more requirements for the buildability of out-of-city-limits parcels. In plain words, according to these court rulings, the minimum size of 4,000 s.m. for such a parcel of land does not ensure that the parcel is buildable. This means that hundreds of thousands of parcels all over Greece (some talk about two million parcels), which had a certain market value for decades, because their owners and potential buyers knew they could build a house of about 180 s.m. give or take, may not be buildable anymore and their development fate and value are uncertain, to say the least.
By losing their “buildability” such parcels of land may result in losing roughly 80% of their value. If we take into consideration that the vast majority of the lower and middle class families in Greece own one or more of these out-of-city-limits parcels, we can grasp the economic damage inflicted upon a vast section of the Greek society. In addition, anyone thinking of investing in the purchase of such parcels must know that, at this specific time, their legal and zoning regime may be like shifting sands. After the Supreme Court rulings of 2023, prospective buyers of these parcels of land cannot be certain whether they will be able to legally build a house or any construction on them. If they can’t build, the value of the parcel will sharply decline and much fewer people will think it is worth buying.
The Court’s recent decisions and certain government laws during the years have added more building requirements, which include the precondition that the parcels of minimum 4,000 s.m. must have also been formed before a certain time (year 2003 or 1985 etc.), that the parcels must have a face of minimum 25 meters on a road, that this road must have been officially recognized by the Greek state and some more, which add to the confusion and make the decision whether a specific parcel is buildable or not, presently, a difficult and uncertain exercise. Even some building authorities around Greece have temporarily stopped issuing permits to build on such parcels until the rules are properly defined. The present Greek government is about to pass a highly anticipated law, which the real estate market, lawyers, notaries and above all civil engineers, hope that will clarify the legal regime of the parcels of land lying outside the city limits in order to allow owners and buyers to know the rules by which they will make their investment decisions.

Η προθεσμία για να δηλωθεί μία κληρονομιά στην ελληνική εφορία έγινε εννέα μήνες από τον θάνατο του κληρονομουμένου, από έξι που ήταν μέχρι προσφάτως. Αυτό ισχύει για τους κληρονόμους που είναι κάτοικοι Ελλάδος, εφόσον και ο κληρονομούμενος απεβίωσε στην Ελλάδα, ανεξαρτήτως του αν η κληρονομία βρίσκεται στην Ελλάδα ή στο εξωτερικό. Εάν ο κληρονόμος είναι κάτοικος εξωτερικού, ή εάν ο κληρονομούμενος απεβίωσε στο εξωτερικό, η προθεσμία για να δηλωθεί η κληρονομία στην εφορία είναι δώδεκα μήνες. Η προθεσμία των εννέα ή δώδεκα μηνών ισχύει εφόσον ο θανών απεβίωσε αδιάθετος, δηλαδή δεν έχει δημοσιευθεί διαθήκη. Εάν υπάρχει δημοσιευθείσα διαθήκη, στην Ελλάδα ή στο εξωτερικό, η προθεσμίες αρχίζουν να μετρούν από την ημέρα δημοσίευσης της διαθήκης. Στην περίπτωση που η διαθήκη έχει δημοσιευθεί στο εξωτερικό και απλώς καταχωρείται στην Ελλάδα για να ισχύσει, η προθεσμία εκκινεί από την δημοσίευση στο εξωτερικό.
Εάν οι κληρονόμοι δεν προλάβουν να υποβάλουν δήλωση εντός των άνω προθεσμιών συνήθως δεν έρχεται το τέλος του κόσμου και δεν χάνουν τα δικαιώματά τους επί της κληρονομίας. Αν η αξία του μεριδίου τους είναι κάτω από το αφορολόγητο όριο, για την εκπρόθεσμη δήλωση της κληρονομίας θα τους επιβληθεί απλώς ένα πρόστιμο που σήμερα είναι 102,40 ευρώ για κάθε κληρονόμο. Αν όμως η αξία του μεριδίου τους είναι πάνω από το αφορολόγητο, οπότε θα προκύπτει φόρος κληρονομίας, αυτός ο φόρος κάθε μήνα που περνάει μετά την λήξη της προθεσμίας αυξάνεται με ένα επιτόκιο που είναι περίπου 0,73 % κάθε μήνα.
Ο κληρονόμος ή οι κληρονόμοι υποχρεούνται από την στιγμή που μαθαίνουν ότι δικαιούνται κληρονομικού μεριδίου, να εντοπίσουν τα στοιχεία της κληρονομίας, ήτοι ακίνητα, κινητά, μετρητά χρήματα, υπόλοιπα τραπεζικών λογαριασμών, μετοχές κλπ., να υπολογίσουν την αξία τους, να περιγράψουν τα ακίνητα και να τα δηλώσουν τελικώς ως σύνολο στην εφορία. Όταν τα περιουσιακά αυτά στοιχεία βρίσκονται στην Ελλάδα, η εξεύρεση και η περιγραφή τους μπορεί να είναι ευκολώτερη ή να μην παρουσιάζει πολλά προβλήματα. Αντιθέτως, όταν τα στοιχεία της κληρονομίας βρίσκονται εκτός Ελλάδος, ο εντοπισμός τους, ο υπολογισμός της αξίας τους, αλλά και η πραγματική κτήση τους από τον κληρονόμο συνήθως απαιτεί πολύ περισσότερο χρόνο. Στο σημείο αυτό εντοπίζουμε ένα κενό στην ελληνική νομοθεσία που οδηγεί σε μία αδικία εις βάρος του κληρονόμου που καλείται να εντοπίσει και να υπολογίσει την αξία περιουσιακών στοιχείων στο εξωτερικό, όπου δεν γνωρίζει πρόσωπα και καταστάσεις, ούτε τον νόμο και τις διαδικασίες μίας χώρας τους εξωτερικού εν σχέσει προς την λήψη υπολοίπων τραπεζικών λογαριασμών εξωτερικού, αλλά και ολόκληρων χαρτοφυλακίων επενδυτικών προϊόντων, ακινήτων σε άλλες χώρες, διαδικασιών δημοσίευσης διαθήκης και εκτίμησης ακινήτων στην αλλοδαπή.
Για να τα βρει όλα αυτά στο εξωτερικό ο κληρονόμος που διαμένει στην Ελλάδα χρειάζεται χρόνο και η προθεσμία που του δίνει ο νόμος, δηλαδή μόνο εννέα μήνες, όσο δηλαδή και για την περιουσία που βρίσκεται στην Ελλάδα, συνήθως δεν επαρκεί. Αυτό το κενό του νόμου, δηλαδή το γεγονός ότι για κληρονόμο κάτοικο Ελλάδος με κληρονομούμενο που απεβίωσε επίσης στην Ελλάδα, αλλά η κληρονομία βρίσκεται στο εξωτερικό, η προθεσμία για την υποβολή της δήλωσης φόρου κληρονομίας είναι μόνο εννέα μήνες, όσο και για την κληρονομία που βρίσκεται στην Ελλάδα, δημιουργεί μία αδικία εις βάρος του κληρονόμου που καλείται να εντοπίσει και να εκτιμήσει κληρονομιαία στοιχεία στο εξωτερικό. Αποτέλεσμα της σχετικά μικρής προθεσμίας των εννέα μηνών για κληρονομία στο εξωτερικό είναι η αδυναμία υποβολής της δήλωσης εμπροθέσμως και η επιβολή προστίμου ή προσαυξήσεων στον φόρο κληρονομίας, λόγω εκπρόθεσμης δήλωσης.
Για τους λόγους αυτούς, ο κληρονόμος που κατοικεί στην Ελλάδα αλλά μαθαίνει ότι δικαιούται κληρονομίας στο εξωτερικό ενώ ο κληρονομούμενος ζούσε στην Ελλάδα, πρέπει να κινηθεί γρήγορα ώστε να μάθει ποια είναι τα στοιχεία της κληρονομίας στο εξωτερικό, ποια η περιγραφή και η αξία τους και πώς θα τα αποκτήσει στην πράξη, για να αποφύγει πρόστιμα και προσαυξήσεις φόρων στην Ελλάδα και για να καταφέρει εγκαίρως να αποκτήσει την κατοχή των κληρονομιαίων (π.χ. να λάβει τα χρήματα από το εξωτερικό στην Ελλάδα), για να μπορεί να καταβάλει και τους σχετικούς φόρους κληρονομίας, αν το κληρονομικό μερίδιό του υπερβαίνει το εκάστοτε αφορολόγητο όριο.

Αν και το Κτηματολόγιο λειτουργεί στις περισσότερες περιοχές της Ελλάδας εδώ και πολλά χρόνια, υπάρχουν ακόμα ιδιοκτήτες που δεν έχουν δηλώσει τα ακίνητά τους για να καταχωρηθούν στο Κτηματολογικό Γραφείο. Σήμερα Κτηματολόγιο λειτουργεί στις περισσότερες περιοχές της χώρας, ενώ λίγες έχουν μείνει ακόμα στο στάδιο όπου οι ιδιοκτήτες ακινήτων καλούνται τώρα να τα δηλώσουν για να ενταχθούν στο νέο σύστημα καταγραφής και περιγραφής ακινήτων.
Η Δήλωση στο Κτηματολόγιο περιλαμβάνει οπωσδήποτε φωτοτυπία του συμβολαίου με το οποίο ο ιδιοκτήτης έχει αποκτήσει το ακίνητο, είτε το αγόρασε, είτε το κληρονόμησε, είτε το έλαβε ως γονική παροχή ή δωρεά ή με όποιον άλλο τρόπο έχει αποκτήσει την κυριότητα ή άλλο εμπράγματο δικαίωμα επ’ αυτού. Για την Δήλωση χρειάζονται ακόμα πιστοποιητικό μεταγραφής του συμβολαίου στο υποθηκοφυλακείο, διαβατήριο ή ταυτότητα του ιδιοκτήτη, ο Αριθμός Φορολογικού Μητρώου του (ΑΦΜ) και πρόσφατο τοπογραφικό με συντεταγμένες αν πρόκειται για οικόπεδο, αγροτεμάχιο ή μονοκατοικία. Μπορεί κατά περίπτωση να χρειασθούν και άλλα έγγραφα, αλλά τα ανωτέρω είναι τα βασικά. Ο ιδιοκτήτης του δεν είναι απαραίτητο να έρθει στην Ελλάδα για να το δηλώσει. Μπορεί να υπογράψει πληρεξούσιο ή εξουσιοδότηση σε πρόσωπο που εμπιστεύεται στην Ελλάδα για να γίνει σωστά η δήλωση χωρίς να χρειάζεται αυτοπρόσωπη παρουσία του στις υπηρεσίες του Κτηματολογίου. Η Δήλωση γίνεται και ηλεκτρονικά, αλλά οι περισσότεροι ιδιοκτήτες που ζουν εκτός Ελλάδος δεν γνωρίζουν τον τρόπο που μπορεί να γίνει πρακτικά από τον υπολογιστή τους, ενώ χρειάζονται και συμβουλές από ειδικούς.
Εάν το ακίνητο είναι διαμέρισμα σε πολυκατοικία, ο εντοπισμός του δικαιώματος γίνεται ευκολώτερα, ενώ εάν είναι οικόπεδο ή αγροτεμάχιο εκτός σχεδίου, ο εντοπισμός του μπορεί να είναι πιο δύσκολος. Αν το ακίνητο δεν εντοπισθεί, δεν μπορεί να καταχωρηθεί στην βάση δεδομένων του Κτηματολογίου και θα χρειασθούν περισσότερες ενέργειες από τον ιδιοκτήτη για να γίνει ο σωστός εντοπισμός του. Αν δεν υπάρχει πρόσφατο τοπογραφικό, πρέπει να γίνει τώρα και θα πρέπει να περιλαμβάνει συντεταγμένες του οικοπέδου ή του αγροτεμαχίου.
Η Δήλωση κάθε ακινήτου στο Κτηματολόγιο είναι υποχρεωτική, διότι χωρίς αυτήν το ακίνητο θα παύσει να έχει αξία για τον ιδιοκτήτη του, αφού δεν θα μπορεί να το πουλήσει, να το μεταβιβάσει με γονική παροχή στα παιδιά του, να το δωρίσει ή να το προσημειώσει για να πάρει δάνειο από τράπεζα. Εκτός αυτών, μετά από μερικά χρόνια το ακίνητο που δεν έχει δηλωθεί στο Κτηματολόγιο, στο οποίο δεν θα έχει το όνομα του ιδιοκτήτη του αλλά θα αναφέρεται ως αγνώστου ιδιοκτήτη, θα μεταβιβασθεί αυτομάτως στην κυριότητα του ελληνικού δημοσίου. Ο πρώην πλέον ιδιοκτήτης του θα το έχει χάσει και θα δικαιούται μόνο να ζητήσει αποζημίωση από το κράτος αντιστοιχούσα στην αξία του ακινήτου, του οποίου την κυριότητα έχασε επειδή δεν το δήλωσε στο Κτηματολόγιο.
Στις περισσότερες περιοχές της Ελλάδας επιτρέπεται ακόμα να δηλωθούν ακίνητα, παρά το ότι μπορεί να έχουν παρέλθει οι προθεσμίες για την υποβολή δηλώσεων. Στην χειρότερη περίπτωση, ο ιδιοκτήτης που δεν έμαθε ποτέ ή αμέλησε να το δηλώσει στην κτηματογράφηση, μπορεί να καταθέσει στο δικαστήριο σχετικό αίτημα για την αναγνώριση της κυριότητάς του στο συγκεκριμένο ακίνητο και την καταχώρησή του στο όνομά του στο Κτηματολόγιο. Εάν το μη δηλωθέν μέχρι σήμερα ακίνητο είναι διαμέρισμα σε πολυκατοικία, εφόσον οι ιδιοκτήτες των λοιπών διαμερισμάτων της ίδιας πολυκατοικίας τα έχουν ήδη δηλώσει, η δήλωση του διαμερίσματος μπορεί να είναι λιγότερο δύσκολη.
Αν όμως το ακίνητο είναι αγροτεμάχιο, οικόπεδο ή μονοκατοικία, μπορεί να χρειασθεί προσφυγή στο δικαστήριο για να γίνει δεκτή η δήλωσή του στο Κτηματολόγιο. Υπάρχουν ωστόσο και περιοχές της Ελλάδας που δεν υπάρχει η δυνατότητα ούτε δικαστηρίου, ούτε άλλης διαδικασίας για μη δηλωθέντα ακίνητα. Αυτοί που δεν έχουν δηλώσει τα ακίνητά τους είναι συχνά ομογενείς ή κάτοικοι εξωτερικού, που δεν έχουν επικοινωνία με την Ελλάδα και δεν πληροφορήθηκαν ποτέ ότι πρέπει να υποβάλουν δήλωση στο Κτηματολόγιο. Πρόκειται επίσης για κληρονόμους ακινήτων που για διάφορους λόγους δεν έχουν ολοκληρώσει την διαδικασία της κληρονομικής διαδοχής. Στις περισσότερες των περιπτώσεων υπάρχει ακόμα χρόνος για να διευθετήσουν τα της κληρονομίας και να δηλώσουν τα ακίνητα στο όνομά τους, αρκεί να γνωρίζουν την τοποθεσία που βρίσκεται το ακίνητο, ποιός ήταν ο προηγούμενος ιδιοκτήτης του, αν αυτός έχει αποβιώσει, πόσους κληρονόμους είχε, ποιοί είναι οι πλησιέστεροι συγγενείς, αν κάποιος χρησιμοποιεί το ακίνητο σήμερα και αν υπάρχουν συμβόλαια, τοπογραφικά ή άλλα έγγραφα που περιγράφουν την νομική ιστορία του ακινήτου. Τις πληροφορίες για το ακίνητο, την κληρονομιά και τα σχετικά έγγραφα πρέπει να τα συζητήσουν το συντομώτερο δυνατό με δικηγόρο στην Ελλάδα, για να λάβουν συμβουλές για το πώς μπορούν να προστατεύσουν τα δικαιώματά τους και να διασώσουν την κυριότητα, συνεπώς και την αξία ενός ή περισσοτέρων ακινήτων.

Ο ελληνισμός έχει την ευτυχία να διαθέτει έναν πολύ μεγάλο αριθμό Ελλήνων εκτός των συνόρων του ελληνικού κράτους. Οι ομογενείς έχουν ισχυρή παρουσία σε χώρες όπως οι ΗΠΑ, ο Καναδάς, η Αυστραλία, η Γερμανία και αρκετές άλλες ανά τον κόσμο. Τα Προξενεία της Ελλάδος στο εξωτερικό πρέπει να εργάζονται για να εξυπηρετούν τους ομογενείς, αλλά και τους αλλοδαπούς που επιθυμούν να επενδύσουν ή απλώς να ζήσουν στην Ελλάδα.
Μία από τις πλέον διαδεδομένες ενέργειες που οι ομογενείς πραγματοποιούν στο Προξενείο είναι η υπογραφή πληρεξουσίου προς τον εντολέα τους στην Ελλάδα, για διενέργεια κάποιας νομικής πράξης, όπως αγορά ή πώληση ακινήτου, αποδοχή κληρονομίας, μίσθωση ακινήτου, άνοιγμα και διαχείριση τραπεζικού λογαριασμού κλπ. Ο Πρόξενος της Ελλάδος στο εξωτερικό ή ο αρμόδιος που ενεργεί αντ’ αυτού, εκτελεί χρέη που ομοιάζουν με εκείνα του συμβολαιογράφου.
Το πρόσωπο που υπογράφει το πληρεξούσιο και παρέχει πληρεξουσιότητα σε άλλο ή άλλα πρόσωπα στην Ελλάδα, δηλαδή ο ομογενής ή αλλοδαπός εντολέας, πρέπει να γνωρίζει καλά το περιεχόμενο του πληρεξουσίου και να το αποδέχεται πλήρως. Συνεπώς, αυτός που δίνει πληρεξουσιότητα σε κάποιον άλλον για διενέργεια πράξεων στην Ελλάδα, επειδή ο εντολέας δεν μπορεί να βρεθεί ή να παραμείνει στην Ελλάδα για όσο χρόνο απαιτούν οι συγκεκριμένες νομικές ενέργειες, πρέπει να γνωρίζει πολύ καλά το κείμενο του πληρεξουσίου και να καταλαβαίνει τι είδους εντολές και εξουσίες δίνει στον πληρεξούσιό του που θα ενεργήσει στο όνομά του στην Πατρίδα. Επομένως, ο εντολέας πρέπει να θέλει να υπογράψει το συγκεκριμένο πληρεξούσιο. Αυτονόητο είναι ότι ο εντολέας πρέπει να έχει εμπιστοσύνη στον πληρεξούσιό του, δηλαδή στο πρόσωπο που αναλαμβάνει την ευθύνη να διενεργήσει σημαντικές πράξεις, με συχνά οικονομικό αντίκτυπο για την τσέπη του εντολέα. Αυτονόητο είναι επίσης και ότι ο εντολοδόχος, δηλαδή ο πληρεξούσιος στην Ελλάδα που λαμβάνει την εντολή να ενεργήσει πράξεις για τον εντολέα του που μένει στο εξωτερικό, αναλαμβάνει μία σημαντική ευθύνη για την ορθή εκτέλεση των εντολών, πάντοτε προς το συμφέρον του εντολέα του.
Η πρακτική που ακολουθούν τα Προξενεία της Ελλάδος είναι να ζητούν να τους αποσταλεί το προσχέδιο πληρεξουσίου έτοιμο με ηλεκτρονικό μήνυμα και μάλιστα σε πρόγραμμα word, ώστε να μπορούν να το αντιγράψουν εύκολα και χωρίς να το ξαναγράφουν, ενώ ακολούθως συμπληρώνουν πρόσθετο κείμενο στην αρχή μόνο και στο τέλος του πληρεξουσίου και μετά συνεννοούνται με τον ομογενή για το ραντεβού της υπογραφής του πληρεξουσίου. Το Προξενείο έχει την ευθύνη το κείμενο του πληρεξουσίου να είναι σύννομο και να είναι απολύτως κατανοητό στον εντολέα. Για τον λόγο αυτόν ο αρμόδιος του Προξενείου μπορεί εμμέσως ή και αμέσως, να ελέγξει εάν ο εντολέας που θέλει να το υπογράψει καταλαβαίνει την ελληνική γλώσσα, αλλά και αν αντιλαμβάνεται το νόημα και τις βασικές συνέπειες του πληρεξουσίου, ότι δηλαδή καταλαβαίνει τι θα υπογράψει.
Πέραν αυτού, το Προξενείο δεν έχει αρμοδιότητα να αποφασίσει για το είδος των εντολών που θα περιληφθούν στο πληρεξούσιο. Αυτό το αποφασίζουν συνήθως ο συμβολαιογράφος ή ο δικηγόρος στην Ελλάδα, που έχουν αναλάβει την ευθύνη να συμβουλεύσουν τον εντολέα που ζει στο εξωτερικό, για το ποιο πρέπει να είναι το περιεχόμενο του πληρεξουσίου, όπως επιτάσσει ο νόμος στην Ελλάδα. Μόνο ο δικηγόρος, επί παραδείγματι, μπορεί να γνωρίζει τι απαιτεί ο νόμος για να εκτελεσθούν στην Ελλάδα μεγάλος αριθμός συνδυασμένων ενεργειών, σε πολλές δημόσιες υπηρεσίες, με διαφορετικές και πολλαπλές απαιτήσεις, ώστε ο ομογενής να επιτύχει το αποτέλεσμα που επιθυμεί, δηλαδή να κάνει την γονική παροχή στο παιδί του, να πάρει τα χρήματα από την τράπεζα, να αποδεχθεί μία κληρονομία, να πωλήσει ή να αγοράσει ένα ακίνητο, να χωρίσει τα ακίνητα που έχει με τους συγγενείς του, να εκπροσωπηθεί σωστά σε ένα δικαστήριο στην Ελλάδα κλπ.
Ο δικηγόρος έχει αναλάβει επωνύμως την ευθύνη της υπόθεσης, έχει συνομιλήσει και συναντηθεί επανειλημμένως με τον ομογενή, έχει ακούσει τις απλές ή περίπλοκες επιθυμίες του, έχει εντάξει την υπόθεση στο σωστό νομικό πλαίσιο και έχει διαγνώσει ποιες νομικές ενέργειες απαιτούνται για να εκτελεσθούν οι εντολές του ομογενή. Ακολούθως έχει συντάξει το σχέδιο πληρεξουσίου. Ο αρμόδιος του Προξενείου ούτε γνωρίζει το εύρος και τις ορατές ή κρυφές πτυχές της υπόθεσης, ούτε την νομική και πρακτική στρατηγική που πρέπει να ακολουθηθεί, ούτε ευθύνη αναλαμβάνει για την επιτυχή ολοκλήρωση της υπόθεσης στην Ελλάδα, ούτε δικαιούται να παρέχει νομικές συμβουλές, διότι δεν είναι δικηγόρος και δεν γνωρίζει τις μελλοντικές συνέπειες των νομικών ενεργειών, ούτε πώς η μία ενέργεια μπορεί να συσχετισθεί με μία άλλη. Αρμοδιότητα του υπευθύνου του Προξενείου είναι να ελέγξει την νομιμότητα του κειμένου του πληρεξουσίου, όπως και το αν το καταλαβαίνει ο ομογενής και ακολούθως να επιμεληθεί ώστε αυτό να υπογραφεί σωστά. Την υποχρέωση για την εκτέλεση των εντολών του πληρεξουσίου επιφορτίζεται ο εντολοδόχος στην Ελλάδα, που μπορεί να είναι συγγενής ή φίλος του εντολέα ή ο δικηγόρος του, που έχει και την τελική ευθύνη για την ορθή εξέλιξη της υπόθεσης και εκ του νόμου υπέχει ευθύνη λογοδοσίας προς τον εντολέα για όλες τις ενέργειες που θα εκτελέσει στο όνομα του εντολέως, περιλαμβανομένης και της απόδοσης λογαριασμού για τις οικονομικές συναλλαγές που θα εκτελεσθούν για τον εντολέα.

Ο κάτοικος εξωτερικού που έχει ακίνητο στην Ελλάδα και θέλει να το πουλήσει, πρέπει να αποφασίσει εάν θα πουλήσει σε οποιονδήποτε αγοραστή που θα συμφωνήσει να πληρώσει τα χρήματα που ζητάει ο πωλητής, δηλαδή ακόμα και σε αγοραστές που θα πάρουν δάνειο από την τράπεζα για να πληρώσουν τον πωλητή του ακινήτου, ή αν θα πουλήσει μόνο σε όσους του δώσουν μετρητά χρήματα, χωρίς δάνειο από τράπεζα. Αν πουλήσεις το ακίνητό σου σε κάποιον που θα σου δώσει μετρητά, λαμβάνεις τα χρήματά σου από την πώληση πρώτον με μία μικρή προκαταβολή όταν δώσετε τα χέρια για το πώληση και δεύτερον όταν υπογράψετε στον συμβολαιογράφο το συμβόλαιο της πώλησης. Η καταβολή του τιμήματος γίνεται με τραπεζική επιταγή ή με μεταφορά των χρημάτων με ηλεκτρονική τραπεζική (internet banking) από τον λογαριασμό του αγοραστή στον λογαριασμό του πωλητή την ώρα της υπογραφής του συμβολαίου. Πρώτα θα πρέπει να δει ο πωλητής ότι πράγματι το τίμημα πιστώθηκε ηλεκτρονικά στον τραπεζικό του λογαριασμό και μετά να υπογράψει το συμβόλαιο της πώλησης.
Όταν ο πωλητής έχει τραπεζικό λογαριασμό στην Ελλάδα, η πώληση ολοκληρώνεται με ένα συμβόλαιο. Ο πωλητής λαμβάνει την τραπεζική επιταγή που του δίνει ο αγοραστής και την ίδια ή την επόμενη μέρα την πηγαίνει στην τράπεζά του και την καταθέτει στον λογαριασμό του. Δεν έχει σημασία αν ο πωλητής είναι κάτοικος Ελλάδος ή κάτοικος εξωτερικού. Σημασία έχει να διατηρεί έναν τουλάχιστον τραπεζικό λογαριασμό στην Ελλάδα, ο οποίος να είναι επικαιροποιημένος και ενεργός.
Εάν όμως ο αγοραστής έχει συμφωνήσει με τον πωλητή ότι θα καταβάλει όλο ή μέρος του τιμήματος όχι τοις μετρητοίς, την ώρα της υπογραφής του συμβολαίου πώλησης, αλλά με δάνειο που θα πάρει από τράπεζα, τότε ο πωλητής που δεν έχει τραπεζικό λογαριασμό στην Ελλάδα θα έχει δυσκολία να εισπράξει το τίμημα. Αυτό συμβαίνει διότι η τράπεζα που θα χορηγήσει το δάνειο στον αγοραστή για να αγοράσει το ακίνητο, θα του το δώσει μετά από συνήθως δύο μήνες από την υπογραφή του συμβολαίου. Η χορήγηση του δανείου θα γίνει με μία τραπεζική επιταγή, εκδοθείσα από την ελληνική τράπεζα, η οποία γίνεται δεκτή σε όλες τις ελληνικές τράπεζες, όχι όμως στις τράπεζες του εξωτερικού.
Επομένως, ο πωλητής του ακινήτου που ζει στο εξωτερικό και πουλάει το ακίνητό του στην Ελλάδα, δεν θα μπορεί να εισπράξει το τίμημα από την πώληση του ακινήτου του, εφόσον δεν έχει λογαριασμό σε τράπεζα στην Ελλάδα. Κάποιες φορές είναι εφικτό η ελληνική τράπεζα που χορηγεί το δάνειο να εκταμιεύσει το ποσό του δανείου απ’ ευθείας στον τραπεζικό λογαριασμό του πωλητή σε χώρα του εξωτερικού. Αυτό όμως δεν είναι σίγουρο ότι μπορεί να γίνει σε όλες τις περιπτώσεις χορήγησης δανείου και αποτελεί μάλλον την εξαίρεση παρά τον κανόνα.
Εάν ο πωλητής του ακινήτου που ζει εκτός Ελλάδος έχει τραπεζικό λογαριασμό στην Ελλάδα, τότε πρέπει να προσθέσει στο πληρεξούσιο που θα έχει υπογράψει σε δικηγόρο ή άλλο έμπιστο πρόσωπο στην Ελλάδα, λεπτομερή εντολή για λήψη παντός είδους τραπεζικών επιταγών και κατάθεσή τους τόσο σε λογαριασμό του πληρεξουσίου, όσο και κυρίως σε τραπεζικό λογαριασμό του πωλητή στην Ελλάδα. Γενικώς, η πώληση ακινήτου από κάτοικο εξωτερικού γίνεται λίγο πιο περίπλοκη, αν ο πωλητής δεν διατηρεί τραπεζικό λογαριασμό στην Ελλάδα.
Αν μεν η πώληση γίνεται με πλήρη εξόφληση του τιμήματος με την υπογραφή του συμβολαίου, ακόμα κι αν ο πωλητής δεν έχει τραπεζικό λογαριασμό στην Ελλάδα, μπορεί να συμφωνηθεί να λάβει τα χρήματά του σε λογαριασμό στο εξωτερικό. Σ’ αυτήν την περίπτωση θα απαιτηθούν δύο συμβόλαια για την πώληση. Το πρώτο και κύριο συμβόλαιο της πώλησης, που θα μεταβιβάζει την κυριότητα με περιορισμούς και θα πιστώνει το τίμημα και ένα δεύτερο, η λεγόμενη εξοφλητική πράξη, που θα υπογραφεί αφού πρώτα ο πωλητής έχει λάβει τα χρήματά του στο εξωτερικό.
Αν όμως η πώληση γίνει όχι με εξόφληση του τιμήματος με την υπογραφή του συμβολαίου, αλλά με τραπεζικό δάνειο που θα λάβει ο αγοραστής, ο πωλητής που δεν έχει λογαριασμό στην Ελλάδα δεν μπορεί να εισπράξει εύκολα το τίμημα. Αυτό θα πρέπει να συζητηθεί στην αρχή των διαπραγματεύσεων για την πώληση του ακινήτου, ώστε να βρεθεί ο κατάλληλος τρόπος για να εισπράξει το τίμημα ο πωλητής που δεν έχει λογαριασμό στην Ελλάδα, όταν ο αγοραστής σχεδιάζει να λάβει δάνειο από τράπεζα.

Selling your real estate property in Greece, while you live in another country, is not that difficult. At least, it is not much more difficult, than it is for a seller who lives in Greece. You certainly have the difficulty of finding the best buyer, at the price you wish to sell. You do have to sort out the problem of who is to show your property to prospective buyers, while you live abroad and who is to apply for and obtain the numerous certificates from various authorities the law requires the seller to have, in order to be allowed to sell. Also, you need to consider who will negotiate the terms of the sale, how you actually get your money and how this money is deposited to your bank account in Greece, or how it is wired to your bank account abroad.
When you live outside of Greece, having a bank account at a bank in Greece is significant and it could help you smooth out the process of receiving the proceeds of the sale. So, if you do have any bank account in Greece, even if you have not used it for ages, or if it does not have any balance, it may be wise to keep it and not to close it, because when you may want to sell or buy property in Greece, having that account will be very useful in future transactions.
When you sell your property in Greece, the buyer will pay you either with a certified bank check, or with a direct transfer to your Greek bank account. If the latter happens, you must have internet banking in order you or your lawyer who is signing the closing on your behalf, to be able to confirm and double check at the time of the closing in real time, at the notary’s office, that the funds have actually been deposited to your bank account by the buyer. If that is confirmed, your lawyer will sign the closing deed, the property will leave your ownership and become the ownership of the buyer and you will own the proceeds paid by the buyer to your bank. If the buyer pays with a bank check, the seller will hand over or underwrite the check and give it to your proxy, who will then deposit it to your bank account in Greece, using a power of attorney from you.
If you do not own a bank account in your name in Greece, the process of selling your property and receiving the funds becomes slightly more complicated. When the time comes to sign the closing deed, the buyer will have to wire the proceeds of the sale to your bank account abroad, at the country where you live. This cannot be done in seconds, like when the bank accounts of the buyer and of the seller are kept in the same country. In that case, the wire transfer from one country to the other can take a few days until the wire hits your account at the country where you live. The closing deed, however, cannot be signed before you receive the money, because in that case, you are not legally safe. On the other hand, the closing cannot be signed after you receive the money, either, because in that case, it is the buyer who is not legally safe. The usual legal formula to solve this problem is to sign the sale closing deed, while the seller has not yet received the money and to insert in the deed clauses and terms which essentially state that the deed will be quashed and cancelled, should the seller does not receive his/her money within 8 – 10 days average. When the seller receives the wire abroad, the seller gives instructions to his lawyer in Greece to sign another deed, called the release deed.
When the buyer buys the property by getting a loan from a bank in Greece, the process requires essentially that the seller owns a bank account in Greece, in order the seller to be able to receive his/her money. This is because the bank which will lend the loan to the buyer, will issue a bank check only in the name of the seller, and not in the name of the buyer, which could be signed by the buyer and then given to the lawyer to be deposited to any bank account in Greece. If the buyer is buying with a loan, the bank’s check can only be deposited at the seller’s bank account in Greece, with a specific power of attorney by the seller to the lawyer in Greece, to have power to deposit the loan check to the seller’s bank account in Greece.
The conclusion is that if the seller does not have a bank account in Greece, the seller will have to essentially turn down all the offers from buyers who intend to finance their purchase with a bank loan. This means that the seller’s chances to sell the property are somehow reduced, because many buyers are buying using a bank loan in the type of a mortgage or similar financial schemes. In order to increase the chances to sell the property even to borrowers, the seller can open now a bank account in Greece. This requires the seller to send to the bank in Greece copies of his tax returns in the country of his residence, his telephone and electricity bills and a document proving his occupation or job in the country of his residence or that he is retired, plus a letter and proof from his bank abroad proving that he has a relation with a bank abroad. The Greek bank may also require physical presence in Greece of the seller, in order to give a signature specimen.
The sale transaction in Greece will be negotiated, prepared and signed with a power of attorney (POA), which the seller signs to a trusted person in Greece. That person (the proxy) will receive the deposit by the buyer, will identify, apply for and obtain the several documents required by law in order to sell and will eventually sign the closing deed, ensuring at the same time that the seller receives his/her money in a legally safe and timely manner.

Very often, when the owners of Greek real estate (immovable) property wish to sell or transfer it, they realize that the registration data of their property is incompatible or not harmonized at different state registries. When this happens, the owner must work with an attorney and with a civil engineer, in order to have his/her property re-measured and checked according to modern technical criteria. The civil engineer must inspect and examine the property, whether it is a flat or a house (even when it is a plot or land), and compare its present measurements and other technical descriptions with the description existing at the old land registry, at the modern land registry (Ktimatologio), the E9 list of properties filed with the tax office, the Municipality registry and possibly with other databases.
In addition, the property to be sold or transferred (gifted to children, donated etc.), is described in various forms and formats, either briefly or in more detail, in previous deeds and survey maps. Thus, the description of the same property may vary, sometimes significantly, and the discrepancies must be dealt with, in order the data of the property to be harmonized.
The sale or transfer of a property starts with a lawyer reviewing the deeds and possibly survey maps and with a title search at the local land registry or at the modern Ktimatologio. Subsequently, a civil engineer must check the technical characteristics of the property in question. The engineer will produce modern, up-to-date measurements and other descriptions of the property. Then, the engineer, the attorney and the notary will compare the present – day measurements with what the older deeds and survey maps state. A deed of twenty, thirty or more years ago may describe the flat as being 95 square meters, while today the c. engineer may measure it as being 98 s.m. In that case, we try to see whether the additional square meters have been “taken” from an adjacent condominium of the same building, or if they are part of the common spaces of the building. Depending on some details, we may first have to modify the charter (main deed) of the building and then sign the sale or transfer of our apartment.
In other cases, the civil engineer compares the present – day measurements of the flat or house with its building permit file and very often discrepancies are unearthed. In such cases, we first need to legalize these discrepancies or outright irregularities in the building, pay some small or not so heavy fines to the state and then be allowed by law to sell the flat or house. This stems from older practices of decades ago, when buildings were in reality being constructed not exactly as their permit blueprints showed. Until 2011 such “differences” were usually accommodated and the sales could go through. After 2011, the present and old deeds and survey maps and blueprints are meticulously examined and even minor technical discrepancies (the balcony or the window is 15 centimeters longer or wider), must be declared and settled before we are allowed to sign the closing sale deed at the notary.
Even when the property to be sold is a plot or land, we still need the technical identity document of the civil engineer, which will state its exact form, size and surface and will also certify that the plot is bare, meaning that there is no building or house on it.
The process of first discovering and then harmonizing the discrepancies is not easy and the lawyer who is usually in charge of the sale from the seller’s side must coordinate with several authorities, like the tax office, the municipality, the building authority and others, as well as with other professionals, including the civil engineer, the notary and the accountant, in order to obtain modern certificates, which will all state the same measurements and the same description of the property, before we reach the office of the notary, to sign the sale or transfer of the property. And even then, more hurdles may have to be overcome, including the registration of the deed of sale / transfer at the local land registry, provided its director does not promote a different interpretation of the law from that of the notary and the lawyers!

Many foreign nationals wish to stay for a prolonged period of time in Greece for various reasons. The nationals of European Union (EU) member states have the right to reside in Greece indefinitely with no or minimal bureaucratic requirements. Nationals of non – EU countries are basically divided in two categories. Those of non – EU countries who have the automatic right to reside in Greece for a period of maximum 90 days within a period of six months of their arrival in Greece, either continuously or in intervals. And the nationals of those non – EU countries who cannot come to Greece, unless they have first been issued a specific visa from the Consulate of Greece in the country of their residence.
Those non – EU nationals who wish to stay longer than 90 days in Greece, and those who have arrived in Greece with a visa type D, have the option to apply for and get a residence permit in Greece as financially independent persons, provided they satisfy the legal conditions. To be able to file such an application in Greece, you need first to apply at the Consulate of Greece in your country for a specific visa (usually type D). You will be interviewed by the Consulate personnel and will be asked to provide written proof that you have a stable monthly income of at least 2,000 Euros (in the equivalent currency) or savings in your bank account of at least 24,000 Euros, amounts which represent a stable yearly income necessary to support personal and family expenditure per year, without having to work in Greece. Such written proof of monthly income or possession of sufficient financial means, could be pension schemes in your country or bank statements, which prove your bank balance or both and in some cases, also other legal documents showing property ownership or business activity, which provides the minimum required financial means to be allowed to stay in Greece without working in the country. You will also have to obtain medical insurance for your stay in Greece with minimum requirements.
Once you obtain your specific visa from the Consulate of Greece, which will have a maximum duration of one year, you can come to Greece and apply for your residence permit as a financially independent person (FIP). You do not have to buy property in Greece worth a minimum of 250,000 Euros (and in some cases 500,000 Euros), as in the case of the so called “Golden Visa”. The government levy for filing your application is 1,016 Euros and another 150 Euros for the applicant’s spouse. You must have your valid passport with the visa stamp for stay in Greece and passport type photographs. Plus, you must either own or lease property in Greece and to prove it you must have copies of the deeds of ownership or the rental agreement filed with the Greek tax authority. Which means that you must also have or obtain a Greek tax number. This will not make you have to file income taxes in Greece, if you do not earn income in Greece.
The applicant must be able to provide evidence of the stable monthly income of minimum 2,000 Euros or bank balance of minimum 24,000 Euros. If the applicant is accompanied by members of his/her family, the above requirements are increased by 20% for the spouse and by 15% for each dependent child. Once the application is filed on line, the system issues a written proof of filing, which serves essentially as a temporary residence permit, allowing the applicant (and its family, if applicable) to stay in Greece more than 90 days and essentially until the time the basic residence permit is issued in several months’ time. During the temporary residence permit period, the applicant can stay in Greece and travel back and forth only to his/her country of nationality.

Όταν κάποιος κάτοικος εξωτερικού, είτε Έλληνας είτε αλλοδαπός, πουλάει ένα ακίνητό του στην Ελλάδα, πολλά είναι τα ζητήματα που πρέπει να σκεφθεί και να ρυθμίσει. Μερικά από αυτά είναι το πώς θα πληροφορηθεί την αγοραία αξία του ακινήτου του, καθώς δεν ζει στην Ελλάδα, πώς θα βρει αγοραστή σε μία τιμή κοντά στην αγοραία, πώς θα συγκεντρώσει τον μεγάλο αριθμό εγγράφων, συμβολαίων, πιστοποιητικών, τοπογραφικών κλπ., που ο νόμος προβλέπει ότι πρέπει να έχει συλλέξει ο πωλητής και πώς θα υπογραφεί το συμβόλαιο πωλήσεως από τον ίδιο (δηλαδή τον πωλητή), αν δεν ταξειδεύσει αυτοπροσώπως στην Πατρίδα.
Τα περισσότερα ζητήματα λύνονται συνήθως με ένα πληρεξούσιο που συντάσσει ο δικηγόρος του πωλητή στην Ελλάδα, το στέλνει στον πωλητή στο εξωτερικό και ο πωλητής το υπογράφει στο Προξενείο της Ελλάδος ή σε τοπικό συμβολαιογράφο, με ανάλογες επικυρώσεις. Το πιο βασικό ίσως ζήτημα που απασχολεί τον πωλητή, που διαμένει εκτός Ελλάδος, είναι πώς θα εισπράξει το τίμημα από την πώληση του ακινήτου του.
Το ζήτημα αυτό επιδέχεται διαφόρων λύσεων. Κατ’ αρχάς, δυνάμει του πληρεξουσίου που θα υπογράψει ο πωλητής στο εξωτερικό, θα δίνει πληρεξουσιότητα στον δικηγόρο του ή σε άλλο έμπιστο πρόσωπο στην Ελλάδα, μεταξύ πολλών άλλων εντολών και για την είσπραξη του τιμήματος από την πώληση. Το τίμημα, βεβαίως, αυτό ο πληρεξούσιος μόλις το εισπράξει στην Ελλάδα, πρέπει το συντομώτερο δυνατόν να το στείλει στο εξωτερικό ή να το αποδώσει με κάποιον άλλον τρόπο στον πωλητή, σύμφωνα με τις οδηγίες του. Εάν ο πωλητής που διαμένει στο εξωτερικό, διατηρεί τραπεζικό λογαριασμό στην Ελλάδα, το τίμημα από την πώληση του ακινήτου μπορεί να κατατεθεί στον λογαριασμό αυτόν, εφόσον επί παραδείγματι ο αγοραστής του ακινήτου εκδώσει τραπεζική επιταγή, την οποία θα παραδώσει στον δικηγόρο του πωλητή, ο οποίος εν συνεχεία μπορεί να την καταθέσει στον τραπεζικό λογαριασμό του πωλητή που διατηρεί στην Ελλάδα. Για να γίνει αυτό, πρέπει να υπάρχει ρητή και συγκεκριμένη πρόβλεψη στο πληρεξούσιο.
Μία άλλη επιλογή για το τίμημα, εφόσον ο πωλητής δεν διατηρεί τραπεζικό λογαριασμό στην Ελλάδα, είναι να παρέχει πληρεξουσιότητα στον δικηγόρο του να ανοίξει τώρα έναν τραπεζικό λογαριασμό στην Ελλάδα. Αυτό συνήθως απαιτεί αρκετές εβδομάδες, μερικά έγγραφα που πρέπει να αποστείλει ο πωλητής από το εξωτερικό και την τελική γνωμοδότηση από τη νομική υπηρεσία της τράπεζας. Συχνά, όμως, απαιτείται για το άνοιγμα του τραπεζικού λογαριασμού και η αυτοπρόσωπη παρουσία του δικαιούχου, δηλ. του πωλητή που μένει στο εξωτερικό, πράγμα που συχνά καθιστά την λύση του γρήγορου ανοίγματος του λογαριασμού δύσκολη.
Άλλη επιλογή είναι το τίμημα της πώλησης του ακινήτου να εισπραχθεί από τον πληρεξούσιο δικηγόρο ή συγγενή του ομογενούς, να κατατεθεί σε τραπεζικό λογαριασμό του πληρεξουσίου στην Ελλάδα και μετά ο πληρεξούσιος να το στείλει με έμβασμα στον τραπεζικό λογαριασμό του πωλητή στο εξωτερικό. Αυτή η λύση προϋποθέτει ο πωλητής να έχει μεγάλη εμπιστοσύνη στον πληρεξούσιό του στην Ελλάδα, πράγμα που θα συμβαίνει βεβαίως, αφού θα του έχει ήδη υπογράψει πληρεξούσιο για την πώληση του ακινήτου του.
Μία διαφορετική επιλογή είναι το τίμημα να πιστωθεί, δηλαδή το ακίνητο του ομογενούς να πωληθεί, αλλά τα χρήματα να μην καταβληθούν την ίδια στιγμή στον πωλητή. Με τις κατάλληλες νομικές δικλείδες ασφαλείας για τον πωλητή, συμφωνείται ότι ο αγοραστής εντός των επομένων πέντε ή δέκα ημερών από την υπογραφή του αγοραπωλητηρίου συμβολαίου, θα στείλει εκείνος με έμβασμα στο εξωτερικό το τίμημα σε λογαριασμό του πωλητή. Μόλις ο πωλητής επιβεβαιώσει ότι έλαβε στον τραπεζικό λογαριασμό του στο εξωτερικό τα χρήματα για την πώληση του ακινήτου του, ο πληρεξούσιός του στην Ελλάδα θα υπογράψει την λεγόμενη εξοφλητική συμβολαιογραφική πράξη και τότε μόνο ο αγοραστής θα είναι ελεύθερος να διαθέσει κατά βούλησιν και χωρίς περιορισμούς το ακίνητο που αγόρασε. Για να ακολουθηθεί αυτή η λύση θα πρέπει επίσης να προβλέπεται ρητώς στο πληρεξούσιο που θα έχει υπογράψει ο πωλητής, πράγμα που σημαίνει ότι για μία τέτοια πώληση ακινήτου, στην οποία ο πωλητής διαμένει εκτός Ελλάδος, το πληρεξούσιο που συντάσσεται στην αρχή της διαδικασίας θα πρέπει να έχει περιλάβει κάθε δυνατή εντολή προς τον πληρεξούσιο για την ομαλή ολοκλήρωση της πώλησης χωρίς ο πωλητής να έρθει και να παραμείνει στην Ελλάδα για πολλές εβδομάδες, όσες συνήθως απαιτούνται σήμερα για την πώληση ενός ακινήτου.

What can be legally considered a Will in Greece by jurists, notaries, the tax office and the administration is determined by Greek law. Legal documents which are considered a perfectly valid Will in other countries, is not always certain that they will be accepted as a Will in Greece. The three possible categories of a Will in Greece are the following:
1. A holographic or handwritten Will. This is a document written by the testator (the person who is making the Will), on any piece of paper, which however must be entirely handwritten. This document must be entirely written by the hand of the testator. It cannot have any printed or typed words or text. If the document contains printed parts, or parts which are handwritten by others than the testator, it is not a Will in Greece, even if it is signed by the testator, and even if the testator has written on it that he/she approves of the part of the text, which is written by someone else. The document must also contain the full name of the testator, the date the document is being drafted and the signature of the testator at the end of the text. Sometimes, if the date is missing, it can be replaced by other, indirect, entries in the Will and thus the document can be “saved” as a Will, even if it does not have a clear date.
The document does not necessarily have to contain the title “Will” or “Last Testament and Will” or something similar. As long as it satisfies the minimum requirements to be a Will, it can be considered as such. Thus, the piece of paper could be even a letter written by the person who died to someone else, where the writer of the document outlines his/her wishes with regards to his/her property and assets, after his/her passing. As long as it states the name of the person who wrote it and a date, and it is handwritten, it can be a Will. If a standard signature is missing, (because people do not usually sign a letter they send to someone else), the entry of the handwritten name of the writer at the end of the letter could be considered a signature.
It does not matter in what language the handwritten document is written. It could be Greek, or any other known language, as long as the text can be officially translated in Greek and presented to the Greek court for probation, so it can obtain legal validity as a Will.
2. A public Will is signed by the testator before a notary (who is a fully professional jurist in Greece), in a formal way, as an officially notarized act in the presence of three witnesses or one witness and a second notary. In this case, the testator provides the lawyer or the notary with his/her wishes and they come up with a first draft of the Will. Once the final draft is fully accepted by the testator, the printed document is signed by the testator and the notary, along with the witnesses and its hardcopy is registered and filed at the notary’s office. If the notary’s commission expires, by law there is always another notary who takes over the archive of the notary with all the officially recorded acts, including the public Will of the testator.
After the passing of the testator, the Will is filed at the court and it is eventually probated by it. The heirs or next of kin of the deceased must know the name of the notary where the testator had made his/her Will, in order to find the public Will and have it probated. If they know or suspect the deceased had made a public Will, but are not aware of the name of the notary, they can file a written request with the notaries’ association and a search is done with a notice sent to all notaries with the name of the deceased.
3. A document written and signed by the testator, or written by another person or typed, but signed by the testator, is enclosed in a file and is handed over to a notary. If the document is written by another person or if it is typed, it must have the signature of the testator on every page. The testator appears at the notary’s office, has his/her id confirmed, hands over the closed envelope and signs the related notarial act (secret Will). Three witnesses, or a second notary and one witness are by law required to be present. The notary keeps it as a recorded act and the envelope is opened by the court after the passing of the testator, when the court probates it as a Will.
If a person has assets in Greece (real estate, movables of value, single – name bank accounts) and wants to make a Will to distribute them, the best course of action is possibly to make a Will, which falls into one of the above three categories of Wills in Greek law. If this person has already signed a Will in another country, in most cases after his/her passing, the foreign Will once probated in that other country, can also be subsequently probated and become valid in Greece, too, so the heirs can use the foreign Will to inherit assets located in Greece. However, there are cases where the legal wording of the foreign Will is not easy to be legally implemented in Greece, the most usual example being the use of the notion of the “Trust” in the foreign Will. This sometimes causes difficulties, or more rarely deadlocks, with the foreign Will not being possible to be legally applied by lawyers, notaries, the tax office and other state authorities in Greece. To minimize this risk, one possible suggestion is the testator to make a separate section in his foreign Will, where he will state his wishes for property exclusively located in Greece, after he has consulted with a Greek lawyer. Another option is to make a separate, Greek Will in Greece, which deals exclusively or primarily with assets in Greece.

Στην σύγχρονη ζωή οι οικονομικές σχέσεις των ανθρώπων επεκτείνονται όλο και συχνότερα και σε χώρες εκτός αυτής στην οποία κατοικούν. Εμφανίζονται, συνεπώς, περισσότερες περιπτώσεις όπου φορολογικός κάτοικος Ελλάδος τυγχάνει να είναι συγκύριος κοινού τραπεζικού λογαριασμού σε τράπεζα του εξωτερικού. Σε περίπτωση που αποβιώσει ο έτερος συγκύριος του κοινού τραπεζικού λογαριασμού της αλλοδαπής, γεννάται το ερώτημα εάν ο κάτοικος Ελλάδος έχει υποχρέωση να καταβάλει φόρο κληρονομίας ή άλλον φόρο στην Ελλάδα για το χρηματικό ποσό που μένει στον λογαριασμό εξωτερικού.
Κατ’ αρχάς στην Ελλάδα ισχύει από το 1932 μέχρι και σήμερα νόμος που ορίζει ότι σε κοινό λογαριασμό μπορεί να έχει τεθεί όρος ότι σε περίπτωση θανάτου ενός εκ των συνδικαιούχων, το ποσό της κατάθεσης περιέρχεται αυτοδικαίως στον επιζώντα δικαιούχο του λογαριασμού, ο οποίος δεν θεωρείται ότι κληρονομεί το ποσό αυτό και έτσι δεν υποχρεούται να πληρώσει φόρο κληρονομίας. Ζήτημα ανέκυπτε με την διαφοροποίηση που γινόταν μεταξύ τραπεζικών λογαριασμών που τηρούνται σε τράπεζα στην Ελλάδα και λογαριασμών που τηρούνται σε τράπεζα του εξωτερικού. Συγκεκριμένα, η ελληνική φορολογική διοίκηση δεχόταν ότι ο εναπομένων συνδικαιούχος τραπεζικού λογαριασμού δεν καταβάλλει φόρο σε περίπτωση θανάτου του έτερου συνδικαιούχου, μόνον εφόσον ο κοινός τραπεζικός λογαριασμός τηρείται στην Ελλάδα. Αν ο λογαριασμός τηρείται στο εξωτερικό, τότε η απαλλαγή δεν ίσχυε, κατά την ελληνική εφορία και ο επιζών συνδικαιούχος κοινού τραπεζικού λογαριασμού εξωτερικού έπρεπε να πληρώσει φόρο κληρονομίας.
Επειδή το καθεστώς αυτό θεωρήθηκε ότι παραβιάζει το δίκαιο της Ευρωπαϊκής Ένωσης αναφορικώς με τον θεμελιώδη κανόνα της ελευθερίας κινήσεως, μεταξύ άλλων και κεφαλαίων εντός Ε.Ε., εισήχθη νομοθεσία στην Ελλάδα με ισχύ από 28 Μαρτίου 2022, σύμφωνα με την οποία δεν γίνεται πλέον διάκριση μεταξύ λογαριασμών που τηρούνται στην Ελλάδα και λογαριασμών του εξωτερικού και συνεπώς παρέχεται η απαλλαγή και στον επιζώντα συνδικαιούχο λογαριασμού εξωτερικού, ο οποίος γίνεται δεκτό πλέον και από την ελληνική φορολογική αρχή ότι δεν υποχρεούται να πληρώσει φόρο κληρονομίας για το ποσό που βρίσκεται στον κοινό τραπεζικό λογαριασμό, ακόμα και αν ο λογαριασμός τηρείται σε τράπεζα του εξωτερικού.
Βασική, ωστόσο, προϋπόθεση για την μη καταβολή φόρου είναι ο θάνατος του συνδικαιούχου του κοινού τραπεζικού λογαριασμού εξωτερικού να έχει λάβει χώρα μετά την 28-3-2022, ημερομηνία κατά την οποία άρχισε να ισχύει ο νέος νόμος στην Ελλάδα.
Μία άλλη βασική προϋπόθεση είναι στα έγγραφα του ανοίγματος του κοινού τραπεζικού λογαριασμού να αναγράφεται ρητώς ο όρος ότι σε περίπτωση θανάτου ενός των συνδικαιούχων του λογαριασμού, το ποσό της κατάθεσης περιέρχεται αυτοδικαίως στον εναπομένοντα συγκύριο του λογαριασμού. Πρέπει δηλαδή να υφίσταται εγγράφως αυτός ο όρος στα έγγραφα που υπογράφονται κατά το άνοιγμα του κοινού τραπεζικού λογαριασμού του εξωτερικού και σε περίπτωση ελέγχου να μπορεί ο φορολογούμενος στην Ελλάδα να αποδείξει εγγράφως την ύπαρξη του συγκεκριμένου όρου στον κοινό τραπεζικό λογαριασμό εξωτερικού.
Τρίτη βασική προϋπόθεση είναι ο κοινός λογαριασμός να τηρείται σε χώρα που θεωρείται ότι είναι συνεργαζόμενη με την ελληνική φορολογική αρχή αναφορικώς με θέματα ανταλλαγής πληροφοριών για φορολογικές υποθέσεις. Για να εφαρμοσθεί δηλαδή από την ελληνική φορολογική αρχή η ευνοϊκή διάταξη της μη φορολόγησης του υπολοίπου κοινού τραπεζικού λογαριασμού εξωτερικού μετά τον θάνατο του συνδικαιούχου, πρέπει η χώρα που τηρείται ο λογαριασμός να μην ανήκει στον κατάλογο των κρατών που σύμφωνα με τις προδιαγραφές του ΟΟΣΑ, δεν συνεργάζονται με άλλα κράτη προκειμένου να παράσχουν πληροφορίες που βοηθούν στην καταπολέμηση της φοροαποφυγής και φοροδιαφυγής.
Ιδιαίτερη προσοχή πρέπει να καταβάλει ο φορολογούμενος Ελλάδος στην περίπτωση κατά την οποία επιθυμεί να χρησιμοποιήσει το υπόλοιπο του (πρώην κοινού) λογαριασμού εξωτερικού, που εισήγαγε στην Ελλάδα, για κάλυψη τεκμηρίων, του πόθεν έσχες ή για αγορά ακινήτου, διότι μπορεί να απαιτηθεί να έχει υποβάλει σχετική φορολογική δήλωση για το εν λόγω ποσό στην Ελλάδα, παρά το ότι δεν υποχρεούται να πληρώσει φόρο κληρονομίας ή εισοδήματος γι’ αυτό. Τέλος, εάν ο θανών συνδικαιούχος του κοινού λογαριασμού εξωτερικού ήταν φορολογούμενος Ελλάδος, η ελληνική φορολογική αρχή θα ζητήσει απόδειξη ότι δήλωνε τα ποσά του υπολοίπου του λογαριασμού ως εισόδημα στην Ελλάδα ή ότι τα ποσά αυτά καλύπτονται από άλλες αιτίες νόμιμης κτήσεως.

When an estate is settled in Greece, (which means that the assets of the estate or part of them, are located in Greece), important questions such as who is considered an heir, what is the share of each heir or beneficiary and several other questions about the inheritance case are determined primarily by the law of the citizenship, which the deceased had at the time of the passing. This is what Article 28 of the Civil Code of Greece states. If the deceased had more than one citizenship, among which the Greek one, it will be Greek inheritance law which will be applicable with regards to who becomes an heir and who gets what share. However, with regards to the process of the settlement of the estate and the inheritance taxes, if any, it is Greek law which is always applicable, with regards to the assets of the estate which are located in Greece (real estate, bank accounts, movables).
If the deceased was not Greek (did not have the Greek citizenship), we require the advice through a simple letter of a lawyer, notary or other jurist from the country of the deceased’s citizenship. If, for instance, the inherited person was Canadian and we are settling the estate in Greece, we will seek the written advice of a Canadian lawyer or notary, who practices inheritance law in Canada. The advice must state under Canadian law who inherits what share in the specific estate case, given the particular circumstances, whether the deceased left a will or not, and given the number of the next of kin and their relations.
The advice of the foreign jurist will have to take into consideration the facts and the circumstances of the specific inheritance case. It will be stated that the deceased died at the specific country in the specific time and that he/she left a spouse and how many children, or any other combination of relatives, including spouse, no children but siblings, or no spouse and no children, but only siblings or cousins or nieces and nephews etc. The written advice will go on stating under Canadian law who of the next of kin gets what percentage of the estate, if there is no will probated. If there is a will, there is a chance that the Greek authorities may not even require the written advice of the foreign jurist, since they will apply directly the stipulations of the will. However, this will also be determined by whether the deceased left a spouse and children or not. If the deceased left a will, where he/she directs that the estate or part of it goes to a non – related heir or to more distant relatives, we may have to obtain the written advice of the foreign lawyer anyway, in order to determine whether any rules of forced heirship or of a minimum forced inheritance share exist in the foreign law, which may give more or increased rights to the next of kin (spouse, children, parents, other).
Once we have secured the advice on who inherits what share according to the law of the country of the citizenship of the deceased, we then proceed to obtain (in Greece or abroad) two affidavits by two persons who knew the deceased and can state who are the closest relatives of the deceased (next of kin). Determining the next of kin of the deceased is a significant part of the settlement of the estate, especially in the absence of a will, in which case intestate law comes into play.
The estate with assets in Greece will then continue being settled according to the process directed by Greek laws, so that the real estate properties are transferred to the heirs’ ownership with deeds registered at a land registry in Greece and any balance of the single – name bank account of the deceased at any Greek bank is released to the heir(s).
It is noteworthy that under Greek law and practice, the heirs do not have to act in unanimity or together and at the same time, in order to claim their share on the estate with assets in Greece. It is true that the ideal is all the heirs to act at the same time and preferably to be represented by the same attorney (provided they do not have conflicting interests), because this will save time, effort and communication delays comparted to each heir acting on their own or at different times. It is, though, possible that each heir acts on his/her own and independently of the others in claiming their share, without having to necessarily involve the other heirs. This possibility offers a solution in cases where one or some of the heirs are willing to immediately settle the estate and get hold of their shares, while other heirs are not ready to proceed or they have not yet been found/located or have not made their mind up whether they will claim their share or not. All the heirs and beneficiaries, however, must keep in mind that they mainly have four to twelve months from the passing of the decadent or from the probation of the will, to renounce their share. If they do not renounce within this period of time, Greek law considers them as heirs, without the right to renounce anymore.

Greek law states that the heir of an estate (inheritance) has the option to renounce in writing his/her right to the estate, within a period of four months from the day the heir learned of his/her right on the estate, meaning from the time the heir learned that he/she is inheriting a share on the estate of the specific deceased. If the heir lives outside of Greece or the deceased died outside of Greece, the 4 – month deadline is extended to twelve months. Any heir who wants to renounce an estate can do it by signing a simple document at the Justice of the Peace court in Greece. This is usually done in person. However, it is possible to renounce via a proxy. In that case, the heir signs a power of attorney, often at the Consulate of Greece in another country, giving power to an attorney / proxy in Greece to sign the document on the heir’s behalf, without the heir travelling to Greece.
Practically, Greek jurists, the tax authority, notaries and the administration in the vast majority of cases consider the date of the passing of the deceased as the starting point of the 4 or 12 - month deadline. If there is a Will probated, the law states that the deadline starts not from the passing, but from the date of the probation of the Will at the court. If the heir does not renounce the estate within the deadline, it is considered by law that the heir has legally accepted the estate, irrespective of whether the heir has signed any document to accept and even if the heir never realized that he/she is inheriting.
In most cases, foreign residents who inherit an estate in Greece are not aware of the law, and they do not know that if they do not renounce in writing the estate within twelve months, it is considered that they have accepted it, even without having signed any document to this effect. Usually, this does not have significant consequences. The only legal result is that the sibling who may have wanted to renounce in favour of another sibling, having now missed the deadline to renounce, will inherit the share on the estate and then will transfer/gift it to the sibling or to any other person the heir wishes. This happens when the estate involves real estate / immovable property, where the heir first inherits the share and then with another notarial deed transfers it to the relative or whoever else the heir wants to give it.
There are, however, cases where the estate has debts and no assets, something which may bring unwanted legal consequences for the heir who neither knew about the estate, nor about it having debts. In those cases, where the deceased owed money to third parties (banks, the state, the tax office, private persons or companies etc.), the heir who has legally accepted the estate by merely letting the deadline to renounce pass, may face the obligation to pay the debt of the estate himself. This is not pleasant and can become a nightmare for the heir who may find that he/she owes money out of nowhere.
In exceptional cases, the heir who finds out that, after the deadline to renounce has ended, has unwillingly inherited an estate with debt, can go to court and prove that he did not know of the estate and of his inheritance share and that he did not know of the rule that after four or twelve months of the passing or of the probation of the Will, one is considered that he has accepted the estate. If he can prove to the court that he has filed the lawsuit action to cancel his acceptance of the estate within six months of his learning of his inheritance right, the court may quash the acceptance of inheritance and allow the heir to renounce the estate even after the deadline of the four or twelve months has passed.
This can happen in exceptional cases and one cannot rely on such an option. Under normal circumstances, anyone living outside of Greece who knows that he has close relatives in Greece, should keep an eye on events in Greece with regards to close family in order to be informed of the passing of relatives and possibly of the existence of an indebted estate, which everyone has started renouncing.

The Golden Visa programs in many countries are quite popular, since they allow non – citizens to obtain the much – wanted residence permit, if the applicant obtains property of a minimum value in one of these countries. It is eight years now that Greece has its own golden visa law, which requires the purchase of a property of minimum value of 250,000 Euros as its basic condition, in order the citizen of a third country (meaning non – European Union) to obtain residence permit in Greece for five years. The permit covers members of the family of the applicant, i.e. dependent children up to the age of 21 and parents of the property owner. Spouses can jointly buy the same property and both obtain the residence permit, which can be renewed after its expiration, provided the applicant retains the ownership of the property at the time of the renewal. The permit does not allow (initially) the applicant to work in Greece and the time spent in Greece by the owner of the permit does not lead to the acquisition of the Greek citizenship. There are conditions and requirements, depending on the facts of each case and the goals of each applicant.
The Greek government has recently confirmed that the September announcement by the Prime Minister now takes effect and the minimum value to apply for the golden visa of 250,000 Euros rises to 500,000 Euros, but only in specific areas of Greece. These areas are the center of Athens and its southern and northern suburbs, the center of Thessaloniki and the two islands, Mykonos and Santorini. In those areas the minimum value of assets to be obtained so the third country (Non – EU) applicant can obtain the five – year residence permit (without the right to work in Greece) goes to 500,000 Euros.
If however, the interested person has already located the property in Greece and has started the process of its acquisition, the new law will allow for a transitional period until the end of April 2023, within which the buyer must have paid the deposit to purchase the property and must have signed the pre-contract with the seller. The final closing of the purchase must take place by the end of 2023. So, even in the affected areas of Athens (center, southern and northern suburbs), Thessaloniki, Mykonos and Santorini, buyers can still find and buy properties of a minimum value of 250,000 Euros in order to obtain the golden visa, as long as they pay the deposit by end of April 2023 and they close the purchase until end of 2023. In all other parts of Greece the minimum amount of 250,000 Euros remains intact. The new law has not yet been in force and details on the implementation of the changes are to be specified in the next weeks.

The on line tax filing process, which has undergone a recent “lifting” by the Greek tax authority, is not only about the yearly tax returns, already a reality in Greece since at least 2010. Now, it is mainly about the inheritance or estate tax declaration, when the heirs declare to the tax office the assets which they inherit, and about the parental gift tax declaration, when the children receive real estate free gifts from their parents, in most cases without paying any transfer tax at all.
Up to now, these tax declarations had to be filed by physically visiting the tax office and filing a bunch of hardcopy documents. With the new system in place, the interested parties, meaning the heirs, or the persons who receive the parental gift or those who receive a donation of an immovable property will not have to visit the tax office, but they will be able to file the necessary declaration and supporting documents from the office of their notary public. The tax authority will be able to review the documents filed and within days the reply will appear at the computers of the transacting parties, who can read the written reply of the tax authority by accessing on line their digital tax file using their username and password. If the tax office has given the green light, the transactions (notarial deeds of acceptance of inheritance, parental gift or donation of property) will materialize and the relevant deeds will be signed and certified by the notary and the persons involved. Finally, these deeds must be registered with the local land registry where the immovable property is located, called Hypothykophylakeeo or Ktimatologio, so the deeds take full legal effect.
It is noted that the spouse and the children of the deceased can claim a tax free inherited share of at least 150,000 Euros per person and after the first 150,000 Euros tax free amount, the next 150,000 Euros incur an inheritance tax of only one per cent (1%). This means that for spouse and children, if each of them inherits a share worth up to 300,000 Euros, the inheritance tax will be only 1,500 Euros. The surviving spouse can claim a tax free inheritance share up to 400,000 Euros, provided the marriage had lasted at least five years until the death of the deceased.
For the parental gift, which usually is a gift of property from parent to child, (but it can be the other way around, with the child gifting property to the parent), the tax free amount is 800,000 Euros, which means that the vast majority of parental gifts (goniki parochi) in Greece are tax free.
For the process of the inheritance settlement it is advisable and for the parental gift and the donations of property it is mandatory that the real estate property be measured with a new survey map and other technical documents drafted by a civil engineer, to ensure that any apartment, building or structure legally transferred does not have any building violations. A number of certificates must be issued as supporting documents for the transactions, issued by the tax authority, the municipality, often the court, other public authorities and by a number of professionals. If the transacting parties (parents, children, heirs etc.) do not live in Greece, they can complete the entire process without having to physically come to the country, by signing specific powers of attorney at the Greek Consulate or at a notary public of their country. The text of such power of attorney must be drafted by a notary or an attorney in Greece.

Μία ακατανόητη πρόσφατη απόφαση του Αρείου Πάγου, δηλαδή του Ανωτάτου Δικαστηρίου στην Ελλάδα, μπορεί να αποτελέσει αιτία για να χάσουν δίκες στην Ελλάδα πολλοί ομογενείς. Η απόφαση του Αρείου Πάγου αφορά τον τρόπο με τον οποίο επιδίδεται η αγωγή στον εναγόμενο, δηλαδή πώς πληροφορείται επισήμως ένας ομογενής κάτοικος εξωτερικού ότι κάποιος στην Ελλάδα του έχει κάνει δικαστήριο, στο οποίο πρέπει να απαντήσει και να παρουσιάσει την δική του εκδοχή των πραγμάτων, διαφορετικά κινδυνεύει να χάσει δικαιώματα, χρήματα, περιουσίες, κληρονομιές, ακίνητα ή να υποστεί βλάβη γενικώς στα συμφέροντά του.
Στην Ελλάδα από το 2015 έχει αλλάξει ο νόμος αναφορικώς με τον τρόπο με τον οποίο δικάζονται πολλές υποθέσεις. Σκοπός της αλλαγής ήταν να μειωθούν οι καθυστερήσεις στην απονομή της δικαιοσύνης. Ο νέος τρόπος δίκης για πολλές υποθέσεις ορίστηκε να είναι η γνωστοποίηση της αγωγής στον εναγόμενο (σ’ αυτόν εναντίον του οποίου γίνεται το δικαστήριο) μέσα σε 30 ημέρες από τότε που ο ενάγων (αυτός που αρχίζει το δικαστήριο) καταθέσει την αγωγή στο ελληνικό δικαστήριο. Αν ο εναγόμενος διαμένει εκτός Ελλάδος, η αγωγή πρέπει να επιδοθεί σε 60 ημέρες, αντί για 30 που ισχύει για τον εναγόμενο κάτοικο Ελλάδος. Από την ημέρα επίδοσης της αγωγής στον εναγόμενο, οι δύο διάδικοι, δηλαδή τόσο ο ενάγων, όσο και ο εναγόμενος, έχουν προθεσμία 90 ημερών για να καταθέσουν στο δικαστήριο τις προτάσεις τους, που περιλαμβάνουν τα νομικά επιχειρήματά τους, τις ένορκες καταθέσεις των μαρτύρων τους και το σύνολο των εγγράφων και λοιπών αποδεικτικών στοιχείων, για να εκθέσουν την δική τους εκδοχή για το τι έχει συμβεί στην συγκεκριμένη υπόθεση.
Όταν ο εναγόμενος είναι κάτοικος Ελλάδος, η διαδικασία φαίνεται ότι δεν δημιουργεί ιδιαίτερα προβλήματα. Όταν όμως ο εναγόμενος είναι κάτοικος εξωτερικού, εάν παγιωθεί η νομική άποψη που υιοθετείται από την κατωτέρω απόφαση του Αρείου Πάγου, ανακύπτει ένας πολύ μεγάλος κίνδυνος για τα δικαιώματά του και για την διασφάλιση της δίκαιης δίκης και της ισότητας των όπλων μεταξύ των διαδίκων. Ειδικώς, όταν ο εναγόμενος μένει στο εξωτερικό, ελλοχεύει ο κίνδυνος να μην πληροφορηθεί ποτέ ότι γίνεται δικαστήριο εναντίον του στην Ελλάδα και μπορεί να δικασθεί μία υπόθεση που τον αφορά άμεσα, χωρίς ο ίδιος να το πάρει καν είδηση! Μπορεί εν συνεχεία, να εκδοθεί δικαστική απόφαση που να τον υποχρεώνει να καταβάλει χρήματα στον ενάγοντα, ή να κρίνει ότι ο εναγόμενος (που ζει στο εξωτερικό) έχασε το σπίτι του ή ότι δεν δικαιούται να πάρει μερίδιο σε μία κληρονομιά, ή γενικώς ότι δεν έχει κάποιο δικαίωμα. Το αποτέλεσμα μπορεί να είναι ο κάτοικος εξωτερικού να υποστεί ζημία, εξ αιτίας μίας δικαστικής απόφασης που εκδόθηκε στην Ελλάδα, μετά από μία δίκη που ποτέ δεν έμαθε ότι είχε γίνει, ή που έμαθε την ύπαρξή της στην Ελλάδα με πολλούς μήνες καθυστέρησης, σε χρόνο που είτε είναι πολύ αργά για να κάνει κάτι για να υπερασπισθεί τα δικαιώματά του, είτε χρειάζεται πολύς κόπος, χρήμα και μεγάλη αβεβαιότητα για να προσπαθήσει τώρα να διορθώσει τα πράγματα, έχοντας μάλιστα χάσει και τον πρώτο βαθμό δικαιοδοσίας, δηλαδή έχοντας στερηθεί βασικών νομικών δικαιωμάτων του.
Το όλο ζήτημα αφορά το αν η επίδοση της αγωγής στον κάτοικο εξωτερικού, η γνωστοποίηση δηλαδή της δίκης και της ανάγκης ο κάτοικος εξωτερικού να αμυνθεί, ολοκληρώνεται με μία τυπική επίδοση της αγωγής στον Εισαγγελέα στην Ελλάδα, ή εάν η δίκη πρέπει να γνωστοποιηθεί με πραγματική επίδοση της αγωγής στην κατοικία του ομογενούς που ζει στο εξωτερικό, ώστε ο κάτοικος εξωτερικού να πάρει στα χέρια του το δικόγραφο και αμέσως να επικοινωνήσει με δικηγόρο στην Ελλάδα για να μάθει τι πρέπει και τι μπορεί να κάνει.
Στην πρώτη περίπτωση, με την απλή, τυπική επίδοση της αγωγής στον Εισαγγελέα στην Ελλάδα, την οποία υιοθετεί η συγκεκριμένη απόφαση του Αρείου Πάγου υπ’ αριθ. 1181/2022, ολοκληρώνεται πλασματικώς η άσκηση της αγωγής εντός 60 ημερών από την κατάθεσή της στο ελληνικό δικαστήριο, δηλαδή τυπικά μόνο τηρείται ο νόμος, αλλά στην πραγματικότητα, ο κάτοικος εξωτερικού θα μάθει για πρώτη φορά για την ύπαρξη της δίκης συνήθως πολλούς μήνες μετά, όταν οι προθεσμίες των 90 και 15 ημερών για να καταθέσει τις προτάσεις και τα αποδεικτικά του μέσα, θα έχουν περάσει προ πολλού! Ο εναγόμενος, συνεπώς, κάτοικος εξωτερικού, θα έχει δικαστεί ερήμην (in absentia) και θα έχει πιθανώς χάσει το δικαίωμα να προβάλει τους ισχυρισμούς του (audi alteram partem), έχοντας στερηθεί της προθεσμίας για να προετοιμασθεί με δικηγόρο.
Ο Άρειος Πάγος με την πρόσφατη απόφασή του υπ’ αριθ. 1181/2022, άλλαξε τη νομολογία που επί πολλά χρόνια ορθώς ίσχυε στην Ελλάδα, ότι η επίδοση της αγωγής στο εξωτερικό πρέπει να είναι πραγματική, δηλαδή ο κάτοικος εξωτερικού πρέπει να παίρνει στα χέρια του τα έγγραφα της δίκης και τότε μόνο να θεωρείται ότι έλαβε γνώση της αγωγής. Τώρα το ανώτατο δικαστήριο στην Ελλάδα, έκρινε ότι αρκεί η τυπική, πλασματική επίδοση στον Εισαγγελέα στην Ελλάδα, για να έχει ασκηθεί μία αγωγή και ότι ο εναγόμενος που μπορεί να διαμένει στην Αυστραλία, στις ΗΠΑ, στον Καναδά, στην Ιαπωνία ή στην Νότιο Αμερική, έχει (θεωρητικά, όχι όμως στην πραγματικότητα) πληροφορηθεί ότι μέσα σε 90 ημέρες πρέπει να καταθέσει έναν τέλειο νομικό φάκελο στο ελληνικό δικαστήριο, για να υποστηρίξει τα δικαιώματά του.
Ο κάτοικος εξωτερικού είναι πιθανό να μάθει για την δίκη αυτή πολλούς μήνες μετά και να μην έχει τον χρόνο ούτε με δικηγόρο στην Ελλάδα να επικοινωνήσει, ούτε τα έγγραφα που χρειάζεται για αποδείξεις να συγκεντρώσει, ούτε πληρεξούσιο ή εξουσιοδότηση να στείλει στον δικηγόρο του στην Ελλάδα, ούτε τους μάρτυρές του να βρει για να καταθέσουν. Σε αντίθεση με τον ενάγοντα, που είχε μήνες πριν την άσκηση της αγωγής την δυνατότητα να την σκεφτεί, να την προετοιμάσει με δικηγόρο, να έχει από πριν συγκεντρώσει τις αποδείξεις και τους μάρτυρές του και ουσιαστικά να έχει μία μεγάλη χρονική ευχέρεια και ένα μεγάλο πλεονέκτημα, έναντι του εναγομένου, που θα μάθει για το δικαστήριο όταν θα είναι πλέον πολύ αργά.
Αν επικρατήσει αυτή η ερμηνεία του νόμου, ότι αρκεί να γνωστοποιούμε πλασματικά (δηλαδή, τυπικά και όχι αληθινά, όχι πραγματικά) την αγωγή στον εναγόμενο μόνο με την τυπική επίδοση στον Εισαγγελέα στην Ελλάδα και όχι με το να φτάσουν τα χαρτιά τις δίκης πραγματικά στα χέρια του εναγομένου που κατοικεί στο εξωτερικό, όπως ήταν μέχρι σήμερα η νομολογία των δικαστηρίων, θα στερούνται οι εναγόμενοι που μένουν στο εξωτερικό της δίκαιης δίκης στην Ελλάδα, του φυσικού τους δικαστή, του δικαιώματος στην πρόσβαση στην δικαιοσύνη και θα παραβιάζονται διεθνείς συνθήκες προστασίας των δικαιωμάτων του ανθρώπου, αλλά και η κοινή λογική. Ποιος ξένος θα έρθει τότε να επενδύσει στην Ελλάδα, αν γνωρίζει ότι μπορεί μία μέρα να αρχίσει μία δίκη εναντίον του, για την οποία δεν θα μάθει ποτέ, παρά μόνο όταν θα είναι πλέον αργά για να αμυνθεί και να προβάλει την δική του εκδοχή των γεγονότων; Ποιος ομογενής θα θελήσει να αγοράσει ακίνητο στην Ελλάδα, αν είναι πιθανό μία ωραία πρωία ο γείτονας, ο συγγενής ή ο συνεργάτης του στην Ελλάδα να του ασκήσουν μία αγωγή και να γίνει ένα δικαστήριο, για το οποίο θα μάθει καθυστερημένα, χωρίς να έχει χρόνο να προετοιμάσει την άμυνά του και τέλος πάντων να αντιμετωπισθεί από την ελληνική δικαιοσύνη με τον ίδιο τρόπο με τον οποίο αντιμετωπίζεται ο κάτοικος Ελλάδος; Είναι δυνατόν να καθιερωθεί ότι η αγωγή αρκεί να επιδίδεται στην Εισαγγελέα στην Ελλάδα και ότι μ’ αυτόν τον τρόπο έχει ικανοποιηθεί η ανάγκη προστασίας των δικαιωμάτων ενός εναγομένου μονίμου κατοίκου εξωτερικού, που θα μάθει για την δίκη λίγο πριν εκπνεύσουν οι προθεσμίες για κατάθεση προτάσεων, ή ακόμα και πολύ μετά από την εκπνοή αυτών; Θα αναμένουμε περαιτέρω σχολιασμό της συγκεκριμένης αποφάσεως του Αρείου Πάγου από τη νομική κοινότητα και θα επανέλθουμε προς ενημέρωση των ομογενών κατοίκων εξωτερικού, που έχουν περιουσία και δικαιώματα στην Πατρίδα.

Parents can gift to their children immovable property located in Greece or cash, taking advantage of the zero transfer tax system. Each parent can transfer to each child property (real estate or cash) worth up to 800,000 euros without paying any transfer tax to the state. If the parent gifts cash, the transaction must be completed through the banking system and the parent must be able to justify tax wise the source of the funds.
The deed of the parental gift of immovable property is drafted and executed at a notary’s office in Greece and requires a number of supporting documents, without which the deed cannot be signed, nor registered with the land registry. The parent and the child must sign in person a number of documents at public authorities in the course of weeks prior to the final transfer, as well as the deed of transfer itself at the notary’s office. If parent and child can’t be present in Greece to prepare and finalize the execution of the transfer, the entire procedure can be completed on their behalf by a proxy, usually an attorney, who will act in their name with a power of attorney (POA). Each principal (parent and child) sign a separate POA in the country of their residence. The POA is drafted by the lawyer and e-mailed to them with instructions on how they will sign it at a notary public or at the Greek Consulate.
Parent and child must send photocopy of id card or passport to their attorney in Greece, and info on their full address, occupation and Greek tax number. If they do not have a Greek tax number, their proxy will file documents to issue one now for each party. The parental gift deed can be executed even if neither of the parties (parent and child) is a Greek citizen. Copies of the deeds of ownership of the parent must be provided. If they are not available, the lawyer can obtain them from the land registry or from the notary who drafted them. The parent must obtain a tax certificate that he/she does not owe taxes in Greece. A certificate that the parent does not owe social security contributions in Greece is also required in some cases and usually foreign residents do not have to provide this.
If the property which is gifted is a plot, piece of land or house, a recently prepared survey map is required. In addition, a certificate by the local municipality must be issued, stating that the parent does not owe municipal taxes. The parent must provide the latest electricity bill, which must have been paid, or information on when the electricity was disconnected. Moreover, a civil engineer must inspect the apartment or the house, verify its technical condition, compare it with its actual situation and the building permit and issue the electronic identity of the structure. If the building has structural irregularities, they must first be legalized, before the parental gift deed can go through.
Another requirement is the certified copy of the land registry record of the property to be gifted. A significant document is also the certificate by the tax office that the yearly property tax for the property to be gifted has been paid for the last five years. If the parent has obtained the ownership of the property to be gifted to the child from a donation or inheritance (estate) after 1-1-2004, a certificate from the tax authority is also required, stating that the donation or estate tax has been paid. The deed of parental gift is finalized by the notary and it is filed with the local tax authority. Once the deed is approved, the transaction can take place and then the notarial deed is registered with the local land registry.
The parent and child must cooperate closely with their lawyer and notary in Greece, in order to provide documents and information, which will help issuing the above documents. Additional procedures and documentation may be required, depending on the particularities of the immovable property or on the specific facts of the case.

Για την ολοκλήρωση μεταβιβάσεως ακινήτων, όπως πώληση, αγορά, γονική παροχή, δωρεά και κληρονομιά, απαιτούνται σειρά ενεργειών σε συμβολαιογράφο, δημόσιες υπηρεσίες, γραμματείες δικαστηρίων, εφορία, δήμο, κτηματολόγιο κ.α.. Χρειάζεται επίσης συχνά η συνδρομή μηχανικού και λογιστή. Εάν οι ενδιαφερόμενοι δεν κατοικούν στην Ελλάδα ή εάν δεν έχουν γνώση και χρόνο για την διεκπεραίωση των πολλών διαδικασιών, ειδικώς όταν προκύπτουν νομικές περιπλοκές, ο συντονισμός όλων των ενεργειών, αλλά και των εμπλεκομένων υπηρεσιών και ιδιωτών μπορεί να γίνει από δικηγόρο.
Τα τελευταία χρόνια το κράτος στην Ελλάδα έχει δημιουργήσει σοβαρή υποδομή στις ηλεκτρονικές δηλώσεις και γενικώς στον τομέα της υποβολής εγγράφων και αιτήσεων διαδικτυακά, ώστε οι πολίτες να εξοικονομούν χρόνο και να αποφεύγουν την ταλαιπωρία της μετάβασης και της αναμονής σε δημόσιες υπηρεσίες. Πολλές από τις αιτήσεις και δηλώσεις υποβάλλονται ηλεκτρονικά μέσω λογιστή, άλλες μέσω συμβολαιογράφου, αλλά και αρκετά συχνά από τον υπολογιστή του ενδιαφερομένου, εφόσον αυτός μπορεί να συντάξει το έγγραφο που θα υποβάλει στην δημόσια υπηρεσία.
Ένα πρόσφατο παράδειγμα της τάσης όλο και περισσότερα έγγραφα να υποβάλλονται στο δημόσιο ηλεκτρονικά από υπολογιστή, είναι η δήλωση φόρου κληρονομίας, η οποία υποβάλλεται στην εφορία στην οποία ανήκε ο θανών. Μέχρι σήμερα οι δηλώσεις αυτές υποβάλλονται με μετάβαση και φυσική παρουσία του κληρονόμου ή του πληρεξουσίου του στην αρμόδια ΔΟΥ. Από τον Οκτώβριο η κυβέρνηση σχεδιάζει να θέσει σε λειτουργία το διορθωμένο σύστημα της ηλεκτρονικής υποβολής της δήλωσης φόρου κληρονομίας από το γραφείο του συμβολαιογράφου, ο οποίος σε δεύτερο στάδιο θα συντάξει και την πράξη αποδοχής κληρονομίας, που είναι αναγκαία για την αποδοχή ακινήτων, ενώ υπάρχει και η εναλλακτική επιλογή του κληρονομητηρίου, που εκδίδεται με απόφαση δικαστηρίου.
Πρακτικά, η υποβολή της ηλεκτρονικής δήλωσης φόρου κληρονομίας γίνεται από τον συμβολαιογράφο στην θυρίδα του κληρονόμου ή των κληρονόμων στο Taxisnet. Προϋποτίθεται ότι κάθε κληρονόμος έχει αποκτήσει κωδικούς (username και password) για διαδικτυακή πρόσβαση στον φορολογικό του φάκελο, πράγμα που δεν είναι τόσο αυτονόητο για κληρονόμους που κατοικούν εκτός Ελλάδος, οι οποίοι κάποιες φορές δεν έχουν ούτε ΑΦΜ, πόσω μάλλον κωδικούς.
Εν συνεχεία, ο κληρονόμος αποδέχεται ηλεκτρονικά την δήλωση κληρονομίας που έχει υποβληθεί στο όνομά του από τον συμβολαιογράφο του. Ακολούθως εφοριακοί επεξεργάζονται την δήλωση και εντός ημερών βεβαιώνεται ο φόρος κληρονομίας, αν προκύπτει φόρος. Ο κληρονόμος πληρώνει τον φόρο και το αποδεικτικό καταβολής αναρτάται στην ηλεκτρονική σελίδα MyProperty για χρήση σε διάφορες συμβολαιογραφικές πράξεις, όμως μεταβιβάσεις ακινήτων. Για κάθε ακίνητο που ο κληρονόμος θέλει να πωλήσει, πρέπει να αποδεικνύει ότι έχει πληρώσει τον φόρο κληρονομίας. Πρέπει ωστόσο να σημειωθεί ότι η ανωτέρω ηλεκτρονική υποβολή της δήλωσης φόρου κληρονομίας είναι μέρος μόνο της συνολικής διαδικασίας που απαιτείται για την ολοκλήρωση της αποδοχής κληρονομίας.
Υπενθυμίζεται ότι για κληρονομιές που έχουν προκύψει πριν από το 2004, δηλαδή όταν ο κληρονομούμενος έχει αποβιώσει έως 31-12-2003, οι κληρονόμοι δεν πληρώνουν καθόλου φόρο κληρονομίας, όσο μεγάλη αξία και αν έχει η κληρονομία. Αν προκύψει φόρος, όταν δηλαδή ο θάνατος έχει συμβεί από το 2004 και μετά, εάν κληρονόμος είναι τέκνο ή εγγόνι του θανόντος, το αφορολόγητο όριο είναι 150.000 ευρώ για κάθε κληρονόμο, ενώ για τον σύζυγο μπορεί να φθάσει έως τις 400.000 ευρώ, εφόσον προκύπτει ότι ο γάμος με τον θανόντα είχε διαρκέσει τουλάχιστον πέντε χρόνια. Για τους συγγενείς των λοιπών βαθμών (αδέλφια, ανήψια κλπ), τα αφορολόγητα όρια είναι αρκετά χαμηλότερα, ωστόσο όλοι διευκολύνονται από το νέο σύστημα της ηλεκτρονικής υποβολής της δηλώσεως φόρου κληρονομίας που εισάγεται από τον Οκτώβριο.

Πολυάριθμές είναι οι ιστορίες μεταναστών που έφυγαν από την Ελλάδα για ΗΠΑ, Καναδά, Αυστραλία και άλλες χώρες και αργότερα ενεπλάκησαν σε δικαστήρια στην Ελλάδα για κληρονομιές ή άλλα ακίνητα που οι συγγενείς προσπάθησαν να διεκδικήσουν. Το μεγάλο ερώτημα που συνήθως χρειάζεται απάντηση σε τέτοιες δικαστικές υποθέσεις είναι ποιος ασκούσε νομή στα διεκδικούμενα ακίνητα για διάστημα άνω των είκοσι ετών χωρίς να έχει ο αντίδικος αντιδράσει με κάποιο νομικό τρόπο, δηλαδή συνήθως με αγωγή ή ασφαλιστικά μέτρα στα δικαστήρια ή έστω με εξώδικο.
Η δυνατότητα να αποδειχθεί η κατ’ ελάχιστον εικοσαετής άσκηση νομής είναι συχνά το κλειδί της νίκης σε παρόμοιες δικαστικές διαμάχες. Νομή, με απλά λόγια, είναι η χρήση ενός ακινήτου με την πεποίθηση από αυτόν που το χρησιμοποιεί ότι είναι δικό του. Νομή είναι να δηλώνεις το ακίνητο στο Ε9 της εφορίας, να πληρώνεις τα έξοδα του ακινήτου και να κρατάς αποδείξεις γι’ αυτό, να συντάσσεις τοπογραφικό με μηχανικό, να το δηλώνεις στο Κτηματολόγιο, να αποτρέπεις καταπατητές να το καταλάβουν, να χτίζεις σ’ αυτό, να φυτεύεις, να φτιάχνεις φράχτη, να κάνεις ανακαίνιση στο σπίτι ή στο διαμέρισμα, να το νοικιάζεις σε άλλους και να έχεις σχετικό μισθωτήριο έγγραφο, να πληρώνεις ΕΝΦΙΑ γι’ αυτό, να έχεις μάρτυρες που βλέπουν για χρόνια ότι κάνεις τα παραπάνω και ότι εσύ και κανένας άλλος δεν φροντίζει το εν λόγω ακίνητο. Νομή δεν ασκεί ο ενοικιαστής, διότι χρησιμοποιεί βεβαίως το ακίνητο, αλλά δεν έχει την πεποίθηση ότι είναι δικό του, διότι γνωρίζει ότι αυτό ανήκει στον ιδιοκτήτη, δηλαδή τον εκμισθωτή στην μίσθωση.
Ο ομογενής που κατοικεί μονίμως εκτός Ελλάδος, αλλά έχει κληρονομικά ή ιδιοκτησιακά δικαιώματα σε ακίνητα στην Πατρίδα, πρέπει να φροντίζει να ξεκαθαρίζει με τους συγγενείς, τους γείτονες ή άλλους που τα κατέχουν προσωρινώς ή για μεγαλύτερο χρονικό διάστημα, ότι τα ακίνητα στην Ελλάδα είναι δικά του και ότι ο βοσκός που βάζει τα πρόβατά του στα χωράφια, ή ο συγγενής που έχει τα κλειδιά του σπιτιού στο χωριό, ή ο φίλος που επισκέπτεται το σπίτι κατά διαστήματα, δεν ενεργούν ως ιδιοκτήτες, αλλά ως αντιπρόσωποι του ομογενούς, εκτελώντας τις οδηγίες του ομογενούς για τα ακίνητα στην Ελλάδα, για δικό του λογαριασμό. Ο ομογενής συνιστάται να υπογράφει έγγραφα με βεβαίωση γνησίου υπογραφής, με τους αντιπροσώπους του στην Ελλάδα, στα οποία να ξεκαθαρίζεται ότι ιδιοκτήτης, κύριος και νομέας του ακινήτου είναι ο ομογενής και ότι οι συγγενείς, οι φίλοι ή οι γνωστοί του στην Ελλάδα, που έχουν τα κλειδιά, που εισέρχονται στα ακίνητο, που το χρησιμοποιούν ενδεχομένως κατά διαστήματα, που το καθαρίζουν, το προστατεύουν από καταπατητές και το εποπτεύουν, δεν τον κάνουν για δικό τους λογαριασμό, αλλά ως αντιπρόσωποι και για λογαριασμό του ομογενούς, ο οποίος είναι και ο αδιαμφισβήτητος κύριος του ακινήτου.
Συχνά το ποιος είναι ο νομέας περιπλέκεται σε ένα θολό τοπίο οικογενειακών και φιλικών σχέσεων, στις οποίες δεν ξεκαθαρίζεται ποιος είναι ιδιοκτήτης, για λόγους αποφυγής εντάσεων λόγω συγγενείας ή μη διατάραξης των φιλικών σχέσεων, με την κάθε πλευρά να διαμορφώνει καταστάσεις σύμφωνα με τις οποίες πιστεύει ότι το ακίνητο είναι, ή γίνεται σιγά σιγά δικό της, με αποτέλεσμα μετά από αρκετά χρόνια να βγαίνουν στην επιφάνεια συγκρούσεις που «σιγόβραζαν» για δεκαετίες.
Αυτό συνέβη και στην υπόθεση η οποία αναφέρεται στην υπ’ αριθ. 416/2020 του Γ’ Πολιτικού τμήματος του Αρείου Πάγου. Μετανάστης από την Αρκαδία έφυγε το 1916 για τις ΗΠΑ, έκανε κάποια χρήματα και επέστρεψε το 1928 στο χωριό του στο Λεβίδι, για να χτίσει σπίτι σε οικόπεδο του πατέρα του. Ο πατέρας αναγνωρίζοντας ότι το παιδί του είχε βάλει τα χρήματα για να χτίσει το σπίτι, έδωσε διά λόγου το σπίτι με το οικόπεδο στον γιό του, ο οποίος το κατοίκησε μαζί με την οικογένειά του έως περίπου το 1937, οπότε και ξαναέφυγαν για τις ΗΠΑ. Από τότε στο σπίτι μείνανε οι γονείς του ομογενούς και άλλα μέλη της οικογένειάς του, έως το 1997, οπότε και ο ομογενής απεβίωσε στις ΗΠΑ. Ο γιός του ομογενούς, επίσης κάτοικος ΗΠΑ, διεκδίκησε το 2006 το σπίτι από κάποιους συγγενείς που το είχαν κατοικήσει κατά διαστήματα και το είχαν μάλιστα ανακατασκευάσει, χωρίς την άδειά του. Μετά από καταθέσεις συγγενών και άλλων μαρτύρων, αλλά και αφού τα δικαστήρια έλαβαν υπόψιν τους και έγγραφα, φωτογραφίες και άλλο αποδεικτικό υλικό, το πρωτόδικο δικαστήριο έκρινε υπέρ των συγγενών, όμως το Εφετείο και ο Άρειος Πάγος δικαίωσαν τον ομογενή, κρίνοντας ότι ο πατέρας του και στην συνέχεια ο ίδιος, είχαν αδιάκοπη νομή επί πολλές δεκαετίες, η οποία δεν είχε διακοπεί από έκτακτη χρησικτησία των λίγων συγγενών που το είχαν νεμηθεί από το 1990 έως το 2006 οπότε και ο γιός του ομογενούς είχε ασκήσει την αγωγή του στα δικαστήρια. Με την άσκηση της αγωγής το 2006 ο ομογενής διέκοψε τη νομή τους και τους εμπόδισε να ολοκληρώσουν δική τους εικοσαετία, καθώς από το 1990 έως το 2006 είχαν συμπληρώσει μόνο16 χρόνια νομής, που δεν ήταν αρκετά για την συμπλήρωση της εικοσαετούς έκτακτης χρησικτησίας.

Individuals who have already moved to another country for professional and/or personal reasons have significantly increased by number the last few years. The pandemic and the progress of technology have accelerated the trend of remote working, which in turn has created the reality for many thousands of people residing in one country for months or years, while working for an employer established in another. Very often, the person who has chosen to work remotely is residing at a country where he/she needs to obtain legal residence status. Many countries offer options to non – citizens, in order to lure them to come and reside in these countries, so the non - citizens can spend a large part of their income there, while still working for a company at another country.
One such program is the legal option, which Greece offers to those who are not Greek and not European Union (EU) citizens, to be able to legally reside in Greece, and to move freely around the EU, provided they purchase assets in Greece worth a minimum of 250,000 Euros. The type of asset, which the non – Greek and the non – EU citizen can buy, is usually real estate in Greece, meaning a house, an apartment, a plot on which the visa applicant will immediately build a house, or even a time sharing contract of a duration of ten years minimum. Its real value must be at least 250,000 Euros. The foreign individual who buys it, must be one person. As an exception, it can be two married persons who purchase the asset together, 50% each. Alternatively, a foreign individual can purchase an undivided share on a property in Greece, provided the share is worth a minimum of 250,000 Euros. The third – country citizen (non – Greek and non – EU), can also be the owner of more than one properties or shares on properties, all of which together must have a minimum worth of 250,000 Euros.
The foreign person who buys a company, which owns the real estate property in Greece (worth at least 250,000 Euros), must own the 100% shares of that company, in order to get the golden visa.
To lodge the golden visa application, the applicant must be legally residing in Greece, at the time of the filing. Once the application has been successfully lodged, the applicant receives a temporary residence permit document valid through the time that the decision on the application will be issued by the Greek state. This temporary residence permit allows free residence in Greece, as well as trips to the citizenship country of the applicant. The temporary residence permit does not allow free movement to other EU and Schengen countries. The golden visa residence permit is not a work permit in Greece.
For the application, a valid passport of the applicant is required, with the stamp of the customs of the entry of the applicant in Greece. If the applicant entered Greece through another EU country, the applicant may be asked to produce the transport ticket by which the applicant entered Greece. Four recent passport – type photos are also needed, and a government levy of 2,016 Euros must be paid.
The applicant must have medical insurance in Greece covering the time the applicant will reside in Greece, with a minimum duration of one year.
A basic document for the application is the purchase deed of the notary, by which the applicant obtained the ownership of the real estate property in Greece, with the full amount having been paid to the seller and not being credited to the buyer. The deed of purchase must be registered with the local land registry.
The visa can be extended to the spouse and the children of the applicant, as well as to his / her parents. The children must be under 21 years old. The members of the family submit an independent application, either simultaneously with the main applicant, or after the main application has been approved.
The golden visa duration, once approved, is five years. It can be renewed, provided the requirements continue to apply, meaning the applicant must still own the property worth of 250,000 Euros. It usually takes two to three months for the application to be approved and the residence permit to be issued. Each application requires independent preparation according to the characteristics of the specific case, and more documents may be required.

Οι ιδιοκτήτες ακινήτων στην Ελλάδα πρέπει να έχουν δηλώσει σωστά και με ακρίβεια όλα τα χαρακτηριστικά των ακινήτων τους σε διάφορες υπηρεσίες, όπως είναι η εφορία μέσω της δηλώσεως Ε9, το Εθνικό Κτηματολόγιο, αλλά και ο Δήμος στην περιοχή που βρίσκεται το ακίνητο. Πολύ συχνά για διάφορους λόγους, ο Δήμος δεν έχει καταχωρημένο το ακίνητο με τα σωστά τετραγωνικά της μονοκατοικίας ή του διαμερίσματος. Οι αιτίες είναι πολλές και συνδέονται συνήθως με πολεοδομικές παραβάσεις των ιδιοκτητών ακινήτων κατά την ανέγερσή τους ή κατά την ανακαίνιση και επέκτασή τους. Είναι προσφιλές χόμπι των Ελλήνων να προσπαθούν να χτίσουν περισσότερα τετραγωνικά μέτρα από εκείνα που επιτρέπει η άδεια οικοδομής που έχουν λάβει.
Ιδιαιτέρως κατά τις προηγούμενες δεκαετίες ο ιδιοκτήτης μίας οικοδομής αρκετά συχνά έχτιζε παραπάνω τετραγωνικά από το επιτρεπόμενο και ακολούθως γινόταν νομιμοποίηση με διάφορες μεθόδους και με διάφορους νόμους που κατά καιρούς έχουν ισχύσει και ισχύουν ακόμα στην Ελλάδα. Άλλες φορές λέγεται νομιμοποίηση ημιυπαιθρίων χώρων, όπου ένα μπαλκόνι ουσιαστικά κλείνεται και μετατρέπεται σε κανονικό δωμάτιο και άλλες φορές ονομάζεται τακτοποίηση ή νομιμοποίηση αυθαιρέτου ή αυθαιρεσιών. Άλλες πάλι φορές το λένε αλλαγή χρήσης, όπου το υπόγειο από βοηθητικός χώρος, αποθήκη ή λεβητοστάσιο μετατρέπεται σε κύριο χώρο κατοικίας.
Σε όλες αυτές τις περιπτώσεις και σε πολλές άλλες, το τελικό αποτέλεσμα είναι ότι η επιφάνεια της κατοικίας ή του διαμερίσματος έχει αυξηθεί στην πραγματικότητα και είναι μεγαλύτερη από εκείνη που αναγράφεται σε βασικά νομικά και πολεοδομικά έγγραφα, όπως είναι η σύσταση οριζοντίου ιδιοκτησίας ή η πολεοδομική άδεια οικοδομής. Η διαφορά μεταξύ νομικής και πολεοδομικής καταστάσεως στα χαρτιά και πραγματικότητας συνήθως δεν ενδιαφέρει κανέναν και ο ιδιοκτήτης απολαμβάνει την χρήση ενός μεγαλυτέρου σε τετραγωνικά ακινήτου από όσο γράφουν οι τίτλοι και η άδεια οικοδομής.
Η διαφορά στα τετραγωνικά, όμως, γίνεται αντιληπτή όταν έρθει η ώρα την μεταβίβασης του ακινήτου, είτε με πώληση, είτε με γονική παροχή ή δωρεά, είτε όταν ο ιδιοκτήτης αποβιώσει και οι κληρονόμοι του προβαίνουν στην διαδικασία της αποδοχής κληρονομίας. Τότε είναι υποχρεωτική λίγο πολύ η μέτρηση του ακινήτου με σύγχρονες μεθόδους από έναν πολιτικό μηχανικό, ο οποίος είναι υποχρεωμένος να καταγράψει την επιφάνεια του ακινήτου και τις βασικές διαστάσεις των μερών του (δωμάτια, εξώστες, στέγαστρα, πηγάδια, δεξαμενές, αποθήκες, μπάρμπεκιου κλπ). Εάν προκύπτουν διαφοροποιήσεις από την άδεια οικοδομής, ακόμα και αν ένα μπαλόνι είναι δέκα πόντους πλατύτερο από όσο γράφει η άδεια οικοδομής, ή αν τα τετραγωνικά κάποιου δωματίου ή άλλου χώρου είναι παραπάνω (ή και παρακάτω), η διαφορά πρέπει να δηλωθεί στις αρχές, να πληρωθούν κάποια σχετικά λογικά και όχι μεγάλα πρόστιμα και να μπορέσει μετά να γίνει η πώληση, η μεταβίβαση ή η κληρονομιά του ακινήτου. Ειδικά για την κληρονομιά, η δήλωση των αυξημένων τετραγωνικών δεν είναι τυπικά υποχρεωτική. Όμως αν οι διαφορές στα τετραγωνικά ή σε άλλες διαστάσεις του ακινήτου δεν εντοπισθούν κατά την αποδοχή κληρονομίας, τότε μία μελλοντική πώληση θα συναντήσει το πρόβλημα και μπορεί να απαιτηθεί τότε να γυρίσουν πίσω οι κληρονόμοι, να διορθώσουν την δήλωση φόρου κληρονομίας και την πράξη αποδοχής στον συμβολαιογράφο, να πληρώσουν αναδρομικούς φόρους και πρόστιμα και μετά να μπορέσουν να πουλήσουν ή να δώσουν σε παιδιά τα κληρονομιαία ακίνητα.
Τα περισσότερα τετραγωνικά ενός διαμερίσματος ή μίας κατοικίας πρέπει να δηλωθούν όχι μόνο στο Ε9 της εφορίας και να πληρωθεί ο ΕΝΦΙΑ που αντιστοιχεί στην διαφορά των τετραγωνικών κατά τα τελευταία πέντε χρόνια, αλλά και στο Κτηματολόγιο και στον Δήμο. Η δήλωση μάλιστα των παραπάνω τετραγωνικών στον Δήμο έπρεπε να έχει γίνει έως 30 Ιουνίου 2022 ώστε ο ιδιοκτήτης να γλυτώσει σημαντικά πρόστιμα. Δεν είναι γνωστό μέχρι σήμερα εάν θα δοθεί παράταση. Αυτό που πάντως πρέπει να κάνουν όλοι οι ιδιοκτήτες ακινήτων είναι να ελέγξουν εάν το ακίνητό τους έχει δηλωθεί με τα ίδια, ακριβή και πραγματικά στοιχεία σε όλες τις υπηρεσίες (Ε9, Κτηματολόγιο, Δήμος). Σ’ αυτήν την κατεύθυνση οδηγεί ούτως ή άλλως ο θεσμός της Ηλεκτρονικής Ταυτότητας Κτιρίου, την οποία κάθε ιδιοκτήτης ακινήτου πρέπει να δημιουργήσει με την βοήθεια πολιτικού μηχανικού.

Πολύ συχνά περισσότερα του ενός πρόσωπα βρίσκονται να έχουν συγκυριότητα σε ένα κοινό ακίνητο, συνήθως λόγω κληρονομίας. Οι συγκληρονόμοι έχουν κληρονομήσει ένα ή περισσότερα ακίνητα, αλλά κανένας από τους κληρονόμους δεν έχει αποκλειστική κυριότητα σε ένα συγκεκριμένο ακίνητο, το οποίο να είναι ολόκληρο δικό του. Η συγκυριότητα ενός ακινήτου από πολλούς συχνά συνεπάγεται προβλήματα, διαφωνίες ή καθυστερήσεις στην χρήση και εκμετάλλευσή του.
Γι’ αυτό πολλές φορές οι συγκύριοι προσπαθούν να συμφωνήσουν σε μία άτυπη, διά λόγου διανομή του ακινήτου, χωρίς επίσημα συμβόλαια. Η διανομή αυτή μπορεί να τηρηθεί από τους συγκυρίους για πολλά χρόνια. Αν η άτυπη, διά λόγου και χωρίς συμβολαιογραφική πράξη διανομή του ακινήτου συνεχισθεί και τηρηθεί για πάνω από είκοσι χρόνια από τότε που πρωτοσυμφωνήθηκε μεταξύ των συγκυρίων, πολλοί πιστεύουν ότι λόγω χρησικτησίας, δηλαδή χρήσης, κάρπωσης και εξουσίασης του ακινήτου για πάνω από είκοσι χρόνια χωρίς αμφισβήτηση από άλλους, έχει δημιουργηθεί κυριότητα στο τμήμα του ακινήτου που κάθε ένας εκ των συγκυρίων έχει καταλάβει για χρονικό διάστημα άνω των είκοσι ετών. Αυτό μπορεί πράγματι να ισχύσει σε κάποιες περιπτώσεις, όπως επί παραδείγματι επί κοινού οικοπέδου ή αγροτεμαχίου το οποίο έχει ατύπως διανεμηθεί σε π.χ. δύο άρτια και οικοδομήσιμα τμήματα. Δεν μπορεί όμως νομικά να ευσταθήσει όταν πρόκειται για απόπειρα δημιουργίας με χρησικτησία ανεξαρτήτων οριζοντίων ιδιοκτησιών (διαμερισμάτων ή “καθέτων” ιδιοκτησιών) με άτυπη διανομή χωρίς συμβόλαια, πράγμα που δεν μπορεί να επιτευχθεί νομικά, όπως επαναλαμβάνει και η υπ’ αριθ. 208/2022 απόφαση του Μονομελούς Εφετείου Ναυπλίου.
Στην απόφαση αυτή, πολύ περιληπτικά και σε απλή γλώσσα, για όσους δεν γνωρίζουν νομικά, το Δικαστήριο έκρινε ότι σε περίπτωση συγκυριότητας ενός κοινού ακινήτου από περισσοτέρους συγκληρονόμους, δεν μπορεί αυτό να χωρισθεί σε διαφορετικά διαμερίσματα υπάρχοντος κτηρίου ή και τμήματα του ιδίου οικοπέδου, έστω κι αν συμφωνούν οι συγκύριοι ποιος θα πάρει ποιο διαμερίσμα, αν προηγουμένως δεν έχει συσταθεί με συμβολαιογραφική πράξη οροφοκτησία, αν δηλ. δεν έχει έχει γίνει προηγουμένως σύσταση οριζοντίου ιδιοκτησίας. Αφού όμως γίνει η σύσταση οριζοντίου ιδιοκτησίας και χωρισθεί το κοινό ακίνητο σε διαφορετικά διαμερίσματα (οριζόντιες ιδιοκτησίες) ή και σε τμήματα οικοπέδου (“κάθετες” ιδιοκτησίες, δηλαδή οριζόντιες κατ’ έκτασιν ιδιοκτησίες), είναι πλέον δυνατή η άτυπη και διά λόγου διανομή, ώστε κάθε ένας συγκύριος να πάρει αποκλειστική χρήση ενός διαμερίσματος και μετά από συνεχή και αδιατάρακτη χρήση, δηλαδή νομή, κάθε διαμερίσματος για τουλάχιστον είκοσι έτη, ο νομέας κάθε διαμερίσματος να καταστεί αποκλειστικός κύριος του συγκεκριμένου διαμερίσματος με έκτακτη χρησικτησία.
Στην συγκεκριμένη δικαστική απόφαση κρίθηκε υπόθεση στην οποία ο πατέρας απεβίωσε το 1977 και άφησε στα τρία του παιδιά ένα ακίνητο στην Παλαιά Επίδαυρο, το οποίο αποτελείτο από μία διώροφη οικοδομή και ένα ακόμα τμήμα του οικοπέδου όπου μπορούσε να χτισθεί μία δεύτερη οικία. Τα τρία παιδιά όταν βρέθηκαν να είναι συγκύριοι του ακινήτου αυτού, αποφάσισαν ατύπως, χωρίς συμβόλαια, να χωρίσουν μεταξύ τους το κοινό ακίνητο, έτσι ώστε το ένα παιδί να πάρει το ισόγειο της υπάρχουσας διώροφης οικίας, το άλλο παιδί να πάρει τον πρώτο όροφο και το τρίτο παιδί να πάρει το άλλο τμήμα του οικοπέδου, όπου μπορούσε να χτισθεί δεύτερο σπίτι. Το Δικαστήριο έκρινε ότι η άτυπη αυτή διανομή δεν μπορούσε να ισχύσει, ούτε μετά την πάροδο είκοσι ετών μετά το 1977 όπου διά λόγου συμφώνησαν την διανομή και δεν είναι νομικά εφικτό με χρησικτησία να δημιουργηθούν αυτόνομα διαμερίσματα (ένα στο ισόγειο και ένα στον πρώτο όροφο), ούτε αυτόνομη “κάθετη” ιδιοκτησία στο ξεχωριστό τμήμα του οικοπέδου, ακόμα κι αν τα τρία αδέλφια τα είχαν βρει μεταξύ τους και για πάνω από είκοσι χρόνια είχε πάρει και χρησιμοποιούσε το καθένα με την οικογένειά του τον κάθε ξεχωριστό όροφο - διαμέρισμα και το ξεχωριστό τμήμα όπου έχτισε και δεύτερο σπίτι στο οικόπεδο το τρίτο παιδί.
Αφού όμως το έτος 1997 πήγαν σε συμβολαιογράφο, υπέγραψαν και μετέγραψαν στο υποθηκοφυλακείο σύσταση οριζοντίου ιδιοκτησίας, με την οποία δημιούργησαν στο κοινό οικόπεδο τρεις οριζόντιες ιδιοκτησίες, δηλ. δύο διαμερίσματα στην υπάρχουσα διώροφη οικία και μία “κάθετη” τρίτη οριζόντια κατ’ έκτασιν ιδιοκτησία και συνέχισαν για πάνω από είκοσι χρόνια (1997 - 2017) να χρησιμοποιούν ο καθένας των αδελφών αποκλειστικά την κάθε μία από τις τρεις οριζόντιες ιδιοκτησίες που είχαν συστήσει συμβολαιογραφικώς το 1997, είχαν πράγματι το 2017 αποκτήσει ο καθένας από τα τρία αδέλφια αποκλειστική κυριότητα σε καθένα ξεχωριστό τμήμα του ιδίου ακινήτου. Είχε, δηλαδή, γίνει πλέον το 2017 ο ένας αδελφός κύριος του ισογείου διαμερίσματος της υπάρχουσας οικίας, ο δεύτερος αδελφός είχε γίνει αποκλειστικός κύριος του πρώτου ορόφου της ίδιας οικίας και ο τρίτος αδελφός έγινε αποκλειστικός κύριος του ετέρου ξεχωριστού τμήματος του κοινού ακινήτου όπου ανεγέρθηκε η δεύτερη οικία.

When you buy property in Greece, you need first to strike a verbal agreement with the seller or the real estate agent on the exact price for the property you are to purchase. Then, it is strongly advisable to retain an attorney who will act on your behalf and will be briefed on the details of the transaction, in order to draft, along with the seller’s side, a private agreement which will include all the basic terms for the transaction and possibly the payment of a deposit. The buyer’s attorney will make the detailed title search on the legal history of the property in question and its possible legal burdens, including mortgages and liens, or the absence of them, which usually opens the way for the purchase.
One of the main expenses the buyer is undertaking when purchasing real estate property in Greece is the transfer tax, which is estimated on the tax value of the property, or on its market value, if the market value is higher than the tax value. The tax value of a property is estimated according to objective criteria established by the government, while the market value is the price the two parties, seller and buyer, have agreed on.
The transfer tax in Greece today is 3% on the tax value (or the market value, if it is higher) and it is paid by the buyer shortly before the signing of the closing deed for the purchase. Only when the transfer tax is paid, according to the brief outline of the purchase deed which has been uploaded by the notary on the tax authority’s site, the certificate that the tax has been paid is issued and the closing deed can be executed at the notary’s office by the seller and the buyer, or their proxies.
It is noteworthy that the transfer tax of 3% is applicable on newly constructed properties, as well. A 2006 law which introduced VAT 24% on all new properties has been suspended from 2020 until end of 2022. It is also expected that the suspension of VAT on the purchase of newly built properties will be extended until end of 2024.
Finally, it must be pointed out that, if the buyer of the property is a tax resident of Greece, he/she must be able to justify the acquisition of the funds which are paid for the purchase of the property, including those for the payment of the transfer tax, as well as the notary’s fee. The buyer, in other words, must have filed income tax declarations in Greece in the several past years, where the income declared, minus the expense of life each year in Greece, is enough to cover the funds for the purchase of the property. Other ways to justify the funds for the purchase are the previous sale of properties or other assets in the past, or the acceptance of an estate in Greece, which may have included cash or balance of bank accounts. If the buyer is a foreign tax resident, the justification of the acquisition of the funds for the purchase of the property is achieved with the bank documents which prove the import of the money from abroad into a bank account of the buyer in Greece.

Ο ΕΝΦΙΑ είναι ο ετήσιος φόρος περιουσίας που έχει καθιερωθεί στην Ελλάδα εδώ και περίπου δέκα χρόνια. Μέχρι σήμερα το ελληνικό κράτος εξέδιδε το ποσό του φόρου που κάθε έτος πρέπει να πληρώσουν οι ιδιοκτήτες ακινήτων στις αρχές Σεπτεμβρίου κάθε χρονιάς. Ο φόρος πληρωνόταν συνήθως σε έξι μηνιαίες δόσεις. Φέτος για πρώτη φορά ο ΕΝΦΙΑ έχει υπολογιστεί και ανακοινωθεί από τις κρατικές υπηρεσίες στα μέσα Μαϊου και η πληρωμή του θα γίνει σε δέκα μηνιαίες δόσεις. Η πρώτη δόση λήγει στις 31 Μαϊου 2022. Η τελευταία δόση λήγει στις 28 Φεβρουαρίου 2023.
Εάν ο φορολογούμενος που έχει ακίνητα στο όνομά του δεν πληρώσει εντός της προθεσμίας της κάθε δόσης, το ποσό αυξάνεται. Η αύξηση είναι μικρή τους πρώτους μήνες της καθυστέρησης, αλλά όσο πιο πολύς καιρός περνάει από την μη πληρωμή των δόσεων, τόσο μεγαλύτερη γίνεται η αύξηση του ΕΝΦΙΑ κάθε μήνα που ο φόρος αυτός δεν πληρώνεται. Από την άλλη πλευρά, υπάρχουν και εκείνοι οι ιδιοκτήτες ακινήτων και υπόχρεοι στον φόρο, οι οποίοι τον εξοφλούν άπαξ με μία πληρωμή μέχρι το τέλος της πρώτης δόσης, παρά το γεγονός ότι όποιος πληρώσει ολόκληρο τον φόρο εντός της προθεσμίας της πρώτης δόσης, δεν κερδίζει κάποια έκπτωση στο ποσό του φόρου.
Ο ΕΝΦΙΑ αποτέλεσε το μεγαλύτερο παράπονο της μεσαίας τάξης κατά του πολιτικού συστήματος που τον εισήγαγε και τιμώρησε εκλογικά την κυβέρνηση που τον μονιμοποίησε. Η έντονη αυτή δυσφορία του μέσου Έλληνα ιδιοκτήτη ακίνητης περιουσίας κατά του ετήσιου φόρου περιουσίας, αποτελεί και την αιτία που τα τελευταία δύο με τρία χρόνια ο ΕΝΦΙΑ έχει μειωθεί. Μάλιστα, αρκετοί ιδιοκτήτες έχουν δει την τελευταία διετία πολύ σημαντική μείωση του εν λόγω φόρου.
Την φετινή χρονιά, τον Μάιο του 2022, η κυβέρνηση έχει μειώσει κι άλλο τον «λαομίσητο» αυτόν φόρο και συγκεκριμένα, ο φόρος έχει μειωθεί κατά 10%, για ακίνητη περιουσία αξίας έως 400.000 ευρώ. Η μείωση είναι 15% για περιουσία έως και 300.000 ευρώ. Η μείωση είναι 20% εν σχέσει με πέρυσι για όποιον διαθέτει περιουσία αξίας έως και 250.000 ευρώ, ενώ η μείωση είναι 25% για όσους έχουν ακίνητη περιουσία έως 150.000 ευρώ. Όσοι έχουν περιουσία έως 100.000 ευρώ πρέπει να έχουν δει φέτος μείωση στην ΕΝΦΙΑ κατά 30%, ενώ ακόμα μεγαλύτερη μείωση κατά 50% του φόρου βλέπουν όσοι πληρούν κάποια χαμηλά εισοδηματικά κριτήρια και επιφάνεια ακινήτων σε τετραγωνικά μέτρα όχι μεγαλύτερη από 150 τ.μ. αξία ακίνητης περιουσίας όχι πάνω από κάποια όρια.
Οι ομογενείς και κάτοικοι εξωτερικού που έχουν ακίνητο ή ακίνητα στην Ελλάδα (αγροτεμάχιο, οικόπεδο, διαμέρισμα, μονοκατοικία, μαγαζί) ή και ποσοστό εξ αδιαιρέτου επ’ αυτών, αλλά και όσοι έχουν επικαρπία ή ψιλή κυριότητα, πρέπει να ανατρέξουν στην ιστοσελίδα της ΑΑΔΕ με τους κωδικούς πρόσβασης που έχουν (username, password) για να δουν πόσος είναι ο ΕΝΦΙΑ που πρέπει να πληρώσουν φέτος. Ακολούθως, σε συνεννόηση με τον φορολογικό εκπρόσωπό τους στην Πατρίδα ή με συγγενείς που παρακολουθούν τα φορολογικά τους ή με τον λογιστή ή τον δικηγόρο τους, πρέπει να πληρώσουν τον φόρο για να μπορούν όποτε το θελήσουν στο μέλλον να πουλήσουν το ακίνητό τους ή να το μεταβιβάσουν στα παιδιά τους ή σε όποιον άλλον επιθυμούν.

Most people who buy or own real estate property in Greece, believe that if they have their deeds on the properties properly done at the notary’s office, and registered at the land registry, they have safeguarded their ownership on the properties no matter what. However, reality in Greece could be somehow different. Yes, the deeds, titles and survey maps of the properties are very important for the owner of the property. Possession of such deeds, contracts and topographic plans (survey maps) by the owner are very significant for the owner’s ability to prove to any authority, court or third party (like, real estate agents) that they own the property and what are the specific characteristics of the property, including its surface in square meters of the land, the plot and / or of the house or apartment, its boundaries, possibly names of neighbors etc.
The deeds, though, the titles and the survey maps only, may not be enough for the owner to protect his/her property in the long run from trespassers or others, who may claim all types of rights on the same property. The main risk a property owner may face is potential claims of adverse possession by a third party on his own property. The nature of the adverse possession claim is that someone claims that he/she has a right on a certain piece of property, without having titles and legal deeds about this property. The foundation of an adverse possession claim is basically the argument that someone has been using the property in question for a certain period of years, acting towards others as the owner of the property and that such long usage has given him/her property rights through adverse possession, even if he/she does not have titles on the property, because he/she never purchased it or never had it legally transferred to him/her by a third party.
The legal owner of a land, plot, house or an apartment, who has paid money to buy it, has signed notarial deeds with the seller, and has also registered the deed of purchase with the local land registry, is not 100% safe from adverse possession claims by a third party, if the owner does not exercise his/her property rights in practice every day, every month, or at least every few years. This can be done either in person, or through proxies, who act on the owner’s behalf. One may have paid money to buy a property in Greece, may have signed the most perfect and accurate deeds, which are registered with the tax office (E9 form) and the land registry, having also done a very modern survey map. But if he/she does not visit the property, does not inspect it from time to time, does not check on trespassers, does not make sure that the boundaries are not changed, or that the house has not been occupied by third parties who may have also changed the locks, runs a risk of losing the ownership of the property if the case goes to court.
The longer a property is left unattended by its owner and the longer the legal owner does not check its actual status, the more significant the risk is to face an adverse possession claim by a third party. This is the reason why the owner – foreign resident of a property located in Greece, must visit the property as often as possible, and take pictures of its present condition, of its boundaries, of the parts of the building or of the trees in it. The owner must also make sure he/she keeps all the receipts for expenses done for the management of the property, including receipts from workers, developers, builders etc. who have done any type of work on the property. The receipts must state the name of the owner as the person who paid the expenses for all sorts of work done at the property or for the property. If the owner rents the land to a tenant for cultivation or for pasture rental, a lease / rental agreement must be signed clearly mentioning who is the owner of the property, who is entitled to receive the rent, in whatever form this rent may be.
If the owner of the property can’t visit it very often, he/she must instruct or request trusted persons on the spot, acting on behalf of the owner, to inspect it periodically and to check that its boundaries, fences, doors and other identification elements of the property have not been damaged or changed and that there are no signs of trespass.
