Εγκαταλελειμμένα Ακίνητα Στην Ελλάδα

Ομογενείς συχνά επικοινωνούν με δικηγόρους ή συγγενείς τους στην Ελλάδα θέλοντας να μάθουν για την τύχη ακινήτων που έχουν αμελήσει να παρακολουθήσουν για αρκετά χρόνια. Κάτοικοι εξωτερικού, παρασυρμένοι συχνά από την καθημερινότητα και τις έγνοιες της ζωής τους στην ξένη χώρα, πολλές φορές εγκαταλείπουν ακίνητα που έχουν στην Πατρίδα, χωρίς να τα επισκέπτοναι για πολλά χρόνια και χωρίς να έχουν αναθέσει σε κάποιοιν συγγενή ή γνωστό τους να τα ελέγχει, έστω σε αραιά χρονικά διαστήματα. Πρόκειται για ακίνητα που αγόρασαν ή τους δωρήθηκαν πριν από πολύ καιρό, ή για κληρονομιαία ακίνητα, που είτε έχουν αποδεχθεί πριν καιρό, είτε δεν έχουν κάνει ακόμα ούτε αποδοχή κληρονομίας.
Μετά από χρόνια, μία ειδοποίηση από την Ελλάδα για φόρους, ένα εξώδικο από συνιδιοκτήτες της πολυκατοικίας για χρωστούμενα κοινόχρηστα, μία όχληση από συνιδιοκτήτες για εκμετάλλευση του κοινού ακινήτου, ή ένα δικαστήριο στην Ελλάδα που θα γίνει για διανομή ή για κάποιο κληρονομικό ζήτημα, «ξυπνάει» το ενδιαφέρον των ομογενών για το ακίνητό τους στην Ελλάδα και επικοινωνούν με δικηγόρο για να ξαναπιάσουν το νήμα της τύχης του ακινήτου τους από την αρχή. Η συνήθης επιθυμία του κατοίκου εξωτερικού είναι ότι τώρα θέλει να πληρώσει τους όποιους οφειλόμενους φόρους και να ρυθμίσει όλες τις εκκρεμότητες του ακινήτου ή των ακινήτων του, ώστε να τα εκμεταλλευθεί, να τα μεταβιβάσει με γονική παροχή στα παιδιά του ή να τα πουλήσει.
Ο ομογενής πρέπει πρώτα πρώτα να στείλει στον δικηγόρο του στην Ελλάδα, έστω σε απλό αντίγραφο μέσω ηλεκτρονικού ταχυδρομείου, όποιο συμβόλαιο έχει για το ακίνητο, αν το είχε παλιά αγοράσει, ή αν είχε κάνει αποδοχή κληρονομίας ή άλλη μεταβίβαση. Αν δεν έχει, θα ενημερώσει τον δικηγόρο του για την τοποθεσία όπου βρίσκεται το ακίνητο και με το όνομα του ομογενούς ή των γονέων του, ο δικηγόρος θα μπορέσει να εντοπίσει στο υποθηκοφυλακείο / κτηματολόγιο το συμβόλαιο. Ακολούθως, θα ελεγχθεί αν ο ομογενής έχει Αριθμό Φορολογικού Μητρώου (ΑΦΜ) στην Ελλάδα και κωδικούς στην εφορία (username και password). Ό,τι από αυτά δεν υπάρχει, θα εκδοθεί τώρα με εξουσιοδότηση ή πληρεξούσιο που ο δικηγόρος θα στείλει στον ομογενή για να υπογράψει στο Προξενείο ή σε συμβολαιογράφο εξωτερικού με Αποστίλλη.
Ο νομικός έλεγχος στην Ελλάδα θα περιλάβει και το αν το ακίνητο έχει δηλωθεί ή αν πρέπει τώρα να δηλωθεί στο Κτηματολόγιο, αν υπάρχουν ακόμα προθεσμίες, αν χρειάζεται να γίνει δικαστήριο για να δηλωθεί το ακίνητο που τώρα φαίνεται ως “αγνώστου ιδιοκτήτη” και αν πρέπει να γίνει τοπογραφικό, εφόσον πρόκειται για μονοκατοικία, σπίτι στο χωριό, οικόπεδο ή αγροτεμάχιο. Αν υπάρχουν συνιδιοκτήτες του ακινήτου, πρέπει να εντοπισθούν για να ληφθεί από όλους απόφαση για την τύχη του κοινού ακινήτου.
Ο δικηγόρος στην Ελλάδα με την εξουσιοδότηση θα ελέγξει για το αν οφείλεται ΕΝΦΙΑ, δηλαδή φόρος περιουσίας, που συνήθως είναι πολύ χαμηλός στην Ελλάδα. Μπορεί το ακίνητο να μην έχει ποτέ δηλωθεί στο Ε9 της εφορίας ή ποτέ να μην έχει γίνει ηλεκτρονική δήλωση, οπότε θα γίνει τώρα και θα πληρωθούν τα ΕΝΦΙΑ για τα πέντε τελευταία χρόνια. Αν πρέπει να γίνει αποδοχή κληρονομίας, θα συλλεχθούν όλα τα έγγραφα για να δηλωθεί το ακίνητο σε όσες αρχές και υπηρεσίες πρέπει και να περάσει τελικώς στην κυριότητα του ομογενούς που ενδιαφέρεται για την τύχη του. Σημειώνεται ότι για κληρονομιές από το 2003 και πίσω, δεν οφείλεται καθόλου φόρος κληρονομίας. Μπορεί για το ακίνητο να υπάρχουν οφειλές στον Δήμο, σε κοινόχρηστα, για ηλεκτρικό ρεύμα και νερό, ενώ μπορεί να πρέπει να γίνει δήλωση τετραγωνικών στον Δήμο ή νομιμοποίηση, λόγω πολεοδομικών παραβάσεων. Στις περισσότερες περιπτώσεις ό,τι διαδικασία και να απαιτείται, όσο γραφειοκρατική κι αν είναι και όποιο κόστος και να έχει, η αξία του ακινήτου συνήθως θα είναι αρκετά μεγαλύτερη, ώστε να συμφέρει τον ιδιοκτήτη του να μεριμνήσει τώρα για το παραμελημένο ακίνητο και να το καταστήσει νόμιμο και τακτοποιημένο, ώστε να το εκμεταλλευθεί ή να το πουλήσει.

A Foreign Will May Not Be Applicable In Greece

Many Greeks living abroad or even non-Greeks, who own assets in Greece, make their Will, to direct where they wish to leave their property. With regards to property they own in Greece, their goal must be to draft a Will which will be straightforward in its application, according to Greek law and practice. What must be avoided in the text of the Will is wording, which may be adequate for a Will in the country of their residence, according to laws and practice in that country, but which will create immense bureaucratic delays or even legal deadlocks when legal practitioners in Greece attempt to implement it.
The “T” word is the main example of the word which must be avoided, when drafting a Will aimed to direct how the property in Greece will be distributed. The word and the legal notion of ”Trust” or “Testamentary Trust” is not known in Greek law and when found in the text of a foreign Will, it usually creates legal uncertainties, to say the least, when the lawyer for the heirs in Greece is trying to implement the Will’s provisions. Instead of such terms, which are not used in Greek law, the testator could elect to use legal language suggested by a lawyer in Greece, who will listen to the testator’s wishes and then come up with a text which will guarantee on the one hand that it represents the wishes of the testator, and on the other, that it can be implemented by lawyers, notaries, tax authorities, land registries and municipalities in Greece.
Another notion which could be avoided since it does not play any significant role in the implementation of a Will in Greece is that of the “Executor”. Such a provision, in most cases, is not necessary in a Will, since Greek law requires that the heirs themselves act in order to accept their shares on the estate, by retaining their own legal counsel to represent them and to do the legal process, which will end with the transfer of the ownership of the share or of the asset to the heir. One attorney can represent all or some of the heirs, and the heirs do not have to retain the same lawyer to settle the estate. Although in most cases, where there are no conflicting rights and claims, having one attorney to represent all the heirs might be advisable and ideal, each heir has, nonetheless, the right to retain his/her own attorney to represent solely his/her own rights. The Executor essentially does not play any role, in most cases, in order to represent the estate and the heirs, since everyone in Greece who is instrumental in the transfer of the estate’s assets, recognizes the actions of the heirs themselves and not those of any executor who, at best, has a limited role.
In a nutshell, the person who wishes to draft a Will to provide for the distribution of his/her assets in Greece, has two options. One is to draft a Will in the foreign country where he/she lives, by which he makes provisions for his assets in that foreign country, according to the laws of that country, as his primary goal. This foreign Will is then reviewed by a Greek lawyer, who will determine whether this Will could also be implemented, in that wording, in Greece and if the answer is in the affirmative, the Will is drafted in the foreign country and it will be probated, when the time comes, first in the foreign country and subsequently in Greece, as well.
The other option is to make one Will in the foreign country and another, separate, in Greece. The last one will be drafted according to Greek law and will reflect the wishes of the testator for the part of the estate located in Greece, whether we are talking about immovable property, or bank accounts or other movables. Greek Wills can be relatively simple, with plain and clear provisions, which will be understood by Greek legal practitioners. If the estate in Greece does not involve large and complicated business and other assets, there is no need to include elaborate provisions for tax and trust issues, which are not useful, when we are to settle an estate in Greece.

A joint bank account is a bank account where more than one person are owners of the account, each of them having the right to independently withdraw money from the balance of the account, without the consent of the other joint owners. Each time a joint owner withdraws money from the joint account, the bank’s obligation towards all the joint owners is deleted for the amount the joint owner withdrew. If the balance of a joint account is 10,000 euros and one of the three joint owners independently withdraws, on his/her own and without the necessary consent of the others, the amount of 2,000 euros, the bank’s obligation towards all the joint owners is reduced to 8,000 euros.
Under Greek law, if one of the joint owners withdraws an amount of money from the balance of the joint account, the other joint owners have the right to claim the amount or a part of it, from the owner who withdrew the amount, not from the bank. The other joint owners can claim their share from the amount the joint owner withdrew, depending on the legal relationship between all joint owners and their internal agreements. For example, if two partners in a company have an agreement that they share 50/50 the profits of their company, and one of them withdraws 5,000 euros from their joint account, the other has the right to claim from his partner 2,500 euros. If they own a company where partner A owns 80% of the company, while partner B owns 20%, in case partner B withdraws any amount from their joint account, partner A has the right to claim 80% of the amount partner B withdrew from their joint bank account.
If the joint owners of the bank account do not have any specific agreement between them or if it cannot be proven what was their internal agreement, Greek law states that they should split 50/50 the balance of their joint bank account, in case of dispute.
If one of the joint owners dies, the surviving owners become owners of the balance of the account. All Greek banks, based on a Greek law of 1932, each time a joint bank account is opened, provide for signing standard forms which, among other terms, state that in the case where one of the joint owners passes, the heirs of that joint owner do not have any right on the balance of the joint account, which becomes the ownership of the surviving joint owners. The Greek tax authority does not claim inheritance taxes on the balance of that account, because the balance goes to the surviving joint owners not as heirs, but in their own right.
In its Decision No. 351/2018 the Supreme Court of Greece dealt with a case where the father, the daughter and the son owned a joint bank account, which of course included the term that in case of the passing of one of the co-owners, the balance goes to the surviving owners and not to the heirs of the deceased joint owner. The father died and therefore the account became a joint account between the daughter and the son, not because they were the heirs of the deceased joint owner, but because they were the surviving joint owners, irrespective of their kinship to the deceased.
After the passing of the father, the son withdrew an amount and the daughter claimed from him 50% of it. When he refused her claim, she filed a civil action and both the Court of First Instance and the Court of Appeals determined that, in the absence of any specific internal agreement between the two joint owners, son and daughter, the daughter was entitled to receive from her brother the 50% of what he had withdrew from their joint account. When the son challenged the decision at the Supreme Court, the decision was the same, confirming that the judgments of the lower courts had properly applied the law.

Πολλοί είναι ο Έλληνες ομογενείς, κάτοικοι εξωτερικού, που αγοράζουν ακίνητα στην Ελλάδα, διότι τα τελευταία χρόνια οι τιμές τους έχουν μειωθεί. Αρκετοί είναι όμως και εκείνοι που πουλάνε ακίνητα που έχουν στην Πατρίδα, είτε διότι θέλουν να αγοράσουν κάτι άλλο στην Ελλάδα, είτε διότι θέλουν να αποκτήσουν μετρητά για επένδυση σε άλλη χώρα
Ο ιδιοκτήτης ακινήτου στην Ελλάδα που θέλει να το πουλήσει πρέπει να έχει, έστω και σε φωτοτυπία, τους τίτλους του ακινήτου, δηλαδή τουλάχιστον αντίγραφο του συμβολαίου με το οποίο το είχε αποκτήσει, αν όχι και τα προηγούμενα συμβόλαια. Αν το είχε αγοράσει, ή του είχε γίνει γονική παροχή από γονέα του, ή του είχε δωρηθεί από κάποιον, ή το είχε κληρονομήσει, πρέπει να έχει το συμβόλαιο, μαζί με το πιστοποιητικό ότι αυτό το συμβόλαιο είχε μεταγραφεί στο υποθηκοφυλακείο, ή το φύλλο και απόσπασμα από το Κτηματολογικό Γραφείο, αν στην περιοχή του ακινήτου λειτουργούσε ήδη κτηματολόγιο. Εάν, ωστόσο, δεν έχει αυτά τα συμβόλαια, ούτε το πιστοποιητικό μεταγραφής τους, δεν σημαίνει ότι δεν μπορεί να πωλήσει. Απλώς πρέπει να ζητήσει από έναν δικηγόρο στην Ελλάδα να κάνει έλεγχο τίτλων στο όνομα του πωλητή για να βρει τα συμβόλαια και να αποκτήσει επικυρωμένα αντίγραφα.
Ο πωλητής του ακινήτου πρέπει να λάβει φορολογική ενημερότητα από την εφορία στην Ελλάδα, ότι δεν οφείλει στην εφορία και ασφαλιστική ενημερότητα, που συνήθως οι ομογενείς δεν έχουν πρόβλημα να λάβουν. Επίσης, πρέπει να λάβει πιστοποιητικό ΤΑΠ από τον Δήμο στον οποίο βρίσκεται το ακίνητο, για το οποίο θα χρειασθεί, εφόσον πρόκειται για διαμέρισμα ή μονοκατοικία, τον τελευταίο λογαριασμό ρεύματος με απόδειξη ότι έχει πληρωθεί.
Εάν εκείνος που τώρα πουλάει έχει αποκτήσει το ακίνητο από κληρονομιά η δωρεά, απαιταίτει να λάβει πιστοποιητικό από την εφορία ότι δεν οφείλει φόρο κληρονομίας ή δωρεάς. Για την πώληση χρειάζεται επίσης βεβαίωση πολιτικού μηχανικού ότι το διαμέρισμα ή η μονοκατοικία δεν έχει πολεοδομικές παραβάσεις, αλλά και πιστοποιητικό ενεργειακής απόδοσης, ενώ αν πρόκειται για οικόπεδο, η βεβαίωση θα γράφει ότι δεν υπάρχει κτίσμα εντός αυτού. Αν το ακίνητο είναι σε περιοχή όπου λειτουργεί Κτηματολογικό Γραφείο, χρειάζεται φύλλο και απόσπασμα κτηματολογικού διαγράμματος, ή πιστοποιητικό κτηματογραφούμενου ακινήτου. Το αντίγραφο της αδείας οικοδομής είναι ένα έγγραφο που θα βοηθήσει πολύ για την ολοκλήρωση της πωλήσεως.
Για την πώληση απαιτείται επίσης πιστοποιητικό ΕΝΦΙΑ, από το οποίο να προκύπτει ότι το ακίνητο δηλώνεται με ακριβή περιγραφή του στο Ε9 της εφορίας και ότι πληρώνεται κάθε χρόνο ο ΕΝΦΙΑ. Ο πωλητής πρέπει να έχει πληρώσει το ΕΝΦΙΑ τουλάχιστον τα τελευταία πέντε έτη και να έχει ηλεκτρονική πρόσβαση στον φορολογικό του φάκελλο με username και password. Αν το πωλούμενο είναι οικόπεδο ή αγροτεμάχιο, απαιτείται σύγχρονο, δηλαδή όχι παλαιό, τοπογραφικό, με πλήρη απεικόνιση των ορίων και των λοιπών χαρακτηριστικών του ακινήτου, ώστε ο αγοραστής να δύναται να γνωρίζει αν το οικόπεδο ή το αγροτεμάχιο μπορεί να οικοδομηθεί, πόσα τετραγωνικό χτίζονται και τους λοιπούς οικοδομικούς όρους, διότι η αξία του είναι αρρήκτως συνδεδεμένη με το “αν χτίζει” και πόσο. Αναλόγως της ιδιαιτερότητας του ακινήτου και της υποθέσεως, μπορεί να χρειάζονται και άλλα πιστοποιητικά και έγγραφα, όπως επί παραδείγματι εάν στο ακίνητο φαίνονται κατασχέσεις ή άλλα βάρη προς τράπεζες ή τρίτους, τα οποία πρέπει πρώτα να πληρωθούν και μετά να γίνει η πώληση, εκτός αν ο αγοραστής αναλάβει να τα πληρώσει αυτός, μειώνοντας το τίμημα που θα πληρώσει στον πωλητή.
Για να μπορεί να πωλήσει κάποιος κάτοικος εξωτερικού πρέπει είτε να έλθει ο ίδιος στην Ελλάδα και να μεριμνήσει για όλα τα παραπάνω έγγραφα και διαδικασίες, που στην καλύτερη περίπτωση απαιτούν ολίγες εβδομάδες, είτε να υπογράψει πληρεξούσιο στην χώρα κατοικίας του στο εξωτερικό, προς δικηγόρο ή άλλο έμπιστο πρόσωπο στην Ελλάδα, όχι μόνο για να συγκεντρώσει τα ανωτέρω έγγραφα, αλλά και για να τον συμβουλεύσει με ποιόν τρόπο θα εξασφαλίσει ότι θα λάβει τα χρήματά του από την πώληση του ακινήτου του. Το πληρεξούσιο πρέπει να συνταχθεί από συμβολαιογράφο ή δικηγόρο Ελλάδος και να υπογραφεί είτε στο Προξενείο, είτε σε συμβολαιογράφο της χώρας του εξωτερικού, με Αποστίλλη ή επικύρωση από το Προξενείο, αναλόγως της χώρας.

Greek law applies lex sanguinis (law of blood), as opposed to lex soli. Lex sanguinis or jus sanguinis, is the basic legal principle of private international law, which practically says that a person’s nationality or citizenship is determined by the citizenship of his/her parents and not by the citizenship of the country where that person was born. For example, if two Greek citizens immigrated from Greece to the United States of America, married there and gave birth in the US, to their child, that child, according to Greek private international law, is entitled to the Greek citizenship. On the contrary, Greek law also states that if two Chinese citizens give birth to their child in Greece, their child, in principle, is not entitled to the Greek citizenship. That child, Greek law provides, is entitled to the Chinese citizenship.
Greece and many other countries apply lex sanguinis with regard to citizenship, because they choose to grant their citizenship even to people born outside of their boundaries, as long as at least one of the parents or grandparents is a Greek citizen. The obvious rationale of such a fundamental legal choice for a country is the determination to retain ties with its people who become immigrants in other countries. Greece saw a large number of its citizens leave the country from the beginning of the 20th century until the 1970’s. Millions of Greeks immigrated to several countries, among which the USA, Canada, Australia, Germany, South Africa and many other. Greece could not afford to cut ties with its people, irrespective of whether those left the country did it for good or not. After all, the people themselves never wanted to cut their ties with motherland or Patrida. It was natural, therefore, that Greek law assumed principles and laws which essentially keep the legal ties of the plethora of immigrants and their families to their beloved country of birth. Moreover, many of the Greek immigrants dreamed to make some money in the foreign country and return to Greece, irrespective of whether this happened or not in the end.
Furthermore, Greeks view family as one of the highest priorities in life, one of the most sacred things. The children of the Greek immigrants, born in the foreign countries, spoke Greek, mostly became Christian Orthodox and kept Greece in high esteem. How could all those first and second generation Greeks be denied of their Greek roots and the citizenship of their ancestors? They could not and they can’t.
That is why Greek law states, in rough terms, that if a foreign-born person can prove their ancestral connection, (birth – marriage – birth with no significant name changes), to a proven Greek citizen, that person is entitled to the Greek citizenship. That translates to the right of such a foreign-born person to apply for the Greek citizenship, if he/she can prove that his/her grandparent or parent was born and is registered as a Greek citizen in Greece. There are of course terms and conditions and Greek bureaucracy makes it difficult or even (unfairly) impossible sometimes for a foreign-born person to obtain the citizenship, simply because the spelling of a name is different from one certificate to the other, or because we cannot locate the proper marriage (civil or religious) or the right birth record or certificate. We deal with such complications in other articles.
Finally, connected to the rule of lex sanguinis applicable by Greek law, is the distinction existing in Greece between the birth record (Lixiarhiki Praxi Geniseos) and the birth certificate (Pistopiitiko Geniseos). The first is issued by the Greek administration for every child born in Greece, irrespective of the citizenship of its parents. Therefore, the child born in Greece, to two Chinese citizens, receives a birth record, but not a birth certificate. The birth record is evidencing the act of birth of a child, the parents’ names, date and place of birth and other data. However, since the child does not have at least one Greek parent, even if the child is born in Greece, it will only obtain a birth record and not a birth certificate. The birth certificate is granted to the child born to at least one Greek parent and the birth certificate means that the child is registered at the Demotologion, which is the main book of citizens. When the foreign-born person obtains the Greek citizenship, she/he obtains a birth certificate and is registered with the Demotologion.

Αγοραπωλησία Ακινήτου Στην Ελλάδα

Κάθε αγορά ή πώληση ακινήτου στην Ελλάδα έχει τα δικά της δεδομένα, που μπορεί να διαφέρουν κατά περίπτωση. Σ’ αυτό το άρθρο αναφέρουμε εντελώς περιληπτικά τα βασικά που πρέπει να γνωρίζει κάποιος κάτοικος εξωτερικού, που θέλει να αγοράσει ή να πωλήσει ένα ακίνητο στην Ελλάδα.
Τα πιο πολλά έγγραφα απαιτείται να τα προσκομίσει στον συμβολαιογράφο ο πωλητής, ενώ τα πιο πολλά έξοδα καλείται να τα καταβάλει ο αγοραστής, αφού άλλωστε αυτός είναι που αγοράζει.
Ο πωλητής πρέπει να λάβει από την εφορία πρόσφατη φορολογική ενημερότητα, έγγραφο δηλαδή που βεβαιώνει ότι δεν χρωστάει στην εφορία στην Ελλάδα. Πρέπει επίσης να λάβει βεβαίωση από πολιτικό μηχανικό, ότι η μονοκατοικία ή το διαμέρισμα που πουλάει είναι χτισμένα χωρίς πολεοδομικές παραβάσεις, ή αν τέτοιες έχουν βρεθεί, ότι τις έχει νομιμοποιήσει και πλήρωσε τα πρόστιμα. Αν πουλάει οικόπεδο, τότε χρειάζεται βεβαίωση μηχανικού ότι το οικόπεδο δεν έχει κτίσμα. Αν πουλάει ακίνητο που απέκτησε από δωρεά, ή κληρονομιά, χρειάζεται να πάρει από την εφορία βεβαίωση ότι έχει καταβληθεί ο φόρος δωρεάς ή κληρονομίας, εκτός αν η κληρονομιά είναι προ του 2004, διότι για τις κληρονομιές προ του 2004, δεν οφείλεται σήμερα φόρος κληρονομίας. Ο πωλητής πρέπει επίσης να λάβει και πιστοποιητικό ΤΑΠ από τον Δήμο όπου βρίσκεται το ακίνητο, ότι δεν οφείλει δημοτικό φόρο. Για να το πάρει, πρέπει να προσκομίσει τον τελευταίο λογαριασμό της ΔΕΗ με απόδειξη ότι έχει πληρωθεί. Επίσης, πρέπει να προσκομίσει πιστοποιητικό της εφορίας ότι δεν οφείλει ΕΝΦΙΑ, από το οποίο να προκύπτει ότι το ακίνητο περιγράφεται με τον ίδιο τρόπο, τόσο στο πιστοποιητικό ΕΝΦΙΑ, όσο και στην βεβαίωση μηχανικού και τελικώς στο συμβόλαιο αγοραπωλησίας. Ο πωλητής πρέπει επίσης να εξασφαλισθεί νομικά και πρακτικά ότι θα λάβει το τίμημα που έχει συμφωνήσει με τον αγοραστή και ότι το συμβόλαιο της αγοραπωλησίας τον εξασφαλίζει στο πολύ κρίσιμο αυτό σημείο, δηλαδή ότι θα πάρει τα χρήματα που έχει συμφωνήσει στον χρόνο που έχει ορισθεί. Πρέπει επίσης να προσκομίσει ασφαλιστική ενημερότητα, ότι δηλαδή δεν χρωστάει σε ασφαλιστικά ταμεία, καθώς και κτηματολογικό φύλλο, εάν στην περιοχή του ακινήτου λειτουργεί κτηματολογικό γραφείο.
Μεγάλη σημασία έχει για τους κατοίκους εξωτερικού το ότι δεν έχουν υποχρέωση να πληρώσουν φόρο υπεραξίας (capital gains tax), όταν πωλούν ακίνητο στην Ελλάδα, ακόμα και αν το πωλούν σε τιμή μεγαλύτερη από αυτήν στην οποία το αγόρασαν. Σχετικός νόμος υπάρχει στην Ελλάδα, που προβλέπει τέτοιον φόρο για τους πωλητές, αλλά η εφαρμογή του συνεχώς αναστέλλεται, λόγω της οικονομικής κρίσης.
Ο αγοραστής ακινήτου στην Ελλάδα προσκομίζει στον συμβολαιογράφο την ταυτότητα ή το διαβατήριό του. Η βασική του μέριμνα πρέπει να είναι ο έλεγχος τίτλων του ακινήτου με δικηγόρο, για να διαπιστώσει ότι το ακίνητο που αγοράζει δεν έχει νομικά ή άλλα βάρη και δεν συνδέεται με οφειλές του πωλητή. Εάν ζει στο εξωτερικό και δεν επιθυμεί να μεταβεί στην Ελλάδα για την υπογραφή του συμβολαίου αγοράς του ακινήτου, πρέπει να στείλει, προξενικό κατά προτίμηση, πληρεξούσιο στην Ελλάδα. Ο αγοραστής κατγαβάλλει την αμοιβή του συμβολαιογράφου, που συνήθως αυτός επιλέγει, για να συντάξει (μαζί με τον ή τους δικηγόρους) το συμβόλαιο αγοράς του ακινήτου. Ο αγοραστής πληρώνει επίσης τον φόρο μεταβιβάσεως, που συνήθως είναι 3% επί της αξίας του ακινήτου που αγοράζει, αν το ακίνητο δεν είναι νεόδμητο. Πληρώνει επιπροσθέτως και την μεταγραφή του συμβολαίου αγοράς του ακινήτου στο υποθηκοφυλακείο ή στο κτηματολογικό γραφείο. Αν αγοράζει οικόπεδο ή αγροτεμάχιο, συνιστάται ο αγοραστής να συμβουλευθεί και πολιτικό μηχανικό, για να βεβαιωθεί περί των όρων δομήσεως του οικοπέδου, για το πόσο μπορεί να χτίσει και υπό ποίες προϋποθέσεις.
Αν έχει μεσολαβήσει μεσίτης, είτε από την πλευρά του ενός είτε και από τους δύο, πωλητή και αγοραστή, η μεσιτική αμοιβή είναι συνήθως 2% επί της τιμής πωλήσεως του ακινήτου, κατ’ ανώτατο όριο.
