Same Name In Birth Certificate And Passport

For the application to obtain Greek citizenship, consistency in the spelling of names in different certificates ις one of the main preconditions Greek authorities check. The same person must be stated in the same way in more than one documents, so that the administration which is processing the citizenship application is convinced that it is the same person who was born at a specific place at a specific date with specific parents, and subsequently it is the same person who is married many years down the road and then, it is the same person who has children.
If the name is not spelled the same way in the fundamental certificates of birth of parent, marriage of parent and birth of child – applicant for citizenship, the Greek administration will advice that they are not convinced that it is the same person. The examination of a Greek citizenship application is based on the axiom that it must be proven that it is the same Greek citizen who first was born in Greece, then was married and subsequently gave birth to children, in order the children or even the grandchildren to be entitled to obtain the citizenship. If the name of the “original” Greek – born person is written in different ways in these certificates, the processing authority very often rejects the application because, according to them, the chain of birth, marriage, birth of children etc. is broken.
When Christos Loukopoulos was born in Greece, but was married in Australia as Chris Loukas, the Greek administration may accept (with difficulty) that Christos and Chris is the same person, but they will not accept that Loukopoulos and Loukas is the same person. If in the birth certificate of his children in Australia, the name of the father is written as Chris James Loukas, perhaps because his father was Dimitrios, it will not help either to establish that his children are the children of the original Christos Loukopoulos and are thus entitled to the Greek passport, because they will see in the file certificates with three different versions of the name of the same person, 1) Christos Loukopoulos, 2) Chris Loukas and 3) Chris James Loukas.
Two inconsistencies that perplex and often “kill” a citizenship application, are the middle name variations and the difference of name between birth certificate and passport for the same person. First, the middle name is something which does not exist in Greece. No one has a middle name. In few occasions, people may have a double first name, but the middle name is difficult to “transfer” to the Greek registration system. Usually, the official translator of the certificates makes the middle name as part of a two – name first name, or the translator puts the middle name as the father name of the person, since in many occasions, the middle name in a foreign country is the father name in Greece.
The other main problem is sometimes the difference between the name in the birth certificate and the passport. The same person was born as Fotios Karavasilis in the US, but today, when he is 45 y.o., his US passport states Frank Karavasilis. In Greece, the birth name and the passport name are always the same and if you change your name officially with a court order or an administrative decision, it changes everywhere. In the case of Fotios and Frank, the administration will not accept that it is the same person, that is why they will reject the citizenship application stating that the present applicant, who was identified by his passport as Frank, is not the person who was born to Greek parents, because the birth certificate states Fotios.
Anyone who wants to apply for the Greek citizenship, therefore, must have in mind the above realities and try to harmonize how his or her name is spelled in the most basic certificates, which prove his/her birth, his/her marriage and the birth of his/her children, as well as his/her present identity with the passport. In many cases, the foreign certificates can be modified in the foreign country, in a way that the name of the person is written the same way in all the certificates, something which will open the way for the Greek citizenship and the European passport.

When you own a property in Greece and someone else is occupying it, it has to be clarified under what legal regime the occupier is staying in your property and whether he has the right to do it or not. It could be that the person who occupies your property is your tenant and you, as the landlord, can verify whether the tenant is keeping his side of the deal by paying the rent and protecting your property or not, in which case you can file a lawsuit action or serve a notice to evict him. However, it could be that the occupier is not a tenant, because you and he never signed or agreed on any lease / rental agreement and that he is staying in your property or occupying it under another claim. He may argue, for instance, that he himself is the owner of the property and that he has the right to use it at his will. Alternatively, his argument could be that he has rented the property from someone else, who is the real owner or that he has permission to use the property under another legal pretext. You, on the other hand, may claim that you have your own legal titles, which are defeating the arguments the occupier is putting forward.
A similar situation was resolved by the court decision No. 751/2021 of the Athens Justice of the Peace Court. The owner of a house with a plot in Athens, living in the USA started negotiating, through a representative of hers in Athens, with the neighbours who run a bar right next to her property. The lady owned the house with the plot with a clear title going back a few decades and her ownership was not disputed. The neighbours who run the bar wanted to rent part of her plot to extend their bar space and the lady who owned the neighbouring house with plot started negotiating with them from June 2020. They discussed about the monthly rent which initially was set at 600 euros, but later rose to 700 euros per month. The discussions between the two sides involved the right of the bar owners to clean the part of the plot they wanted to rent, as well as to model it for the use they wanted to do.
More than a year after the start of the negotiations, the bar owners had cleaned and modelled the part of the neighbouring plot, spending a considerable amount of money. They had also paid to the owner of the plot (the lady living in the US) four monthly rents, of 720 euros each month. However, the lady from the US, as owner of the neighbouring plot, filed a petition for temporary injunction against them, claiming that they were trespassers and asking the court to order them to vacate the premises.
The respondents (owners of the adjacent bar) replied in their legal brief that they were not trespassing. They argued that they were tenants, because a lease – rental agreement had been concluded between them as tenants and the lady, owner of the plot, as landlord. The rental agreement was not concluded in writing, but nonetheless it was legally valid, because a rental agreement does not necessarily have to be agreed in writing, if its main terms regarding the amount of monthly rent and the identity of the rented property are agreed verbally between the landlord and the tenant.
The court heard the arguments by both sides, considered the evidence presented to it and decided that a rental agreement had indeed been struck between the two parties, even if this agreement was not in writing. From the evidence regarding the substance of their negotiations it turned out, according to the judge, that the two sides had agreed on the amount of the monthly rent and on the exact specifications of the part of the plot which was to be rented. The fact that the respondents had already paid rents covering a four - month period, of an amount of 720 euros per month, which the landlord had accepted and not rejected, was a significant indicator that the respondents were not trespassers who had illegally occupied the part of the neighbouring plot, but tenants who were exercising their rental right to use the property since they paid the monthly rent they had agreed with the landlord. Thus, the court rejected the petition for temporary injunction and ordered the petitioner to pay the legal expenses of the respondents.

Ακύρωση Διαθήκης Λόγω Πνευματικής Ανικανότητας

Για να είναι έγκυρη μία διαθήκη πρέπει ο διαθέτης που την έχει γράψει να είχε πνευματική διαύγεια και ικανότητα αντίληψης της πραγματικότητας όταν την συνέτασσε. Ο νόμος ορίζει ότι ανίκανοι να συντάσσουν διαθήκη είναι α) οι ανήλικοι, β) όσοι βρίσκονται σε δικαστική συμπαράσταση με πλήρη στέρηση της δικαιοπρακτικής τους ικανότητας ή με ρητή στέρηση της ικανότητας να συντάσσουν διαθήκη και γ) όσοι κατά το χρόνο σύνταξης της διαθήκης δεν έχουν συνείδηση των πράξεών τους ή βρίσκονται σε ψυχική ή διανοητική διαταραχή που περιορίζει αποφασιστικά τη λειτουργία της βούλησης τους.
Συχνά, το αν ο διαθέτης, δηλαδή εκείνος που συνέταξε την διαθήκη, έχει ή όχι συνείδηση των πράξεών του ή βρίσκεται σε ψυχική ή διανοητική διαταραχή που περιορίζει αποφασιστικά την βούλησή του, δεν είναι εύκολο να διαπιστωθεί. Μπορεί ο ένας κληρονόμος να υποστηρίζει ότι ο κληρονομούμενος ήταν σε ψυχική και διανοητική κατάσταση ώστε να συντάξει εγκύρως διαθήκη, αλλά ένας άλλος κληρονόμος να ισχυρίζεται ότι ο θανών δεν ήταν σε πνευματική κατάσταση που να του επιτρέπει την σύνταξη διαθήκης και ότι δεν αντιλαμβανόταν την πραγματικότητα γύρω του ή ότι είχε μειωμένη ικανότητα ελέγχου της αντικειμενικής πραγματικότητας.
Το αν μία διαθήκη ισχύσει ως έγκυρη ή όχι, έχει συνέπειες στην κληρονομική διαδοχή, διότι με την διαθήκη μπορεί να κληρονομεί ένας ή περισσότεροι κληρονόμοι ένα ή περισσότερα περιουσιακά στοιχεία του θανόντος, ενώ χωρίς την διαθήκη, μπορεί να κληρονομούν άλλοι κληρονόμοι, ή οι ίδιοι κληρονόμοι αλλά σε διαφορετικά ποσοστά. Μπορεί χωρίς την συγκεκριμένη διαθήκη να ισχύει μία προηγούμενη διαθήκη, που όριζε λίγο ή πολύ διαφορετικά πράγματα για το ποιος κληρονομεί και σε τι ποσοστό. Εάν το περιεχόμενο δύο ή περισσοτέρων διαθηκών έρχεται σε σύγκρουση μεταξύ τους, ισχύει η πιο πρόσφατη έναντι της πιο παλαιάς. Εάν όμως οι διαθήκες δεν έρχονται σε σύγκρουση μεταξύ τους, τότε μπορούν να ισχύουν όλες μαζί ταυτοχρόνως.
Στην υπ’ αριθ. 1333/2021 απόφαση του Πολυμελούς Πρωτοδικείου Αθηνών, το δικαστήριο έκρινε αγωγή που κατέθεσαν τα παιδιά του θανόντος για την ακύρωση της διαθήκης του, με την οποία άφηνε κάποια περιουσιακά στοιχεία στην σύντροφό του και στην κόρη αυτής, με τον ισχυρισμό ότι ο πατέρας τους κατά τον χρόνο σύνταξης της διαθήκης, λίγες ημέρες πριν πεθάνει, βρισκόταν σε διανοητική και ψυχική διαταραχή και ότι δεν είχε πνευματική διαύγεια και ικανότητα να συντάξει διαθήκη. Η διαθήκη είχε συνταχθεί από συμβολαιογράφο, ήταν δηλαδή μία δημόσια διαθήκη. Ο συμβολαιογράφος είχε μεταβεί στην οικία του διαθέτη όπου ενώπιον τριών μαρτύρων ο διαθέτης είχε προφορικά διατυπώσει ποια ήταν η επιθυμία του και ο συμβολαιογράφος είχε συντάξει την δημόσια διαθήκη. Μετά τον θάνατο του διαθέτη η διαθήκη δημοσιεύθηκε και σύμφωνα με το περιεχόμενό της, άφηνε συγκεκριμένα περιουσιακά στοιχεία στις δύο εναγόμενες, ήτοι την επί πολλά έτη σύντροφό του (καθώς η σύζυγός του είχε πεθάνει) και στην κόρη της.
Το δικαστήριο μελέτησε τα επιχειρήματα και των δύο πλευρών, διάβασε ένορκες βεβαιώσεις και έγγραφα που οι δύο αντίθετες πλευρές προσκόμισαν, αλλά και την ψυχιατρική πραγματογνωμοσύνη που είχε διενεργηθεί και κατέληξε στο συμπέρασμα ότι κατ’ αρχάς, ο συμβολαιογράφος δεν είναι ο πλέον αρμόδιος να διαπιστώσει την ψυχική και διανοητική υγεία του διαθέτη. Ακολούθως, το δικαστήριο έκρινε ότι ο διαθέτης κατά τον χρόνο που είχε συνταχθεί η διαθήκη δεν είχε την ικανότητα να συντάξει διαθήκη και ότι, κατά συνέπεια, η διαθήκη ήταν άκυρη. Αυτό βασίσθηκε σε σειρά ιατρικών βεβαιώσεων, γνωματεύσεων, σε ψυχιατρική πραγματογνωμοσύνη, σε μάρτυρες και σε άλλα αποδεικτικά στοιχεία, σύμφωνα με τα οποία ο θανών έπασχε για αρκετά έτη από ανίατη ασθένεια και ελάμβανε φαρμακευτική αγωγή, που τον επηρέαζε σωματικά και ψυχικά. Ειδικώς, το δικαστήριο κατέληξε στο συμπέρασμα ότι ο κληρονομούμενος «κατά το χρόνο σύνταξης της διαθήκης στις 7-3-2016, δεν είχε την ικανότητα να εκφράσει προφορικά διάταξη τελευταίας βούλησης και δη με το ανωτέρω συγκεκριμένο περιεχόμενο, με λόγο δομημένο και άρτιο, προβαίνοντας μάλιστα σε χρήση και τοπογραφικού διαγράμματος, καθώς δεν είχε την απαιτούμενη προς τούτο γλωσσική και εκφραστική ικανότητα, κρίση και αντίληψη, ευρισκόμενος σε ψυχική και διανοητική διαταραχή τέτοια, που δεν μπορούσε να θυμηθεί ούτε την ακριβή διεύθυνση της κατοικίας του, ούτε τον αριθμό του δελτίου της αστυνομικής του ταυτότητας». Διαπίστωσε δηλαδή το δικαστήριο σημαντική έκπτωση των νοητικών λειτουργιών του κληρονομουμένου και ψυχική διαταραχή αυτού, ως αποτέλεσμα της μακροχρόνιας ασθένειάς του και της φαρμακευτικής αγωγής που ελάμβανε που αφορούσε όχι μόνο αυτή καθ’ εαυτή την ασθένεια, αλλά και την ψυχική του ισορροπία.
Η αγωγή συνεπώς των παιδιών του θανόντος έγινε δεκτή από το δικαστήριο και η διαθήκη ακυρώθηκε.

Γράψτε Σωστά Το Όνομά Σας Στα Πιστοποιητικά

Πολλοί Έλληνες ομογενείς που θέλουν να πάρουν ελληνική ιθαγένεια και διαβατήριο ή έχουν κληρονομικά στην Ελλάδα, ταλαιπωρούνται διότι δεν είναι γραμμένα τα ονόματα της οικογένειάς τους στα πιστοποιητικά στο εξωτερικό και στην Ελλάδα με τον ίδιο τρόπο. Είναι γνωστό ότι οι Έλληνες που φύγανε στο εξωτερικό πριν από πολλές δεκαετίες, είδαν το όνομά τους να γράφεται από τις αρχές των χωρών του εξωτερικού όπου μετανάστευσαν, με διαφορετικό τρόπο από αυτόν με τον οποίο είναι γραμμένα στην Ελλάδα, στο Δημοτολόγιο, στο Μητρώο Αρρένων, αλλά και σε ληξιαρχικές πράξεις γεννήσεως.
Επί παραδείγματι, η Ευαγγελία που έφυγε από την Ελλάδα, παντρεύτηκε στην Αυστραλία με το όνομα Angel ή Lia ή Eva και όταν το παιδί της, που γεννήθηκε στην Αυστραλία, θέλει να πάρει ελληνικό διαβατήριο μετά από πολλά χρόνια, συναντάει προβλήματα, διότι στο Προξενείο ή στην ελληνική διοίκηση του λένε ότι η μητέρα του, που στον αυστραλιανό γάμο της και στην γέννησή του λέγεται Λία, δεν είναι η ίδια γυναίκα που είχε γεννηθεί στην Ελλάδα ως Ευαγγελία.
Ο Απόστολος που γεννήθηκε στην Ελλάδα, παντρεύτηκε στην Αμερική ως Tolis, ο Ευστράτιος έκανε παιδιά στον Καναδά ως Steven. Αλλά και με τα επώνυμα, οι αλλαγές που έχουν γίνει στο εξωτερικό είναι μεγάλες και συχνά αποτελούν εμπόδιο στο να αποκτήσουν τα παιδιά και τα εγγόνια την ελληνική ιθαγένεια, διότι η αυστηρή και γραφειοκρατική ελληνική διοίκηση αμφισβητεί ότι ο παππούς τους είναι αυτός που είχε γεννηθεί στην Ελλάδα και όχι κάποιος άλλος. Αμφισβητεί δηλαδή ότι ο Θωμόπουλος που γεννήθηκε στην Ελλάδα είναι το ίδιο πρόσωπο με τον Thomson, που έκανε παιδιά και εγγόνια στην Αυστραλία. Δεν δέχεται η ελληνική διοίκηση ότι ο Δημόπουλος είναι το ίδιο πρόσωπο με τον Demos και πολλές άλλες παρόμοιες αδικίες.
Μέχρι πριν λίγα χρόνια το ελληνικό κράτος δεχόταν την ένορκη βεβαίωση συγγενών ή φίλων που υπέγραφαν ότι το ελληνικό και το αγγλικό όνομα ανήκει στο ίδιο και το αυτό πρόσωπο, ότι δηλαδή ο Γεωργόπουλος και ο Georges ήταν το ίδιο και το αυτό πρόσωπο. Εσχάτως, ωστόσο, το ελληνικό κράτος δείχνει το αυστηρό πρόσωπό του στους χιλιάδες ομογενείς που θέλουν να ενισχύσουν τους δεσμούς τους με την Πατρίδα, να πραγματοποιήσουν επενδύσεις, να αγοράσουν σπίτια, ακόμα και να εγκατασταθούν στην Ελλάδα. Στερεί ουσιαστικώς την ελληνική ιθαγένεια για επουσιώδεις συνήθως αλλαγές ονομάτων που έχουν συμβεί στην διαδρομή δεκαετιών, στο εξωτερικό, υπό συνθήκες δύσκολες για τους ομογενείς, που και μόνο ότι βρίσκουν πιστοποιητικά γάμου και γεννήσεως του παππού και της γιαγιάς, των γονέων τους κλπ. που συνάδουν με τα ελληνικά στοιχεία, αποτελεί συχνά άθλο.
Για να αποφύγουν τουλάχιστον από σήμερα και στο μέλλον οι ομογενείς παρόμοια προβλήματα για τους ίδιους αλλά και για τα παιδιά και τα εγγόνια τους, που τώρα ή στο μέλλον θα αναζητήσουν το ελληνικό διαβατήριο, καλό είναι όταν σήμερα παντρεύονται ή γεννούν παιδιά στο εξωτερικό, να φροντίζουν ώστε στο πιστοποιητικό γάμου ή γεννήσεως τα ονόματα όλης της οικογένειας να γράφονται από τις αρχές του εξωτερικού με τρόπο που να είναι όσο το δυνατόν πιο ταυτόσημος με τον τρόπο γραφής του ονόματος στην Ελλάδα. Ο Κωνσταντίνος στην πράξη γεννήσεως του παιδιού του να γράψει ως όνομα πατρός Constantinos και όχι Costa ή Gus. Η Ουρανία να γράψει το όνομά της στο εξωτερικό ως Ourania και όχι ως Rania. Αν έχει γίνει αλλαγή ονόματος στο εξωτερικό ή αν επιθυμεί ο Έλληνας που μετανάστευσε να έχει αλλαγμένο όνομα στο εξωτερικό, επειδή εκεί τώρα όλοι τον γνωρίζουν ως Steven και όχι ως Σταύρο, που είναι στην Ελλάδα, πρέπει τότε να αποκτήσουν έγγραφα από το εξωτερικό από δικαστήριο ή άλλη επίσημη αρχή, που να καταγράφουν με σαφή τρόπο ότι ο Σταύρος Αγγελόπουλος άλλαξε το όνομά του σε Steven Angelos ή ότι πρόκειται για το ίδιο πρόσωπο.
Πολύ σημαντικό είναι επίσης, οι ομογενείς να κρατάνε το έστω και ληγμένο ελληνικό διαβατήριό τους και την παλιά ελληνική ταυτότητα, που έχουν φωτογραφία και αναγράφουν το ελληνικό τους όνομα, ώστε να μπορούν αυτά να συγκριθούν με τα ξένα διαβατήρια και άλλες ταυτότητες, ακόμα και άδειες οδηγήσεως, που έχουν επίσης φωτογραφία και το όνομά τους όπως είναι στο εξωτερικό. Με τον τρόπο αυτόν, δηλαδή με την αντιπαραβολή ταυτοτήτων και διαβατηρίων που έχουν φωτογραφία του προσώπου, με τις δύο διαφορετικές εκδοχές του ονόματός του, πείθονται οι ελληνικές αρχές ότι το ξένο και το ελληνικό όνομα ανήκουν ή ανήκαν στο ίδιο πρόσωπο και προχωράει μετά η διαδικασία του ελληνικού διαβατηρίου ή της κληρονομιάς στην Ελλάδα.

Αποποίηση Κληρονομίας Από Ανήλικο

Η κληρονομία, δηλαδή το σύνολο δικαιωμάτων και υποχρεώσεων ενός προσώπου που απεβίωσε, μεταβιβάζεται διά της κληρονομικής διαδοχής στους κληρονόμους του, είτε εξ αδιαθέτου, δηλαδή χωρίς διαθήκη, είτε εκ διαθήκης. Συνήθως η κληρονομία έχει θετικό περιεχόμενο, δηλαδή οι κληρονόμοι αποκτούν ακίνητα, τραπεζικούς λογαριασμούς, κινητά πράγματα κλπ. που ανήκαν στον κληρονομούμενο. Ενίοτε, ωστόσο, η κληρονομία δεν έχει θετικό περιεχόμενο, αλλά μόνο βάρη, δηλαδή οφειλές, χρέη και υποχρεώσεις προς τρίτους. Σε μία τέτοια περίπτωση όσοι κληρονομούν επιθυμούν να αποφύγουν να λάβουν την κληρονομιά και για τον λόγο αυτόν προβαίνουν σε αποποίηση της κληρονομίας.
Η βασική προθεσμία εντός της οποίας μπορεί να γίνει η αποποίηση είναι τέσσερις μήνες από τον θάνατο του κληρονομουμένου. Αν ο κληρονομούμενος απεβίωσε στο εξωτερικό ή ο κληρονόμος ζει στο εξωτερικό, η προθεσμία είναι δώδεκα μήνες. Αν έχει δημοσιευθεί διαθήκη, τότε η προθεσμία των τεσσάρων ή δώδεκα μηνών αρχίζει από την δημοσίευση της διαθήκης.
Εάν ο κληρονόμος που θέλει να αποποιηθεί είναι ενήλικος, το πράττει με υπογραφή σχετικού εγγράφου στο Ειρηνοδικείο όπου είχε ο κληρονομούμενος την κατοικία του κι αν δεν είχε κατοικία στην Ελλάδα, στο Ειρηνοδικείο Αθηνών. Αν όμως το πρόσωπο που πρέπει να αποποιηθεί είναι ανήλικος, τότε δεν αρκεί μία απλή δήλωση αποποίησης από τους γονείς του. Ο νόμος απαιτεί να υποβληθεί πρώτα αίτηση στο Ειρηνοδικείο, να ακολουθήσει μία σύντομη δίκη στο πλαίσιο της λεγόμενης εκούσιας δικαιοδοσίας και μόνον εφόσον εκδοθεί δικαστική απόφαση που να δέχεται την αίτηση θα επιτραπεί να γίνει η αποποίηση για λογαριασμό του ανηλίκου. Ο δικαιολογητικός λόγος της απαίτησης δικαστικής απόφασης για την αποποίηση ανηλίκου είναι ότι για ένα ευάλωτο κατά τεκμήριο πρόσωπο, όπως είναι το ανήλικο, ο νόμος δεν αρκείται στο ότι την αποποίηση μπορούν να την αποφασίσουν για το συμφέρον του παιδιού τους οι γονείς του. Η νομοθεσία απαιτεί μία πρόσθετη ασφαλιστική δικλείδα για την προστασία των συμφερόντων του ανηλίκου, που είναι η κρίση του δικαστηρίου, για να αποφασισθεί ότι πράγματι είναι προς το συμφέρον του ανηλίκου να αποποιηθεί της συγκεκριμένης κληρονομίας, πέραν του γεγονότος ότι κατά το νόμο, το ανήλικο κληρονομεί πάντοτε ούτως ή άλλως με το ευεργέτημα της απογραφής, δηλαδή δεν θα κληθεί ποτέ να πληρώσει από την τσέπη του για χρέη της κληρονομιάς.
Στην υπ’ αριθ. 1720/2021 απόφασή του το Ειρηνοδικείο Αθηνών έκρινε παρόμοια υπόθεση, στην οποία κληρονομούμενος ήταν ο παππούς, ο οποίος άφησε κληρονομία που εμφάνιζε αυξημένο παθητικό και στερείτο ενεργητικού, κατά τους ισχυρισμούς της αιτήσεως που κατέθεσαν στο δικαστήριο οι γονείς της εγγονής του θανόντος παππού. Ο πατέρας της ανήλικης, υιός του θανόντος παππού, αποποιήθηκε της κληρονομίας, ενώ το ίδιο έπραξε και ο αδελφός του. Μετά την αποποίηση του τέκνου του θανόντος, κληρονόμος καθίσταται το τέκνο του τέκνου, δηλαδή το εγγόνι, το οποίο αν είναι ανήλικο δεν μπορεί να αποποιηθεί μόνο του, αλλά χρειάζεται η απόφαση του δικαστηρίου. Μετά από την διαδικασία των αποδείξεων στο δικαστήριο, προέκυψε, κατά την κρίση του Ειρηνοδικείου, ότι πράγματι η κληρονομία στερείτο ενεργητικού και για τον λόγο αυτόν το δικαστήριο εδέχθη την αίτηση και εξέδωσε απόφαση παρέχοντας άδεια στους αιτούντες, υπό την ιδιότητά τους ως ασκούντων από κοινού την γονική μέριμνα της ανήλικης θυγατέρας τους, να αποποιηθούν εκείνοι την επαχθείσα στο ανήλικο τέκνο τους κληρονομία. Με τον τρόπο αυτόν ένα ανήλικο παιδί αποφεύγει να λάβει μία κληρονομία η οποία έχει παθητικό και όχι ενεργητικό.

Opening Or Updating A Bank Account In Greece

Banks in Greece the last few years have been applying considerably more strict rules with regard to keeping updated and accurate records of the identity and of the personal data of their clients. The financial institutions feel the pressure of the regulating authorities (the Bank of Greece, Ministry of Finance, the institutions of the European Union.), to clean up their act not only regarding the thousands of “red” loans which are not being serviced, but also with regard to more transparency in banking transactions.
As a result, opening a bank account in Greece requires the proper identification of the client and meticulous recording of his/her personal data, meaning address, phone number, profession, tax status etc. If the person who wants to open a new account or update an existing one is a foreign resident, the bank will request a number of supporting documents as evidence of the personal data of the client.
These documents are the Greek id card or Greek or foreign passport of the client, a copy of the client’s recent telephone bill to confirm his/her address and telephone number, a copy of a recent electricity bill to double check the client’s address, and a copy of the last tax assessment or tax records from the country where the client is a permanent tax resident. The bank in Greece is not interested in the income of the foreign resident, but wants to be certain about the fact that this person is a foreign tax resident and of which country in particular. Another document the bank wants for the opening or for the update of a bank account is proof of the client’s profession. This is provided either with a letter from the company or agency where the client works, stating that this person works for this company or authority, or a copy of the client’s professional identity card or proof of membership to any professional chamber. If the client is retired, proof of profession many not be needed.
The client must file the above documents in person at the bank in Greece. The bank will take a sample of the new client’s signature, if the matter at hand is the opening of a new account. If the issue is the update or re-activation of a previously existing account, the bank will require all the above documents filed in person by the client, in order to obtain fresh and accurate information about the client’s profile, in case the bank wants to audit anything regarding this client’s banking activity.
Alternatively, the opening or update of an account can be done with a power of attorney (POA), which the client signs at the Greek Consulate at the country of his residence or at a notary public with either the Apostille stamp or certification by the Greek Consulate (if the country of his residence has not ratified the Hague Convention for the Apostille). The text of the POA must be very detailed and accurate and for this reason it must be prepared by an attorney in Greece, who will have first discussed in detail with the client and then will have agreed with the bank regarding the bank’s demands. The opening of the bank account will, however, require, even at a later point, the physical presence of the client in Greece, to give the sample of his signature, while the update of the account can be done exclusively with the POA.
Finally, if the new client of the bank is to wire significant funds to Greece from abroad, the Greek bank will require written evidence from the foreign banks showing that these funds have either been acquired recently by the disposition of an asset of the client, or that the funds had been in the client’s foreign bank account for a minimum period of time.

Zero Transfer Tax For Parental Gifts In Greece

From 1st October 2021 a major tax break has been introduced by the Greek government. Parents who wish to transfer to their children any type of asset, including real estate, cash, company stakes, will not pay transfer tax for gifting property worth up to 800,000 euros. The tax – free parental gift of 800,000 euros applies to each parent gifting property to each child. In other words, the two parents can gift property to their two children worth up to 3.2 million euros (800,000 X 4) without any transfer tax, since each parent can gift to two children property worth up to 1.6 million euros tax - free. The same applies vice versa, for gifts from children to parents, although such transfer is rare.
Given the value of properties held by the average Greek household, which is less than 800,000 euros, the new tax - free amounts will cover virtually every family in Greece. The previous tax - free amount was 150,000 euros, which makes the new tax - free limit of 800,000 euros look like an extraordinary measure.
Up to now, the tax – free limit for the parental gift was the same as the tax – free limit for acceptance of estate (inheritance). In both cases, the amount was 150,000 euros. From 1st October 2021, the tax – free limit for the parental gift is skyrocketing to 800,000 euros, while the tax – free limit for the inheritance remains at 150,000 euros. This suggests that the usual question for a parent, whether it is better to give assets to the children now with a parental gift, or leave them for after the passing of the parents, the answer is that, tax wise it is preferable to gift assets to the children now, since the tax – free limit is very high (800,000 euros), compared to the 150,000 tax – free for the estates.
The tax – free limit applies also to free gift transfers from children to parents. Therefore, with the new law, after 1st October 2021, even siblings can transfer between themselves assets or cash, up to 800,000 euros, without paying any transfer tax. This can be achieved if the child gifts first to the parent the asset or the cash and subsequently the parent can further gift it to the other child.
Even grandparents can transfer assets or cash to grandchildren, without paying any transfer tax up to the amount of 800,000 euros.
With regards to cash transfers, however, there is a catch. Any free gift from parent to child or from child to parent or between grandparent and grandchild, must be executed through the bank. Consequently, the amount which will be gifted must exist in the bank account of the person who makes the gift and must be transferred through a bank transaction to the account of the person who receives the cash gift. Moreover, the additional precondition is that the person who makes the cash gift must have declared the amount as income during the last several years. The higher the amount to be gifted, the more likely the Greek tax authority to enquire whether the person who makes the gift has sufficient income tax filings the last many years, in order to justify the acquisition of such funds. Another way to justify the source of the funds to be gifted, is the sale of assets the previous years by the person who makes the free gift.
The free gifting of real estate assets in Greece is done through a deed of free gift, called “goniki parochi”, drafted usually by lawyers and executed before a notary. The deed subsequently must be registered at the local land registry, which will make the deed valid before any third party. If the free gist involves cash / funds at the bank, the two parties sign and file tax declarations to the tax office.
