Τράπεζα Συμψηφίζει Κοινό Λογαριασμό

Ο κοινός τραπεζικός λογαριασμός συχνά δημιουργεί αντιδικίες, είτε μεταξύ των συνδικαιούχων του κοινού λογαριασμού, είτε μεταξύ ενός εξ’ αυτών και της ίδιας της τράπεζας στην οποία τηρείται. Πολλές φορές έχουν φθάσει στα δικαστήρια υποθέσεις διαφωνίας μεταξύ συνδικαιούχων κοινού λογαριασμού, που ενώ αρχικώς είχαν αρμονικές σχέσεις π.χ. ως συναίτεροι ή ως σύζυγοι, αργότερα οι σχέσεις τους διερράγησαν και διαφώνησαν ως προς την κυριότητα των χρημάτων του κοινού λογαριασμού.
Άλλες φορές η διαφωνία υπάρχει μεταξύ συνδικαιούχου κοινού λογαριασμού και κληρονόμων ενός ετέρου συνδικαιούχου που απεβίωσε, αναφορικώς με το γνωστό ζήτημα αν το υπόλοιπο της καταθέσεως του κοινού λογαριασμού κληρονομείται από τους κληροόνομους ενός από τους συγκυρίους του λογαριασμού, ή αν τα χρήματα μένουν στην διάθεση και στην κυριότητα ουσιαστικώς των υπολοίπων συγκυρίων του λογαρισμού, έστω κι αν αυτοί δεν είναι κλρονόμοι. Η λύση που δίδεται κατά τα δεδομένα που συνήιως ισχύουν στην περίπτωση αυτή είναι ότι το υπόλοιπο της καταθέσεως του κοινού λογαριασμού ανήκει στους επιζώντες συγκυρίους του λογαριασμού και όχι στους κληρονόμους του θανόντος συγκυρίου του λογαριασμού.
Ένα άλλο όμως, ενδιαφέρον επίσης, ζήτημα δημιουργήθηκε όταν τράπεζα συμψήφισε αξιώσεις της κατά του ενός εκ των δύο συγκυρίων κοινού τραπεζικού λογαριασμού. Δύο σύζυγοι είχαν κοινό λογαριασμό σε μία τράπεζα. Ο σύζυγος είχε παραλλήλως συνάψει με την ίδια τράπεζα και συμβάσεις αλληλόχρεου λογαριασμού, δηλαδή ουσιαστικώς δανειζόταν χρήματα από την τράπεζα κατά διαστήματα και τα επέστρεψε τμηματικώς (αλληλόχρεος λογαριασμός). Τα ποσά που αναφέρονται εδώ είναι υποθετικά και όχι αληθινά, η υπόθεση είναι όμως πραγματική, επί της οποίας εκδόθηκε η υπ’ αριθ. 140/2021 απόφαση του Μονομελούς Εφετείου Πατρών. Ας υποθέσουμε ότι το υπόλοιπο της κοινής καταθέσεως των δύο συζύγων ήταν 100.000 ευρώ. Ο ένας εν των συζύγων, δηλαδή ο σύζυγος χρωτούσε στην τράπεζα από τους αλληλόχρεους λογαριασμούς των ποσό των 90.000 ευρώ. Η τράπεζα κάποια στιγμή έκλεισε τους αλληλόχρεους λογαριασμούς του συζύγου, απαίτησε το υπόλοιπο που της οφειλόταν δηλαδή ποσό 90.000 ευρώ και εν συνεχεία προέβη σε συμψηφισμό από τον κοινό τραπεζικό λογαριασμό που ο οφειλέτης είχε με την σύζυγό του στην ίδια τράπεζα, του ποσού των 90.000 ευρώ, ουσιαστικώς αφήνονντας υπόλοιπο στο κοινό λογιαρμό μόνο 10.000 ευρώ από τα 100.000 ευρώ που είχε ο λογαριασμός.
Η σύζυγος διαμαρτυρήθηκε ότι η τράπεζα παραβίασε τα δικαιώματά της, επικαλούμενη κυρίως διατάξεις νόμου που ορίζουν ότι σε περίπτωση κατασχέσεως εις βάρος δικαιούχου κοινού λογαριασμού, η κατάσχεση μπορεί να γίνει μόνο στο μερίδιο που θεωρητικώς ανήκει στον κοινό συνδικαιούχο και όχι σε μεγαλύτερο μερίδιο. Υποστήριξε δηλαδή ότι στην περίπτωση αυτή, που υπήρχαν δύο συνδικαιούχοι, η τράπεζα θα έπρεπε να κατάσχει μόνο ποσό 50.000 ευρώ από τον κοινό τραπεζικό λογαριασμό που είχε 100.000 ευρώ και ανήκε σε δύο συνδικαιούχους ισομερώς.
Πράγματι, ο νόμος γενικώς προβλέπει ότι εάν υπάρχουν επί παραδείγματι τρεις συνδικαιούχοι ενός κοινού τραπεζικού λογαριασμού, που έχει υπόλοιπο 120.000 ευρώ και γίνει κατάσχεση από τρίτον εις χείρας της τραπέζης, η κατάσχεση μπορεί να γίνει μόνο μέχρι του ίσου μεριδίου του ενός εκ των τριών, δηλαδή μόνο για ποσό 40.000 ευρώ, δηλαδή 120.000 διά τρία. Ετσι, η σύζυγος υποστήριξε ότι η τράπεζα θα μπορούσε να «κατάσχει» μόνο έως και το μισό της κοινής κατάθεσης με τον σύζυγό της, δηλαδή μόνο τις 50.000 από το σύνολο των 100.000 ευρώ.
Ωστόσο, τόσο το Πρωτοδικείο, όσο και το Εφετείο έκριναν ότι η σύζυγος δεν είχε δίκιο, διότι, εντελώς περιληπτικώς, δεν επρόκειτο περί κατασχέσεως του κοινού λογαριασμού, αλλά περί συμψηφισμού, που είχε δικαίωμα η τράπεζα να κάνει βάσει των συμβάσεων αλληλόχρεου λογαριασμού. Επιομένως, όταν πρόκειται για συμψηφισμό στον οποίο προβαίνει η τράπεζα για αξίωσή της επί κοινού τραπεζικού λογαρισμού, δεν περιορίζεται μόνο στο μισό της κοινής καταθέσεως, εφόσον οι συγκύριοι του λογαριασμού είναι δύο, αλλά μπορεί να συμψφίσει το σύνολο της απαιτήσεώς της, δηλαδή και πάνω από το μισό, όπως συνέβη και στην συγκεκριμένη υπόθεση, όπου συμψήφισε και πήρε από τον κοινό τραπεζικό λογαριασμό τις 90.000 ευρώ από το σύνολο των 100.000 ευρώ, διότι τόση ήταν (90.000 ευρώ) η αξίωσή της κατά του ενός εκ των δύο συζύγων – συνδικαιούχων του κοινού λογαριασμού. Άλλο δηλαδή κατάσχεση του κοινού λογαριασμού από κάποιον τρίτο, δανειστή ενός εκ των συγκυρίων του λογαριασμού και άλλο συμψηφισμός απαίτησης της τράπεζας έναντι ενός εκ των συγκυρίων του λογαριασμού.

Ακύρωση Δημόσιας Διαθήκης Στην Ελλάδα

Η διαθήκη στην Ελλάδα που έχει δημοσιευθεί από δικαστήριο, ισχύει κανονικά, μέχρι την τυχόν ακύρωσή της από δικαστήριο τελεσιδίκως. Η διαθήκη είτε είναι δημόσια, είτε μυστική, είτε ιδιόγραφη, έχει την ίδια νομική ισχύ. Αναμφισβήτητο είναι ωστόσο ότι πιο δύσκολα ακυρώνεται δημόσια διαθήκη, η οποία έχει συνταχθεί και υπογραφεί ενώπιον συμβολαιογράφου και μαρτύρων.
Η δημόσια διαθήκη συντάσσεται με δήλωση από τον διαθέτη της τελευταίας του βούλησης ενώπιον συμβολαιογράφου, ενώ είναι παρόντες τρεις μάρτυρες ή δεύτερος συμβολαιογράφος και ένας μάρτυρας. Ο διαθέτης, δηλαδή εκείνος που δηλώνει τι επιθυμεί να γίνει με την περιουσία του μετά τον θάνατό του, δηλώνει προφορικώς την τελευταία του βούληση ενώπιον του συμβολαιογράφου και των τριών μαρτύρων ή των δύο συμβολαιογράφων και του ενός μάρτυρα. Τα πρόσωπα αυτά συμπράττουν και πρέπει να είναι παρόντα σε όλη τη διάρκεια της πράξης της συντάξεως της δημόσιας διαθήκης. Απαγορεύεται κατά τη σύνταξη της διαθήκης η παρουσία οιουδήποτε άλλου, εκτός από τον διαθέτη και τα συμπράττοντα πρόσωπα. Το κείμενο της διαθήκης πρέπει να διαβασθεί στον διαθέτη, ώστε όλοι, δηλ. συμβολαιογράφος και μάρτυρες να είναι βέβαιοι ότι ο διαθέτης κατάλαβε το περιεχόμενο του κειμένου που συντάσσεται για να ισχύσει ως διαθήκη και ότι αυτό είναι που πράγματι θέλει να υπογράψει ως διαθήκη του.
Στην υπόθεση που περιγράφεται στην υπ’ αριθ. 86/2021 απόφαση του Τριμελούς Εφετείου Πατρών, ο διαθέτης απεβίωσε το έτος 2016, αφήνοντας ως πλησιέστερους συγγενείς του την δεύτερη σύζυγό του και τα παιδιά του από τον πρώτο γάμο του. Μετά τον θάνατο του διαθέτη, η δεύτερη σύζυγός του επιμελήθηκε ώστε να δημοσιευθεί και να ισχύσει ως διαθήκη μία δημόσια διαθήκη που είχε υπογράψει ο σύζυγός της λίγο πριν αποβιώσει το 2016. Με βάση αυτή την δημόσια διαθήκη, μοναδικός κληρονόμος εμφανιζόταν να είναι σε ολόκληρη την περιουσία του διαθέτη, η δεύτερη σύζυγός του. Στην διαθήκη υπήρχε και η αναφορά του διαθέτη ότι στα παιδιά του από τον πρώτο γάμο του άφηνε όσα τους είχε δώσει εν ζωή, χωρίς δηλαδή να τους αφήνει κάτι από την περιουσία του μετά θάνατον.
Τα παιδιά από τον πρώτο γάμο του διαθέτη, ως έχοντες έννομο συμφέρον, προσέβαλαν την διαθήκη στο δικαστήριο ως άκυρη, παρουσιάζοντας όχι μόνο μάρτυρες, αλλά και σειρά αποδεικτικών στοιχείων που οδήγησαν το Πρωτοδικείο, αλλά και το Εφετείο Πατρών στην κρίση ότι η διαθήκη δεν είχε συνταχθεί παρουσία του διαθέτη, αλλά και ούτε ενός τουλάχιστον από τους μάρτυρες που αναφερόταν στην διαθήκη ότι ήταν παρόντες κατά την σύνταξή της.
Συγκεκριμένα, τα παιδιά του κληρονομουμένου προσκόμισαν στο δικαστήριο αρκετά έγγραφα, πολλά από τα οποία δημόσια, που αποδείκνυαν ότι ο πατέρας τους την ημέρα κατά την οποία φερόταν να έχει παραστεί στην σύνταξη της διαθήκης, αυτός νοσηλευόταν στο Γενικό Πανεπιστημιακό Νοσοκομείο Πατρών και υπεβάλετο σε συγκεκριμένες ιατρικές εξετάσεις. Από το σύνολο των αποδεικτικών στοιχείων το δικαστήριο σχημάτισε την κρίση ότι κατά την ημερομηνία, που φέρεται να συντάχθηκε η επίδικη διαθήκη, ο κληρονομούμενος δεν βρισκόταν στο γραφείο του συμβολαιογράφου και ως εκ τούτου ψευδώς βεβαιώνεται τούτο από τον άνω συμβολαιογράφο.
Επίσης, ο συμβολαιογράφος βεβαίωσε ως αριθμό ταυτότητας του κληρονομουμένου τον αριθμό της προηγούμενης ταυτότητάς του, ενώ αν είχε πράγματι παραστεί στον συμβολαιογράφο ο διαθέτης, θα είχε καταχωρηθεί η ισχύουσα ταυτότητα του διαθέτη και όχι η προηγούμενη που είχε ήδη αντικατασταθεί. Είναι χαρακτηριστικό ότι το δικαστήριο έκρινε ότι δεν ήταν αναγκαίο να διατάξει πραγματογνωμοσύνη, για να διαπιστώσει την πλαστότητα της υπογραφής του διαθέτη στην φερόμενη διαθήκη, αφού ήδη είχε σχηματίσει δικανική πεποίθηση από τα ενώπιόν του αποδεικτικά στοιχεία και από την πλήρη απόδειξη ότι κατά την σύνταξη της διαθήκης δεν ήταν παρών ούτε ο διαθέτης, ούτε ένας εκ των μαρτύρων και τα πραγματικά αυτά περιστατικά αρκούσαν για την ακύρωση της διαθήκης.
Για τους λόγους αυτούς το Εφετείο επεκύρωσε την απόφαση του Πρωτοδικείου, ότι δηλαδή η φερόμενη ως δημόσια διαθήκη δεν ήταν έγκυρη, αφού δεν είχε παραστεί κατά την σύνταξή της ο διαθέτης και ένας εκ των τριών μαρτύρων, σε αντίθεση με όσα αναφέρει η διαθήκη. Αποτέλεσμα ήταν να ακυρωθεί η διαθήκη.

Thousands of people of Greek background around the world wish to obtain the Greek passport. Is that good or bad? One would think that for a country like Greece, with a declining birth rate and with its need for foreign investment and support to its foreign policy issues, the desire from thousands of descendants of Greek – born ancestors, to obtain the Greek citizenship would be considered a very positive development.
Not quite. It is true that Greece is not a very wealthy country, which means that it can’t support huge numbers of civil servants working in the Greek Consulates around the world. However, Greece is a developed country, No 32 in the world Human Development Index, and a member of the European Union. Greece also saw millions of its citizens in the last 100 years, immigrating to other countries. Most of them thrived in the countries where they established themselves. Many of their children and grandchildren wish to obtain a Greek passport, and subsequently to be allowed to exercise their rights as Greek citizens, including their right to vote from the place of their residence.
What have the Greek government and the administration been doing for this, throughout the past decades? Almost nothing. Is the Greek administration helping the thousands who want to become Greek citizens, because they are children and grandchildren of Greeks? The answer is disheartening. Bureaucracy, obstacles and negative approach towards the thousands of applications for citizenship, are the words that most characterize the attitude of the Greek state. So many people of Greek origin approach the Greek Consulates in the USA, Canada, Australia, South Africa and many other countries, only to discover that the waiting times and the bureaucratic demands of the law or of the interpretation of the law by the officials, are blocking or significantly delaying their path to Greece through citizenship.
Many of these applicants for the Greek citizenship would invest in Greece, if they got the passport. Some would start businesses, bring money and know-how, help the economy, create families, revive towns and rural areas. They would move to Greece to live a more laid back, quality life as they approach retirement. They would advertise the Greek way of living, the Greek history and culture. They would support the national causes of Greece around the world.
Unfortunately, the real, slowly moving world of the administration of the Hellenic Republic is much different. A minor spelling difference in the name of an ancestor, can kill the application. Excruciating requirements for documents with very specific content can delay the processing of files for citizenship for ages. And now, there is a new requirement from the Greek administration and its interpretation of the law, which strikes another blow to the wave of interest for the Greek passport. A certain type of applications, which for decades were filed in Greece, by a lawyer or other proxy of the applicant, expediting the process, from now on are channelled to the Greek Consulates, which will fail to manage the increased numbers of files within reasonable time.
The Greek administration is denying to the Greek expatriates their right to file a specific type of citizenship application through an attorney in Greece, and directs them to file at the Consulate of Greece. It may, however, take the Consulate up to many weeks to reply to their request for an appointment, let alone when the review of their documents will take place. The on - line appointment system is booked for months, sometimes. The Consulate, despite the efforts of many of its officials, may book them an appointment sometimes in months. The Consulate will review the documents and info presented by the Greek expatriates, but in many cases it will discourage them to move forward, because this can’t be done and the other is missing. There have been, however, several cases where applicants, originally discouraged by the Consulate that they can’t apply for a Greek passport, have found their way through an attorney in Greece to finally obtain, under perfectly legal procedures, the much wanted Greek passport at last.
If those who run the Greek state want to serve their country, they should immediately look into and modify the procedure of filing for the Greek citizenship by those who are entitled to according to the lex sanguinis (law of blood) principle, because they are descendants of Greeks. The processing of citizenship application must be simplified and facilitated. And the thousands who are eager to apply, because they wish to obtain the citizenship of their parents and grandparents, must be allowed to file through a proxy with a power of attorney in Greece. The Idiko Lixiarceeo in Athens must be supported with more personnel to satisfy the increasing needs of the Greek expatriates who want to register foreign acts. The Consulates of Greece around the world must be allocated sufficient resources in order to be able to serve the huge demand for applications and transactions in Greece, because this serves the interest of the Greek people. Because it will be good for the country. Because this may help reverse the shrinking population in Greece. Because Greece owes it to the millions of Greeks, who had to leave their country for a better life with more chances, not offered to them in their patrida at the time.

Τα Αναδρομικά Συνταξιούχων Δηλώνονται Στην Εφορία

Το Φθινόπωρο του 2020 η ελληνική κυβέρνηση συμμορφώθκε με τις αποφάσεις του ανωτάτου διοικητικού δικαστηρίου της Ελλάδος, δηλαδή του Συμβουλίου της Επικρατείας (ΣτΕ) και κατέβαλε στους συνταξιούχους αρκετά από τα οφειλόμενα αναφρομικά από περικοπές συντάξεων. Τους κατέβαλε δηλαδή χρηματικά ποσά από συντάξεις που παρανόμως είχαν περικοπεί τα προηγούμενα χρόνια. Πολλοί είναι οι ομογενείς που ζουν εκτός Ελλάδος, αλλά εισπράττουν σύνταξη στην Πατρίδα. Τα αναδρομικά που εισέπραξαν στο τέλος του 2020 πρέπει να δηλωθούν τώρα ως εισόδημα στα φορολογικά έτη 2015 και 2016. Αυτό θα έχει ως συνέπεια το εισόδημα των ετών εκείνων, που έχει ήδη φορολογηθεί, να αναμορφωθεί, δηλαδή να αυξηθεί, αφού θα προστεθεί ως εισόδημα και το ποσό των αναδρομικών που έχει εισπράξει ο κάθε συνταξιούχος, με αποτέλεσμα να επιβληθεί πρόσθετος φόρος που θα πρέπει να πληρωθεί.
Κατά την ελληνική φορολογική αρχή (ΑΑΔΕ), τα ποσά που καταβλήθηκαν τον Οκτώβριο του 2020 ως αναδρομικά σε συνταξιούχους, ήταν περικοπές συντάξεων του 2015 και 2016 και καταβλήθηκαν στους δικαιούχους χωρίς να φορολογηθούν. Τα ποσά αυτά χαρακτηρίζονται «αναδρομικά κύριας σύνταξης που φορολογούνται στο έτος όπου ανάγονται». Οι συνταξιούχοι που εισέπραξαν τα αναδρομικά το 2020 πρέπει να υποβάλουν, τώρα το 2021, τροποποιητικές δηλώσεις για τα φορολογικά έτη 2015 και 2016 και να επιβληθούν τα αναλογούντα ποσά φόρου εισοδήματος και ειδικής εισφοράς αλληλεγγύης.
Αποτέλεσμα θα είναι τα αναδρομικά ποσά να φορολογηθούν με συντελεστές 22% έως 42% της κλίμακας φόρου. Τα αναδρομικά αυτά είναι πρόσθετο εισόδημα, το οποιό θα προστεθεί στο εισόδημα των συνταξιούχων που είχαν δηλώσει το 2015 και το 2016, πράγμα που μπορεί να έχει ως συνάπεια και την μετάβαση σε υψηλότερη φορολογική κλίμακα για τον συνταξιούχο, ώστε η συνολική φορολόγηση να φθάσει έως και το 55%.
Μπορεί θεωρητικά να είναι σωστό να επιβληθεί πρόσθετος φόρος για πρόσθετη σύνταξη που έλαβε ένας συνταξιούχος. Ωστόσο, είναι δυσάρεστο για τους συναξιούχους να παρουσιάζεται τώρα μία νέα φορολογική υποχρέωσή τους. Ενώ δηλαδή το 2020 δικαιώθηκαν και έλαβαν το πρόσθετο εισόδημα που αδίκως τους είχε περικοπεί, τώρα αναγκάζονται να υποστούν μία επιβάρυνση, αφού όχι μόνο πρέπει να αναθέσουν σε λογιστή την δήλωση των αναδρομικών με τροποποιητικές φορολογικές δηλώσεις παρελθόντων ετών, αλλά και να πληρώσουν πρόσθετο φόρο.

Protection For European Citizens Outside Europe

If you hold a Greek passport, you are considered a European citizen, meaning a citizen of a member state of the European Union (EU). Holding a Greek / European passport entitles you to travel and move from one EU country to another without visa or other requirements, to establish yourself in any EU member state, to work and enjoy the basic benefits of life on that other member state and to avoid any discrimination against you because you are not a national of that member state. So, if you hold a Greek passport, you can travel, move, study, establish yourself, set up business, and provide services in any European country member of the EU, much like USA citizens move from one state to the other within the USA.
Moreover, owning a EU passport can be beneficial in a foreign country, which is outside the European Union (a third country). Every EU citizen is entitled to consular protection for EU citizens abroad. Millions of European Union (EU) citizens travel or live outside the EU in places where their own country does not have an embassy or consulate. During their stay, they might need assistance from consular authorities, for instance if their passport is lost or stolen, if they are victims of an accident or if they find themselves in the middle of a political crisis which requires that they are evacuated. Thus, EU citizens in distress in a non-EU country have the right to enjoy the protection of the other EU countries’ embassies or consulates, if their own country is not represented.
For example, if you hold a Greek (thus EU) passport and you encounter a crisis in a non – EU country, in case there is not a Greek Embassy or representation in that country, you are entitled to protection from the Embassy/Consulate of another EU country, like the Consulate of Germany, France, Spain, Italy etc. in that country.
Other EU countries must provide unrepresented EU citizens with whatever assistance they would provide to their own nationals, such as assistance in cases of death, or serious accident or illness, in case of arrest or detention, if they are victims of a crime, and provide relief and repatriation in case of an emergency. This has actually been implemented in reality. An example one can remember is when Greek military and commercial ships successfully evacuated in the summer of 2014 not only Greek, but also other EU nationals from Libya during the chaos of civil war in that country.
The citizen can be redirected from one embassy to another, as EU countries present in the country can agree locally on who should take care of whom in order to ensure efficient protection for EU citizens. European Union Citizens can get information on assistance available by contacting the EU Delegation in the country in question.
European law guarantees that unrepresented citizens are duly taken into account and fully assisted in crisis situations. In such cases, a clear division of responsibilities and coordination is essential to avoid that EU citizens are neglected. If the assistance provided implies costs or fees, unrepresented EU citizens should not have to pay more than the citizens of the EU country which assists them. Citizens who are not able to pay these costs on the spot will be asked to sign a form by which they undertake to repay those costs to their own authorities.

Ktimatologio , E9 and ENFIA crucial for your property in Greece

What would possibly connect a court claim for a piece of property, with payment of the property tax for it? The answer is Greek law. The Greek administration has invented several ways to force property owners to pay property tax. Some call it extortion. Some others believe it is a reasonable measure to enforce the law. Even several courts in Greece have issued rulings stating that the law which says that if you have not paid your property tax, you can’t protect your property from trespassers at the court, is unconstitutional, because the law can’t deprive a property owner from his inalienable human right to seek court protection for his threatened private property, if the owner has not paid property tax.
The reality is that, as a lawyer, I have to advise a client who wishes to claim a property at the court, that one of the preconditions for our civil lawsuit action to be considered admissible by the court, is to produce written proof that this specific property has been filed at the E9 tax listing of properties and the ENFIA yearly property tax has been paid. This is a secure way to know that the court will accept to review our action. Every property owner in Greece, therefore, must know that listing his/her real estate properties to the E9 tax registry and paying the ENFIA property tax is a requirement for keeping their properties’ status updated. Moreover, property owners can’t sell or transfer the property to anyone, unless they have listed the accurately described real estate to the E9 tax registry and have paid the ENFIA.
This means that house, plot and land owners who own them with titles, deeds and survey maps dated before 2010, may have to retain a civil engineer to measure their properties again today, using a modern GPS – based system, in order to obtain their more accurate measurements, which they have to then update with their E9 tax filing. Because, when they are to sell or transfer them, or even declare them to the modern land registry called Ktimatologio, they have to describe them in a most detailed way, to ensure legal certainty and technical accuracy and to avoid or minimize disputes and court litigation with neighbours or relatives who may claim the same property for themselves.
Only yesterday sources at the Greek government revealed a plan that tax auditors will obtain access to the E9 tax listings of property owners and to their respective Ktimatologio land registry filings. Their aim will be to compare, for any taxpayer in question, the two property filing systems and confirm whether properties listed with the Ktimatologio land registry have also been listed to the E9, so that property taxes are paid correctly. If the auditors discover that a tax payer has omitted or “forgotten” to list in the E9 tax filing one or more properties registered with the Ktimatologio land registry, they will impose retroactive fines and taxes. In addition, any legal change, development, sale or transfer of the property in question will be put on hold, until the property is accurately described in both E9 tax filing and the Ktimatologio land registry.
