File For Greek Citizenship While Your Greek Parent Is Still in Life

Many foreign residents wish to obtain the Greek citizenship and an EU passport, based on the fact that one or both of their parents were born in Greece. Such a case may involve bureaucratic and persistent work, but it is usually straightforward and can lead to the acquisition of the citizenship by the foreign-born person, if the legal conditions are met. For some applicants, though, it is one or more of their grandparents (and not parents) who were born in Greece.
In the case were the citizenship is claimed because of a Greek - born grandparent, apart from other requirements, the Greek administration has recently adopted the view that the child of the grandparent, meaning the parent of the present applicant, must today be in life, in order to be able to apply first for the citizenship. This means that if the applicant is the grandchild of the Greek - born grandparent, the parent of the grandchild, who is the child of the Greek - born grandparent, must first apply and once the parent gets the citizenship, the grandchild can then apply for the citizenship as well.
For decades and until a couple of months ago, the Greek administration dealing with citizenship applications, did not insist in most cases that the "intermediary" Greek (the parent) get the citizenship first, in order the grandchild to obtain it, too. Recently, however, a new law introduced in October 2020 has led the officials of the Greek administration to partially change the process, so that now it has become mandatory that the parent must first apply for and obtain the Greek citizenship, before the child can apply subsequently.
It is obvious, therefore, that in the case where the "original" Greek is the grandparent (the one born in Greece as a Greek citizen), only if his/her child is in life and can first get the citizenship, the adult grandchild can apply for the citizenship, as well. This means that those who wish to obtain a Greek passport, based on the fact that their grandparent was born in Greece, apart from satisfying several other requirements, like finding all the birth and marriage certificates and having all the names without significant spelling changes, one basic requirement is also to be able to have their parent apply for the citizenship, before they can apply themselves.
Those who do not satisfy the above or other conditions, cannot apply for the citizenship under the basic process. They can, however, apply through an alternative process, under article 10 of the Code of Greek Citizenship, provided they speak at least some Greek and know the very basics of Greek history and culture.

Resident of Greece Inherits Foreign Estate

If a resident of Greece or a foreign resident inherits property or any type of assets located in Greece, it is mainly Greek law which will determine the process of the transfer of the assets (movable or immovable) from the deceased to the heir. Only if the deceased was a foreign and not a Greek citizen, it is the law of his citizenship country which will determine who inherits what. But Greek law will still determine the process of the transfer of ownership of the estate located in Greece. If, on the other hand, the estate assets are located outside of Greece, it is usually the foreign law, meaning the law of the country where the assets are located, which is applicable for the legal transfer of the estate assets to the heirs.
When that process is completed, the resident of Greece will receive his/her share from the foreign estate, whether this is movables and cash, or ownership rights on immovable property located in the foreign country. The question which concerns many tax residents of Greece, who inherit foreign assets, is whether they have to declare their inherited share to the Greek tax authority and whether they have to pay to the Greek state inheritance tax.
The basic law governing such a situation is the Code of Inheritance, Donations and Parental Gifts in Greece. From the combined application of mainly articles 3 and 25 we reach the conclusion that a Greek taxpayer (meaning a tax resident of Greece), who inherits a foreign estate, will not have to pay inheritance tax in Greece at all, if the assets which he/she inherits are immovable property located in another country, outside of Greece. This means that if you are a tax resident of Greece and you inherit immovable property, (plots, buildings, apartments, houses etc.) located outside of Greece, you do not have to file an inheritance tax declaration in Greece, because you do not have to pay inheritance tax in Greece for inherited real estate assets abroad. However, you must consult with an accountant / tax advisor in Greece on how you will declare the foreign immovable property you inherited, in your tax filings in Greece.
If, on the other hand, the foreign estate which you inherited consists of movables and particularly cash (money at a foreign bank), a very important distinction must be made whether the deceased was a tax resident of Greece the last ten years before his/her passing or not. If the deceased, who left a balance in bank accounts at a foreign bank, was a foreign tax resident and not a Greek tax resident, for a minimum of ten years or more before his / her passing, the heir who is a Greek tax resident does not have to file an inheritance tax declaration in Greece because the heir does not have to pay inheritance tax, irrespective of the amount the heir received from abroad. When the amount of the inherited share is wired from a foreign bank to the Greek bank account of the Greek tax resident who is the heir, the Greek bank will enquire on the source of the money. The heir, who is a resident of Greece, will give to the bank copies of the basic documents of the foreign estate which prove the value of the estate and the value of the share the heir has received in Greece.
In case, however, the deceased was a tax resident of Greece the last one or more years, before his/her passing, the Greek tax resident who inherits the foreign movable assets must file an inheritance tax declaration to the Greek tax authority and be subject to payment of inheritance tax, depending on the rates and next of kin categories. Simple example: the child or spouse who live in Greece and inherit an amount up to150,000 euros each in a foreign bank by a deceased who was a Greek tax resident, do have to file the inheritance tax declaration, but will not pay inheritance tax, if they do not inherit anything else from that deceased, or if their combined share of Greek and foreign assets is not worth more than 150.000 euros. If the heir is a next of kin of the deceased, but not a child or spouse, the tax – free thresholds are lower than the 150,000 euros. No need to mention that the above is general information. For accurate advice on each separate case, one should consult with a professional, because each case has its own particularities.

Τι Γίνεται Αν Υπάρχουν Περισσότεροι Συγκύριοι;

Πολλές είναι οι περιπτώσεις στις οποίες ένα πράγμα, που συχνά είναι ένα ακίνητο, ανήκει σε περισσότερους από έναν συγκυρίους. Σε αρκετές από αυτές, δημιουργείται διαφωνία μεταξύ των συγκυρίων για το πώς είναι καλύτερα να χρησιμοποιείται το κοινό πράγμα. Χαρακτηριστική είναι η περίπτωση στην οποία ένα διαμέρισμα ή μία μονοκατοικία έχει καταλήξει να ανήκει σε δύο, τρεις ή περισσοτέρους ιδιοκτήτες, συχνά λόγω κληρονομικής διαδοχής. Οι περισσότεροι του ενός συγκύριοι διαφωνούν μεταξύ τους για το ποιός και πώς δικαιούται να χρησιμοποιεί το διαμέρισμα ή την μονοκατοικία, ή για το ποιός θα κατοικήσει σ’ αυτήν συγκεκριμένους μήνες του έτους, όπως π.χ. Ιούλιο και Αύγουστο. Σε άλλες περιπτώσεις, η διαφωνία μπορεί να αφορά το αν το κοινό πράγμα θα χρησιμοποιείται από τους συγκυρίους και με ποιόν τρόπο, ή για το αν θα εκμισθωθεί (νοικιασθεί) σε τρίτον για να αποφέρει εισόδημα στους συγκυρίους.
Εάν υπάρχει διαφωνία, προβάδισμα έχει η λύση που επιλέγει η πλειοψηφία των μεριδίων. Δηλαδή αν ένας συγκύριος έχει το 55% εξ αδιαιρέτου του κοινού πράγματος, ενώ τρεις άλλοι έχουν το υπόλοιπο 45%, την απόφαση λαμβάνει εκείνους που έχει την πλειοψηφία, δηλαδή το 55%. Αν αποφασίσει επί παραδείγματι να κρατήσει ο ίδιος το ακίνητο, η απόφασή του είναι νόμιμη και πρέπει να γίνει αποδεκτή από τους υπολοίπους συγκυρίους που έχουν την μειοψηφία του 45%. Θα υποχρεωθεί βεβαίως ο πλειοψηφών συγκύριος να αποδίδει το 45% ενός μέσου μισθώματος του ακινήτου στους μειοψηφούντες συγκυρίους. Η μειοψηφία μπορεί, ωστόσο, να εναντιωθεί στην απόφαση της πλειοψηφίας για την τακτική χρήση του κοινού πράγματος μόνο εάν η απόφαση της πλειοψηφίας δεν καταλήγει στην πιο πρόσφορη χρήση του κοινού πράγματος ή εάν ζημιώνει το πράγμα ή εάν η μειοψηφία θα επέλεγε μία λύση που θα ικανοποιούσε καλύτερα τα συμφέροντα όλων των συγκυρίων και θα απέφευγε την χειροτέρευση του κοινού.
Ο νόμος για την συγκυριότητα δεν αφορά μόνο σε ακίνητα, αλλά και σε κινητά πράγματα, όπως ένα αυτοκίνητο ταξί, το οποίο μπορεί, ως άδεια ταξί, να ανήκει όχι σε έναν, αλλά σε δύο ιδιοκτήτες. Η περίπτωση περιγράφεται στην υπ’ αριθ. 36/2021 απόφαση του Πολυμελούς Πρωτοδικείου Πατρών. Δύο ιδιοκτήτες απέκτησαν 50/50 μία άδεια ταξί και άρχισαν να την εκμεταλλεύονται σε δύο βάρδιες ημερησίως. Για αρκετά χρόνια η συνεργασία τους ήταν αρμονική. Μετά όμως από ένα μεγάλο χρονικό διάστημα ομαλής συνεργασίας, προέκυψαν σημαντικές διαφωνίες μεταξύ των δύο συγκυρίων του ταξί, τόσο ως προς την καταβολή των κοινών λειτουργικών δαπανών του αυτοκινήτου, όσο και για τον τρόπο διαχειρίσεως του ταξί και της αδείας εκμεταλλεύσεως αυτού, αλλά και για το εάν ο ένας εκ των δύο συγκυρίων μπορούσε ή όχι να προσλάβει άλλον οδηγό που να οδηγεί το ταξί στην δική του βάρδια.
Ο ένας εκ των συνιδιοκτητών του ταξί προσέφυγε στο δικαστήριο και απέδειξε ότι υπήρχε διαφωνία μεταξύ των δύο συνεταίρων, αλλά και ανάγκη να ρυθμισθεί η διαχείριση του κοινού πράγματος (ταξί) από το δικαστήριο, αφού ο δύο συγκύριοι δεν μπορούσαν πλέον να τα βρουν μεταξύ τους. Πρότεινε δε τον τρόπο κοινής λειτουργίας του ταξί που εκείνος θεωρούσε πιο πρόσφορο και επωφελή για αμφοτέρους τους συγκυρίους και για το κοινό τους περιουσιακό αντικείμενο.
Το δικαστήριο έκανε δεκτή την αγωγή του συγκυρίου και όρισε αναλυτικώς τον τρόπο με τον οποίο θα πρέπει από εδώ και στο εξής να γίνεται η κοινή χρήση του αυτοκινήτου, δηλαδή τις βάρδιες, τον τρόπο καταγραφής και καταβολής των δαπανών από την λειτουργία του ταξί και άλλα ζητήματα, απαραίτητα για την συνέχιση της εκμετάλλευσης του κοινού πράγματος από τους συνιδιοκτήτες του. Εδέχθη επίσης ότι είναι δυνατόν και επιτρεπτό οιοσδήποτε των συνιδιοκτητών του ταξί να προσλαμβάνει οδηγό, με τα προσόντα που ορίζει ο νόμος, για να εκτελεί την βάρδια του συγκυρίου που δεν μπορεί ή δεν θέλει να την κάνει ο ίδιος. Το Δικαστήριο, τέλος, όρισε ότι σε περίπτωση που ο έτερος συγκύριος του ταξί δεν συμμορφώνεται με την δικαστική απόφαση, θα πρέπει να καταβάλει χρηματική ποινή ύψους 500 ευρώ και θα μπορεί να του επιβάλλεται και προσωπική κράτηση ενός μηνός, για κάθε παράβαση της απόφασης.

Greek Citizenship, Army And Taxes

I am eligible for the Greek citizenship. I have at least one parent or grandparent born in Greece and I can prove, with an unbroken chain of birth and marriage certificates, that from the original Greek - born person to me, the family names appear in the same spelling or with minor changes. The marriage type is religious in those cases where it is required to be by Greek law and in case I base my citizenship claim on a grandparent born in Greece, my parent is in life to file first for the citizenship, so I can file subsequently.
Alternatively, I am of Greek ancestry, but I do not have an ancestor born in Greece, or one or more of the required certificates is missing, or the name changes are many and I can’t officially justify them. But I am feeling Greek and I even speak the language to some degree. This means that I can apply for and possibly get the citizenship.
However, if I get the Greek citizenship, will I have to serve to the Greek army? The answer is, no, if you were born outside of Greece and you never stayed in Greece more than six months in the same calendar year. Or, if you were born in Greece, but after the age of 11 or a bit later, you left the country and never returned to stay more than six months. The male applicant who is granted the Greek citizenship, is registered in a Greek municipality and obtains a Greek passport, which is at the same time a European one, does not have to serve, in the vast majority of cases. If the applicant was born outside of Greece and has not lived in Greece more than six months within one calendar year, he will not serve to the Greek army, even if he obtains the Greek citizenship. The requirement is until the 31st of December of the year on which he becomes 45 years old, not to reside in Greece more than six months in the same calendar year. During this period, where the restriction applies, he can, however, reside indefinitely and all year long in any other EU country, using his Greek passport, without having to serve to the Greek army.
If the Greek citizen who was born outside of Greece and has the status of foreign resident, wishes to establish himself in Greece before the age of 45, the maximum army service that he will have to do is three months. Even that can be reduced to twenty days, if he is eligible to buy out the rest of the three months’ service. The crucial point is the foreign resident to apply for his three - month long army service while he is still a foreign resident and not after he has resided in Greece more than six months, in which case he has lost his status as a foreign resident and will have to serve approximately twelve months.
OK with the army. But, if I become a Greek citizen, will I have to file tax returns in Greece? Will I have to pay taxes? The answer, again, is negative. The Greek citizenship is not related to filing taxes in Greece. Obtaining the Greek citizenship will not make you file taxes in Greece, if you do not obtain income in Greece. If you earn income in Greece, you will have to file and pay taxes in Greece, even if you are not a Greek citizen. Also, if you own real estate in Greece, you will have to file your property to the tax authority only once and not every year, and pay the yearly property tax, which compared to other countries, is very low.

Greeks living outside of the country often contact attorneys or relatives in Greece to find out the actual, legal and tax status of real estate properties, which they have neglected for years. Foreign residents, of Greek origin or not, carried away by their everyday business and life obligations in a foreign country, quite often abandon real estate properties which they own or can claim in Greece. They may have not visited them for years and they may have not requested from relatives or friends to inspect or check on them, not even every now and then, as they should have done. Such properties may have been purchased by foreign residents a long time ago, they may have been gifted to them by family, or may be assets of an estate in Greece, which the foreign residents had settled years ago, or have not even legally accepted and need to settle now.
After all these years, a notice in Greece for taxes due, a formal letter by other building owners about management expenses, a legal notice by other joint owners of the same real estate property for the development or exploitation of the jointly owned asset, or a civil lawsuit action for division of property, a boundary dispute or an inheritance issue, will “wake up” the interest of the foreign resident about their forgotten property in Greece. This will lead to a phone call or an e-mail to a lawyer or a relative in Greece, in order to touch base with the management of their “abandoned” real estate plot, land, house or apartment.
The foreign residents will usually want to know if and how much they have to pay for back property and other taxes, and to sort out all outstanding matters for the property or properties, so that they start developing or exploiting them, or how they can transfer them to their children, or sell them.
The foreign resident must first send to the attorney in Greece any contract, deed or document related to the property, be that a purchase deed, or a deed of acceptance of estate, or any other transaction contract. If the foreign resident does not have any of the above, he/she will advise the attorney about the location (village, town or city) of the property, and the attorney should be able to make a title search in the area using the owner’s name and data, in order to identify the deeds of ownership of the property at the local land registry. More information will be needed, like whether the foreign resident has a Greek tax number (AFM), username and password for on line access to the tax file, and whether the property has been declared by the owner to the tax office E9 property list and to the Ktimatologio new land registry. Any work which needs to be done in Greece for the property will be executed with a power of attorney or authorization, which the foreign resident will sign at the Greek Consulate or at a notary public with Apostille. The text of such power of attorney will be drafted by the Greek lawyer, once the attorney is briefed on the details of the case.
The legal search in Greece includes whether the property has been declared to the Ktimatologio modern land registry and if not, it will be declared now, as this is still possible in most areas of Greece. In some cases, depending on the time limits on each particular case, a court hearing and decision may be required to retroactively declare the property, to avoid the property being listed in someone else’s name or “expropriation” of the property by the state. A new, modern survey map may have to be drafted by a topographer or civil engineer, if the asset is land, a plot, or a house (but not, if it is an apartment – condominium). If the property is jointly owned with others, they may have to be located so that all joint owners decide on the management of the property.
The attorney in Greece, with the power of attorney / authorization, will be able to check if property taxes are owed, although such tax is usually low, anyway. The property may have never been listed to the E9 tax list, or the owner may have never set up his/her on-line tax page, in which case it will have to be done now and the, usually low, annual property tax called ENFIA will have to be paid for the last five years, in order to bring the property up to date. The deed of ownership will be collected (from the local land registry or from a notary’s office) and the asset will be registered with every authority required by law, so that it is properly recorded in the name of the foreign resident who had “abandoned” it.
It is noteworthy that for inheritances/estates from 2003 and back, zero inheritance tax is owed. However, even if inheritance tax must be paid, because the deceased passed after 1-1-2004, close relatives usually enjoy a 150,000 – euro tax free amount for each child and for the spouse of the deceased, making it less costly to inherit the property. Other outstanding matters may be paying utility bills, and declaring any surface built in breach of the building regulations, which calls for legalization of the structure. The bottom line is that, whatever bureaucratic procedure is required and whatever the cost of bringing the taxes and other dues up to date, in most cases the expenses will be much lower than the market value of the abandoned property. This means that it makes sense for the owner to re-visit the long forgotten Greek property, in order to update its legal and tax status, so that it can be transferred to children, developed or sold.

Οι ομογενείς συχνά επικοινωνούν ή συναντώνται με δικηγόρο στην Ελλάδα για να λάβουν συμβουλή για διάφορα νομικά ζητήματα που τους απασχολούν. Εάν η υπόθεση αφορά στην αποδοχή κληρονομίας με ακίνητα ή κινητά στην Ελλάδα, ή κτήση ελληνικής ιθαγενείας, μία συχνή ερώτηση από τον δικηγόρο είναι το εάν ο γάμος των γονέων τους ήταν πρώτος για τον Έλληνα γονέα τους, ή αν είχε κάποιο προηγούμενο γάμο και διαζύγιο. Ο ομογενής μπορεί να έχει έναν ή δύο γονείς Έλληνες. Το αν ο γάμος τους ήταν πρώτος ή δεύτερος (ή και τρίτος) έχει σημασία για την διαδικασία που πρέπει να ακολουθηθεί στην Ελλάδα για την πρόοδο της υπόθεσης και την επίτευξη του επιθυμητού αποτελέσματος.
Ας πάρουμε το παράδειγμα της κτήσεως ελληνικής ιθαγενείας. Εάν ο ομογενής που θέλει την ιθαγένεια έχει έναν μόνο Έλληνα γονέα, πρέπει να γνωρίζουμε εάν ο γάμος του ή της με τον αλλοδαπό σύζυγο ήταν πρώτος για τον Έλληνα γονέα. Εάν ήταν πρώτος, τότε η υπόθεση μπορεί να προχωρήσει πιο γρήγορα. Θα χρειασθούμε το πιστοποιητικό γεννήσεως του Έλληνα γονέα από την Ελλάδα, τον γάμο του με τον αλλοδαπό σύζυγο (στην Ελλάδα ή στο εξωτερικό, που ήταν πρώτος για τον Έλληνα γονέα) και την γέννηση του παιδιού από το εξωτερικό. Εάν όμως ο γάμος για τον Έλληνα ήταν δεύτερος, τότε θα χρειασθούμε τον πρώτο γάμο του, για να τον εγγράψουμε στο Ειδικό Ληξιαρχείο στην Ελλάδα. Μετά, απαιτείται η δικαστική απόφαση διαζυγίου, η οποία εάν είναι από το εξωτερικό, πρέπει να έχει Αποστίλλη ή επικύρωση από το Προξενείο της Ελλάδος, εάν στην χώρα του εξωτερικού δεν υπάρχει η Αποστίλλη. Ακολούθως, το ελληνικό δικαστήριο χρειάζεται και πιστοποιητικό από το εξωτερικό, ότι η δικαστική απόφαση που έλυσε τον γάμο (απόφαση διαζυγίου) είναι αμετάκλητη, δηλαδή ότι δεν έχει προσβληθεί με έφεση ή ότι τώρα δεν μπορεί να προσβληθεί με κάποιο ένδικο μέσο.
Αυτό που γίνεται τότε είναι ένα δικαστήριο χωρίς αντιδικία (εκούσια δικαιοδοσία) στην Ελλάδα, συνήθως στην Αθήνα, με το οποίο θα αναγνωρισθεί η ισχύς της αλλοδαπής απόφασης διαζυγίου στην Ελλάδα. Μόλις το δικαστήριο στην Ελλάδα εκδώσει την απόφασή του αναγνωρίζοντας την ισχύ της ξένης απόφασης, θα εγγραφεί το διαζύγιο στο Ειδικό Ληξιαρχείο στην Αθήνα και μετά θα εγγραφεί ο δεύτερος γάμος του Έλληνα γονέα που έχει τελεσθεί στο εξωτερικό.
Όταν γίνουν αυτά, θα ανοίξει ο δρόμος για την ελληνική ιθαγένεια του αιτούντος, οπότε θα μπορεί να εγγραφεί και η γέννησή του, αλλά αργότερα και ο δικός του γάμος και η γέννηση των δικών του παιδιών, αν έχει.
Η ίδια διαδικασία για την αναγνώριση του αλλοδαπού διαζυγίου ακολουθείται και στην περίπτωση που γίνεται αποδοχή κληρονομίας για κάποιον κληρονομούμενο που ζούσε εκτός Ελλάδος και άφησε περιουσία στην Ελλάδα. Εάν έχει παιδιά από δεύτερο γάμο ή από πρώτο και από δεύτερο, εάν δεν έχουν καταχωρηθεί στην Ελλάδα οι γάμοι του και το διαζύγιό του, δεν μπορεί να εκδοθεί πιστοποιητικό εγγυτέρων συγγενών, πράγμα που εμποδίζει την κατάθεση Δήλωσης Φόρου Κληρονομίας και ενδεχομένως την Πράξης Αποδοχής Κληρονομίας σε συμβολαιογράφο, εάν δεν υπάρχει διαθήκη.
Είναι αυτονόητο ότι το να ζητάει ο δικηγόρος από τους εντολείς του να βρουν στην χώρα του εξωτερικού τον πρώτο γάμο του γονέα τους και το διαζύγιό του, δεν είναι ούτε το πιο εύκολο πράγμα, ούτε το πιο ευχάριστο. Ωστόσο, εάν ο γονέας είχε πρώτο γάμο, διαζύγιο και δεύτερο ή και τρίτον γάμο στο εξωτερικό, είναι απαραίτητο για την ολοκλήρωση των νομικών διαδικασιών στην Ελλάδα να εγγραφούν όλοι οι γάμοι του εξωτερικού και το διαζύγιο, ώστε η οικογενειακή μερίδα του γονέα να τακτοποιηθεί για να προχωρήσουν μετά ζητήματα όπως η ιθαγένεια και η αποδοχή κληρονομίας.

Φορολογία Για Κατοίκους Ελλάδος Βάσει Της Περιουσίας Τους

Το παρόν άρθρο αφορά όσους έχουν καταχωρηθεί στην ελληνική εφορία ως κάτοικοι Ελλάδας. Επομένως, οι ομογενείς, κάτοικοι εξωτερικού δεν θα πρέπει να ανησυχούν ότι μπορεί να φορολογηθούν στην Ελλάδα με βάση την περιουσία τους και όχι το πραγματικό εισόδημά τους. Για όσους, συνεπώς, είναι μόνιμοι κάτοικοι Ελλάδος η εφορία κάθε χρόνο τους φορολογεί με βάση την περιουσία που διαθέτουν, εκτός αν δηλώνουν μεγαλύτερο εισόδημα. Ας πούμε ότι κάποιος μόνιμος κάτοικος Ελλάδος έχει δύο διαμερίσματα στο όνομά του, οπότε το τεκμήριο διαβίωσης για την εφορία είναι για τα δύο αυτά ακίνητα 8.000 ευρώ. Έχει και ένα οικόπεδο και ένα αυτοκίνητο ΙΧ, ενώ πληρώνει και ιδιωτικό σχολείο για τα παιδιά του. Όλα αυτά μπορεί να δημιουργούν ένα τεκμήριο διαβίωσης 20.000 ευρώ ετησίως. Αν στην ετήσια φορολογική του δήλωση ο φορολογούμενος δηλώσει ότι είχε εισοδήματα 30.000 ευρώ, τότε θα φορολογηθεί για το ποσό των 30.000 ευρώ. Αν όμως δηλώσει ότι είχε εισόδημα 12.000 ευρώ, τότε θα φορολογηθεί όχι για 12.000 ευρώ, αλλά για 20.000 ευρώ, που είναι τα τεκμήρια, διότι η εφορία υποστηρίζει ότι αφού έχει αυτήν την περιουσία (σπίτια, αυτοκίνητο, παιδιά σε ιδιωτικό σχολείο κλπ.), δεν μπορεί να ζει με λιγότερο από 20.000 ευρώ, οπότε τον φορολογεί για το ποσό αυτό.
Με τον τρόπο αυτό η εφορία καταπολεμά εν μέρει την φοροδιαφυγή, επειδή φορολογεί κάποιον αναλογικώς με την περιουσία που διαθέτει και χρησιμοποιεί και με το συμπέρασμα που προκύπτει για το επίπεδο ζωής του, με βάση την αξία των περιουσιακών του στοιχείων. Αφού δηλαδή έχεις αυτό το σπίτι, εκείνο το αυτοκίνητο και εκείνες τις «πολυτελείς» δαπάνες (πισίνα, οικιακή βοηθό, παιδία σε ιδιωτικό σχολείο κλπ.), τότε το ελάχιστο που σε υπολογίζω να έχεις ως ετήσιο εισόδημα είναι 20.000 ευρώ, έστω κι αν εσύ μου φέρνεις στοιχεία για εισόδημα 12.000 ευρώ.
Τι γίνεται όμως στην περίπτωση κατά την οποία ο φορολογούμενος έχει πραγματικά χαμηλώτερο εισόδημα από εκείνο που προκύπτει από τα τεκμήρια; Τότε θα είναι άδικο να φορολογηθεί για εισόδημα που δεν αποκτά. Σε μία τέτοια περίπτωση μπορεί να αμφισβητήσει τα τεκμήρια, προσκομίζοντας αποδείξεις ότι ζει με λιγότερα χρήματα. Μπορεί δηλαδή ο φορολογούμενος να έχει τρία σπίτια (κληρονομιά, ή από τότε που έβγαζε χρήματα), αλλά λόγω εξαιρετικών συνθηκών, σήμερα να μην έχει παρά πενιχρά εισοδήματα, πολύ χαμηλώτερα από τα τεκμήρια.
Τέτοια στοιχεία που αποδεικνύουν ότι κάποιος δεν έχει το εισόδημα που «μαρτυρούν» τα τεκμήρια, μπορεί να είναι:
- Ότι υπηρετεί την στρατιωτική του θητεία, επομένως δεν εργάζεται και δεν έχει συνεπώς εισόδημα, παρά το ότι έχει τρία σπίτια και αυτοκίνητο.
- Ότι είναι φυλακή, οπότε δεν μπορεί να εργασθεί και δεν έχει εισόδημα, παρά την περιουσία που διαθέτει.
- Ότι είναι άνεργος και εισπράττει μάλιστα επίδομα ανεργίας.
- Ότι νοσηλεύεται ή ότι πάσχει από ασθένεια ή ότι η κατάσταση της υγείας του είναι τέτοια (π.χ. αναπηρία), που δεν του επιτρέπει να εργασθεί και να έχει το εισόδημα που ορίζουν τα τεκμήρια.
- Ότι ζουν στο ίδιο σπίτι με συγγενείς πρώτου βαθμού και ότι τις ανάγκες τους καλύπτουν οι συγγενείς. Δηλαδή ένας ηλικιωμένος μπορεί να έχει στην κυριότητά του πέντε διαμερίσματα τα οποία δεν νοικιάζει για διάφορους λόγους και τα τεκμήρια λένε ότι πρέπει να φορολογείται για 30.000 ευρώ ετησίως. Αν αποδείξει ότι ζει με τα παιδιά του και ότι εκείνα καλύπτουν τις βασικές του ανάγκες διαβίωσης, τότε μπορεί να γλυτώσει την φορολόγηση για εισόδημα 30.000 ευρώ και να φορολογηθεί για λιγότερο. Αρκεί και τα παιδιά του να δηλώνουν επαρκές εισόδημα που να καλύπτει και τις ανάγκες του πατρός τους.
- Ότι είναι ορφανοί ανήλικοι που κατέχουν επιβατικά αυτοκίνητα ΙΧ από κληρονομιά γονέα τους.
- Ότι για λόγους ανωτέρας βίας πραγματοποίησαν δαπάνες διαβίωσης μικρότερη των τεκμηρίων.
Όταν ο φορολογούμενος υποβάλει στην φορολογική αρχή στην Ελλάδα κάποιον από τους ανωτέρω ισχυρισμούς που μειώνουν το εισόδημα για το οποίο πρέπει να φορολογηθεί κάτω από το ποσό των τεκμηρίων, η εφορία θα ελέγξει τις σχετικές αποδείξεις και θα αποφανθεί αν μπορεί να γίνει μείωση του φορολογητέου εισοδήματος και σε ποιό ποσοστό.
