My Parents Own Property In Greece

My parents own property in Greece, but I do not know if they have the right documents to prove their property rights. Also, I do not know if they have updated their titles and property listings with various authorities in Greece and if we owe taxes to the Greek tax authority. These are some of the main questions Greek expatriates put forward, with regard to property they have in Greece, especially when they are facing decisions related to selling it, or transferring it to their offspring, or starting managing it in a more efficient way.
The first important matter is to make sure we have the deed or title to the property. This is the legal document by which the owner (Greek expatriate) has obtained the ownership of the property in question. It is usually a deed of purchase, when the Greek expatriate bought the property years ago. Very often it is a deed of acceptance of inheritance, by which the Greek expatriate inherited the property from a parent or another relative. It may be a deed of donation / free gift from a relative or a third party. The title may be a deed of legal division of jointly owned property, in order each of the owners to obtain a separate piece of the property. All these deeds have been signed (executed), sometime in the past, before and by a notary in Greece and they are supposed to be registered at the local land registry, near the property. In some cases, the title of ownership is a state deed, by which the Greek state transferred title to private owners on land given to them for any reason (refugees from Asia Minor many years agο, redistribution of lands etc.).
If the owner (Greek expatriate) does not have even a copy of the deed by which she/he owns the property, the lawyer in Greece will make a search at the land registry in the area of the property, and using the name of the owner (first name, last name, maiden for women, father’s and mother’s first name), should be able to find the deed of the property, provided the deed had been registered when it was signed. This means that the Greek expatriate must be able to a) either have the old deed (even in copy form) or b) know the town or village where the property is located. If the owner does not have the old deed and does not even know where the property is located, the lawyer in Greece may not be able to locate its legal title.
Another valuable document is a survey map or topographic plan, showing the technical aspects of the property.
It is enough for the present owner to have a copy of such deed and survey map. Having the deed, even in photocopy form, will give the lawyer or the notary the chance to verify many legal aspects of the identity of the property and subsequently advise what needs to be done in order to bring the deed up to date, whether any taxes are owed, if the owner must register the deed with a modern land registry called Ktimatologio, the E9 property list of the tax authority and with the local Municipality. A new survey map may have to be drawn by a civil engineer, so that the boundaries and other technical characteristics of the property are depicted according to recent specifications.
In order to make the new survey map (topographic plan), the most crucial question is to be able to physically get to the property. In other words, to visit it. In some cases the Greek expatriate who claims is the owner, does have a deed, and does not know how to get to his property. If the property in question is a house or apartment, it may be easier to locate it, visit it and show it to a civil engineer for technical inspection. If, on the other hand, the property is a land or plot, the legal description of its boundaries and its exact location may not be a part of the old deed’s text. Older deeds do not offer an exact description of the property’s accurate location, making it difficult for someone today to locate it and then to measure it.
This is the reason why it is very important to either know where your property actually is, in physical terms and not just in legal description, or be acquainted with a trusted relative, neighbor or other local person, who knows how to get to your property. If you visit your property in Greece anytime, the best thing is to make a new survey map. Alternatively, you must at least take several photos of its boundaries, and its location and you must also keep track of how to get there, because this practical detail may be critical in locating the position of your property in the future and updating its status with the Greek tax office, the land registry, the Municipality and other authorities.
When the property is identified with a deed and its actual position is located, the identity of the owner must be established, by having the passport or / and Greek id card of the owner available for legal work. If the owner lives outside of Greece, there is no problem at all to update the property’s status. This is done with a power of attorney (POA) which is drafted by a lawyer in Greece and sent (e-mailed) to the owner abroad, with instructions to sign it at the closest Greek Consulate, or at least at a local notary public with the Apostille stamp or with the stamp of the Greek Consulate, depending on the situation.
The owner, in consultation with his family and his lawyer in Greece, must decide what he/she wants to do with the property, meaning whether he wishes to retain it in his ownership or sell it, gift it to his offspring, donate it to a sibling or make a Will. Depending on the owner’s instructions, the lawyer in Greece will draft the appropriate POA, which the owner will sign at the Consulate or local notary with Apostille and mail it back to Greece.

My mother was born in Greece and I would like to know if and how I could obtain the Greek citizenship, which I believe is like a European citizenship, as well. Could you please advise how this could be done? This is a very common request, which I receive from many people, born outside of Greece to Greek parents or grandparents. The pattern is the same. A Greek – born father or mother, or grandparent, and fewer times a great grandparent. Sometimes, the ancestor was not even born in Greece, but was Greek anyway. In that case, you can read my article “How Much Greek You Feel?”.
My initial reply is that, first we need to know the full data of the parent born in Greece. His or her name, last name, (maiden for a woman), place and year of birth in Greece, as accurate as possible, and the first name of his or her father, as the minimum data, which allows the proper search to be done at a municipal office in Greece. The aim is to locate, if possible, the valid registration of the parent, at a Greek Municipal office. This is the Demotologion for men and women, which is like the main book of citizens. Anyone registered at a Demotologion is a Greek citizen. The other option, available only to men for obvious reasons, is the army record or Male Registry, which can help us locate valid registrations of men even from the 1870’s in some parts of Greece and later.
If we locate the birth record of the parent born in Greece, the next thing we need is his/her marriage certificate. The marriage may have taken place in Greece or abroad and in that case, for older marriages, we must establish whether it was only a state / civil marriage, or a religious marriage, as well. And in that last case, what type of denomination. All foreign (non-Greek) certificates of birth and civil marriage must have the Apostille stamp, if they come from the USA, Australia, the UK, South Africa, Brazil and most other countries. If they are issued from Canada and few other countries, they do not get the Apostille. Instead, they are notarized by the Greek Consulate in that country, or by the respective foreign Consulate in Athens. The aim is to register the foreign marriage at the Special Registry in Athens. If this is the marriage of the grandparents of the applicant, whether it was civil or religious may determine the prospects of the citizenship application, especially if the marriage has taken place outside of Greece and before 1983.
We also need to know whether this marriage was a first or second etc. for the Greek – born parent of the present applicant for the Greek citizenship. If it was not a first marriage, we will need the first marriage and the divorce court ruling, in order to recognize it in Greece with a court petition and hearing, which does not re-try the divorce in its merits, but simply transfers its validity into the Greek legal order.
Subsequently, we need the birth certificate of the person interested in the Greek / European citizenship, from the foreign country, always with Apostille or Greek Consulate notarization. We need to register this at the Special Registry in Athens, too. Names must be consistently stated in all certificates. Serious name and spelling changes can be a serious problem. They can be overcome with adjusted translation or justification of the name change, either with a court or administrative decision abroad, if this exists, or with photo identification documents (passports or other photo id), where each version of the name appears in each photo id. The photos in the photo ids serve as the link, proving that both versions of the name belong to the same person.
Apart from the above basic info, there are many variations of facts and details in each case, which make it unique and call for legal advice on specific issues by experienced attorneys in Greece.

Μέχρι σήμερα ένα σημαντικό κομμάτι της διαδικασίας της κληρονομίας στην Ελλάδα είναι η υποβολή Δήλωσης Φόρου Κληρονομίας. Μία σειρά από έγγραφα, όπως κυρίως η ληξιαρχική πράξη θανάτου, με επίσημη μετάφραση αν αφορά αλλοδαπό που έχει περιουσία στην Ελλάδα και με Αποστίλλη ή άλλη επικύρωση, ανάλογα το αλλοδαπό κράτος, το πιστοποιητικό εγγυτέρων συγγενών ή οικογενειακής κατάστασης ή οι σχετικές ένορκες βεβαιώσεις, η διαθήκη ή το πιστοποιητικό περί μη δημοσιεύσεως διαθήκης και το έντυπο της δηλώσεως έπρεπε να υποβληθούν διά ζώσης στο τμήμα κεφαλαίου - κληρονομιών της αρμόδια εφορίας, είτε από τον κληρονόμο αυτοπροσώπως είτε από αντιπρόσωπο (δικηγόρο ή μη) με συμβολαιογραφικό ή προξενικό πληρεξούσιο. Μερικές φορές η αναμονή ήταν μεγάλη, αλλά το θετικό στοιχείο ήταν ότι υπήρχε μία ζωντανή και άμεση επικοινωνία μεταξύ του υποβάλλοντος την δήλωση και του εφοριακού, ώστε με τις ερωταπαντήσεις πολλά ζητήματα να λύνονται επί τόπου. Αν ήθελε ένα πρόσθετο έγγραφο ο εφοριακός μπορεί να του το παρέδιδε αμέσως ο υποβάλλων την δήλωση, ή να φρόντιζε να υποβληθεί γρήγορα ή να το λάβει εκείνη την στιγμή από άλλο τμήμα της ίδιας εφορίας.
Τώρα οι νέες διαδικασίες επιβάλλουν την αποστολή της δηλώσεως φόρου κληρονομίας και όλων των πιστοποιητικών και συνοδευτικών εγγράφων με ηλεκτρονικό ταχυδρομείο (e-mail), ή με κούριερ ή απλό ταχυδρομείο. Υποτίθεται ότι ο εφοριακός θα μελετά τον φάκελλο της δηλώσεως και τα έγγραφα και είτε θα εκδίδει την πράξη ότι ελήφθη από την εφορία και ότι οφείλεται τόσος φόρος ή ότι δεν οφείλεται φόρος, είτε θα στέλνει ηλεκτρονικό μήνυμα στον κληρονόμο ότι λείπει το ένα ή το άλλο έγγραφο. Κατά τον ίδιο τρόπο, όταν ο κληρονόμος θα θέλει να πουλήσει ή να δωρίσει το κληρονομηθέν ακίνητο, ή όταν θα θέλει να λάβει από την τράπεζα το υπόλοιπο του λογαριασμού του θανόντος, εφόσον το δικαιούται, το πιστοποιητικό ότι δεν οφείλει φόρο κληρονομίας θα εκδίδεται από την εφορία ηλεκτρονικά μετά από αίτηση που θα υποβάλλεται επίσης ηλεκτρονικά.
Το αποδεικτικό του ταχυδρομείου ή της υπηρεσίας ταχυμεταφοράς (ελληνικά, κούριερ) ή το αυτοματοποιημένο μήνυμα που αποστέλλεται ως απάντηση στο ηλεκτρονικό μήνυμα του φορολογουμένου, αποτελεί γι’ αυτόν αποδεικτικό υποβολής της δήλωσης ή της αίτησης και επέχει θέση απόδειξης παραλαβής εκ μέρους της εφορίας.
Η ίδια «ηλεκτρονική» διαδικασία θα ακολουθείται και όταν γίνεται πώληση, δωρεά, γονική παροχή ή άλλη μεταβίβαση ακινήτου. Αντί η δήλωση μεταβιβάσεως και το σύνολο των απαιτουμένων εγγράφων να υποβάλλονται αυτοπροσώπως από τον αγοραστή, μαζί με τον πωλητή, με φυσική τους παρουσία στην εφορία, θα αποστέλλονται με ηλεκτρονικό ταχυδρομείο ή κούριερ και η συνδιαλλαγή με την εφορία θα γίνεται μόνο ηλεκτρονικά. Η απόδειξη της ταυτότητος, ώστε ο εφοριακός να πειστεί ότι αυτός που υποβάλει με ηλεκτρονικό μήνυμα την δήλωση κληρονομίας ή μεταβιβάσεως είναι το σωστό πρόσωπο, θα γίνεται πλέον με ηλεκτρονική ταυτοποίηση μέσω της διαδικτυακής σελίδας gov.gr ή με υπεύθυνη δήλωση με γνήσιο της υπογραφής από το ΚΕΠ ή άλλη αρμόδια αρχή. Η βεβαίωση του γνησίου της υπογραφής των δηλούντων (σε δήλωση φόρου δωρεάς, γονικής παροχής και μεταβίβασης ακινήτων) μπορεί να γίνει και από τον συμβολαιογράφο που θα συνάψει το αντίστοιχο συμβολαιογραφικό έγγραφο.
Φρονούμε ότι η εξέλιξη αυτή δύναται να αποτελέσει πρόοδο, διότι μπορεί να οδηγήσει στην εξοικονόμηση χρόνου. Ωστόσο, εάν η εφορία απαιτεί πρόσθετα έγγραφα, δεδομένης και της πολυνομίας και της γραφειοκρατίας, μπορεί η επικοινωνία εφορίας με πολίτη να γίνει πιο δύσκολη και πιο αργή, διότι αντί της αμέσου διά ζώσης συνεννοήσεως θα προβλέπεται η ανταλλαγή ηλεκτρονικών μηνυμάτων μέσω του TAXISNET, ένα σύστημα που πρέπει να δούμε εάν θα αποδειχθεί ότι είναι πιο εύκολο και πιο πρακτικό από το προηγούμενο.

Greece Asks For The Taxpayers’ Foreign Tax Number

Until today, the foreign resident who filed taxes also in Greece, did not have to disclose to the Greek tax authority his/her tax number in the foreign country, where he/she permanently resides. Thus, the Greek – American living in New York, who had to file tax returns each year in Greece, because he earns income from renting a property in Greece or from receiving a pension, was asked to declare only the country of his residence, which in this example was the USA. In another example, the resident of Montreal, Canada, who also filed tax returns in Greece, had to state only that he resided in Canada and that he had property (in general) in Canada. The Greek tax authority knew only, vaguely, that the taxpayer filing in Greece, was a permanent resident of another country (say, Australia) and that he owned property there, something not particularly suspicious, since it is absolutely normal to own property in Australia if you permanently reside there.
From this year (tax filing extended until the 29th of July 2020 for income of 2019), the foreign resident who also files taxes in Greece, is asked to state in his filing to the tax authority not only the country of his residence, but also whether he has income there. Even worse, he has to divulge his tax number in the foreign country and his address there. The Greek tax authority says that this information is wanted in order to establish better communication with the tax authorities of other countries.
Most Greeks, who permanently live outside of Greece, but file taxes in Greece because they rent a property or they receive a small pension, or for any other reason, have become very suspicious with this new development. They fear that once they disclose their tax number abroad, Greece will cooperate with the tax authority of their country of residence, so that income and/or property they earn or own in another country is divulged to the Greek tax authority and vice versa. Most expatriate Greeks do not earn a lot of money in Greece. They may receive a pension which is usually low, and / or the rent of a modest or medium size property. If they state in their Greek tax returns their tax number in their country of residence, they may have to pay more taxes in their country of residence, since they will be taxed for their income anywhere in the world (world income).
These people believe that they already pay significant taxes and cope with many adversities, when they have to deal with the bureaucracy of two countries, and when they have to pay agent fees and many other expenses to fix problems of their property in Greece, where they are not present most of the time. If they are forced to disclose their foreign tax number and thus their modest Greek property or income to the foreign tax authority, they will have to pay more taxes. In some cases this will make owning and managing property in Greece too costly and unsustainable.
Such a development may have the negative consequence of cutting off the roots of thousands of expatriate Greeks with Greece. If those residents of foreign countries who also own property in Greece, have to sell their properties in Greece, or to cut down on their travels to the country, in order to reduce their expenses, the end result will be damaging not only to them, but to Greece, as well, because the country will lose a significant “human capital”. The Greek expatriates love Greece and they and their families support in many ways, directly and indirectly, the Greek society and even the budget of the Greek government. They travel to Greece every year or very often. They advertise life in Greece all over the world. They are “ambassadors” of Greece. They demonstrate love and interest in Greek affaires, including support with regards to international issues and threats that Greece is facing. All this will be lost, if they feel that their ties with Greece have become too “expensive” for them to retain.
It will be very disappointing if Greece fails to keep Greeks who live abroad, close to the country where they were born or where their parents or ancestors were born. Greece must find a way to strengthen her ties to our sisters and brothers who live abroad and make them come more often to Greece. We must make them invest more of their money and time in Greece. We do not have the luxury of losing such a large number of Greeks and the Greek government must find ways to stop their potential alienation from the country of their ancestors.

Πώς Θα Μεταβιβάσετε Την Περιουσία Σας Στην Ελλάδα Στα Παιδιά Σας

Πάρα πολλοί είναι οι ομογενείς που επιθυμούν να μεταβιβάσουν στα παιδιά τους ακίνητα που έχουν στην Ελλάδα. Είτε επειδή θέλουν να προτρέψουν τα παιδιά τους να διατηρήσουν στενούς τους δεσμούς τους με την Πατρίδα, είτε διότι τα παιδιά τους ήδη επισκέπτονται συχνά την Ελλάδα για διακοπές, δουλειές ή και μόνιμη εγκατάσταση, η σκέψη για μεταβίβαση περιουσίας στους απογόνους οδηγεί τους ομογενείς σε αναζήτηση της καλύτερης νομικής φόρμουλας για την «παράδοση» της μικρής ή μεγαλύτερης περιουσίας στην νέα γενιά Ελλήνων.
Μία πρώτη επιλογή που έχουν οι γονείς είναι να δωρίσουν το ή τα εν Ελλάδι ακίνητά τους, στα παιδιά τους, με την νομική πράξη που ονομάζεται γονική παροχή. Η πράξη αυτή προετοιμάζεται με σειρά πιστοποιητικών και εγγράφων στην Ελλάδα από εφορία, μηχανικό, Δήμο και άλλες υπηρεσίες και υπογράφεται σε συμβολαιογράφο και ο γονέας μεταβιβάζει άνευ ανταλλάγματος το ακίνητο στο παιδί του, για να το ενισχύσει στην ζωή του και να το βοηθήσει κοινωνικά και επαγγελματικά.
Ο ελληνικός νόμος επικροτεί την μεταβίβαση περιουσίας από γονέα προς τέκνο, συμφώνως προς τα ήθη και την νοοτροπία των Ελλήνων απανταχού της γης, με το να καθιστά αφορολόγητη την γονική παροχή μέχρι το ποσό των 150.000 ευρώ από κάθε γονέα προς κάθε τέκνο. Εάν συνεπώς τον ακίνητο στην Ελλάδα έχει αντικειμενική αξία έως 150.000 ευρώ, δεν θα πληρωθεί φόρος γονικής παροχής, γεγονός που μειώνει σημαντικά τα έξοδα της μεταβιβάσεως. Αλλά ακόμα και αν το ακίνητο έχει μεγαλύτερη αξία, έως 300.000 ευρώ, ο φόρος γονικής παροχής είναι πολύ μικρός, δηλαδή μόνο ένα τοις εκατό (1%) από τις 150.000 έως τις 300.000 ευρώ. Εάν δηλαδή το ακίνητο έχει αντικειμενική αξία π.χ. 200.000 ευρώ, ο φόρος γονικής παροχής θα είναι το ένα τοις εκατό των 50.000, δηλαδή 500 ευρώ. Σημειώνεται μάλιστα ότι το αφορολόγητο ισχύει για κάθε παιδί, επομένως για μεταβίβαση με γονική παροχή περιουσίας 400.000 ευρώ σε δύο παιδιά από τον ένα μόνο γονέα, ο φόρος θα είναι 1% επί των 100.000, δηλαδή μόνο 1.000 ευρώ.
Για την ολοκλήρωση της γονικής παροχής, η οποία γίνεται μόνο σε συμβολαιογράφο στην Ελλάδα και όχι στο Προξενείο ή αλλού, απαιτείται η έκδοση σειράς εγγράφων, όπως φορολογική ενημερότητα, πιστοποιητικό ΤΑΠ από τον Δήμο, πιστοποιητικό της εφορίας ότι δεν οφείλεται φόρος κληρονομίας ή γονικής παροχής, πιστοποιητικό ότι δεν οφείλεται ΕΝΦΙΑ και ότι οι διαστάσεις και τα χαρακτηριστικά του ακινήτου είχαν δηλωθεί σωστά στο Ε9, βεβαίωση μηχανικού ότι δεν υπάρχουν πολεοδομικές παραβάσεις ή ότι το γεωτεμάχιο δεν έχει κτίσμα, αλλά και ενεργειακό πιστοποιητικό, ασφαλιστική ενημερότητα, τοπογραφικό με σύγχρονο τρόπο αποτύπωσης και συντεταγμένες εάν πρόκειται για οικόπεδο ή αγροτεμάχιο και άλλα. Απαιτείται βεβαίως και πληρεξούσιο, τόσο από τον γονέα, όσο και από το παιδί που παίρνει την γονική παροχή, προς έμπιστο πρόσωπο (συγγενή, φίλο ή δικηγόρο) στην Ελλάδα. Κι αυτό, διότι στις πλείστες των περιπτώσεων η έκδοση των απαιτουμένων εγγράφων απαιτεί αρκετές εβδομάδες και οι ομογενείς είτε δεν έρχονται καν στην Ελλάδα, είτε αν έρθουν, προτιμούν να περάσουν τον χρόνο τους στην Πατρίδα με καλύτερο τρόπο, από το να τρέχουν σε υπηρεσίες, εφορίες, δήμους, συμβολαιογραφεία και δικαστήρια. Η γονική παροχή μπορεί να μεταβιβάσει στο τέκνο την πλήρη κυριότητα του ακινήτου ή μόνο την ψιλή κυριότητα, οπότε ο γονέας διατηρεί την επικαρπία για όσο ζει, ώστε να λαμβάνει αυτός τα τυχόν εισπραττόμενα ενοίκια ή να έχει εξασφαλίσει την χρήση της κατοικίας εφ’όρου ζωής.
Η εναλλακτική επιλογή μεταβίβασης περιουσίας στα παιδιά, εκτός της γονικής παροχής που έχει ισχύ από τώρα, την ώρα δηλαδή που θα υπογραφεί η συμβολαιογραφική πράξη, είναι η διαθήκη, με την οποία η περιουσία θα μεταβιβασθεί στα παιδιά μετά θάνατον του διαθέτη. Η φορολογία στην διαθήκη / κληρονομία είναι ίδια με την γονική παροχή. Εάν επιλεγεί η λύση της διαθήκης, ο διαθέτης γονέας πρέπει να συμβουλευθεί δικηγόρο ή συμβολαιογράφο στην Ελλάδα, για να συντάξει καλύτερα την διαθήκη, με περιεχόμενο που θα μπορεί να εφαρμοσθεί και δεν θα προκαλέσει δυσκολίες όταν έρθει η ώρα να ισχύσει. Μερικές φορές μπορεί να αρκεί και η διαθήκη που ο γονέας έχει συντάξει στο εξωτερικό, εφόσον ελεγχθεί από δικηγόρο στην Ελλάδα. Εάν επί παραδείγματι ο γονέας έχει δύο παιδιά και στην Ελλάδα έχει δύο ακίνητα ίσης περίπου αξίας, θα ήταν προτιμώτερο να γράψει στην διαθήκη ότι δίνει το Α ακίνητο στο ένα παιδί του και το Β στο άλλο, παρά να γράψει ότι αφήνει στα παιδιά του τα δύο ακίνητά του, δημιουργώντας έτσι εξ αδιαιρέτου μερίδια που μπορεί να προκαλέσουν έριδες ή πολυπλοκότητα στην διαχείριση των κοινών ακινήτων.

Δηλώστε Τώρα ή Διορθώστε Το Κτηματολόγιο Στην Αθήνα

Το Κτηματολόγιο προχωράει στην υλοποίησή του στον Δήμο Αθηναίων. Η διαδικασία άρχισε πριν από πάνω από δέκα χρόνια, όταν για πρώτη φορά όλοι οι ιδιοκτήτες ακινήτων στην Αθήνα, ακόμα και όσοι έχουν εξ αδιαιρέτου μερίδιο σε κάποιο ακίνητο, ή μόνο έναν χώρο στάθμευσης (ανεξάρτητη οριζόντια ιδιοκτησία), ή μόνο μία αποθήκη, ή μόνο την επικαρπία, ή την ψιλή κυριότητα, κλήθηκαν να υποβάλουν συμβόλαια, πιστοποιητικά μεταγραφής, τοπογραφικά και λοιπά έγγραφα, που αποδεικνύουν το δικαίωμά τους.
Από την 1η Ιουνίου 2020 άρχισε η πρώτη ανάρτηση, δηλαδή η δημοσίευση των δικαιωμάτων που δηλώθηκαν τα προηγούμενα χρόνια από όλους όσους είναι ή ισχυρίζονται ότι είναι ιδιοκτήτες ακινήτων στον Δήμο Αθηναίων. Καθένας που έχει δηλώσει ακίνητο ή γενικώς εμπράγματο δικαίωμα πρέπει τώρα να ελέγξει εάν το δικαίωμά του έχει αποτυπωθεί από το Κτηματολόγιο σωστά, ή εάν έγινε κάποιο λάθος. Λάθη μπορεί να έχουν γίνει ως προς τα τετραγωνικά, τα ποσοστά κυριότητας, το όνομα και τα λοιπά στοιχεία του δικαιούχου κλπ. Τώρα μπορεί να αρχίσουν να βγαίνουν στην επιφάνεια και διεκδικήσεις του ίδιου ακινήτου από περισσότερους του ενός ιδιοκτήτες. Εάν επί παραδείγματι, περισσότεροι έχουν δηλώσει το ίδιο ακίνητο, θα προκύψει το πρόβλημα, διότι αυτό θα φανεί στην πρώτη ανάρτηση του Κτηματολογίου. Εάν κάποιος παρά το ότι δήλωσε το ακίνητό του, δεν το βλέπει στους πίνακες της πρώτης ανάρτησης, είναι πιθανόν οι υπηρεσίες του Κτηματολογίου να αξιολόγησαν τα έγγραφα που υπέβαλε ως μη επαρκή για την απόδειξη της κυριότητάς του, ενώ αξιολόγησαν ως επαρκή τα στοιχεία που πιθανώς υπέβαλε κάποιος άλλος για το ίδιο ακίνητα και ανεγνώρισαν, προσωρινώς, εκείνον ως ιδιοκτήτη. Τέτοιες περιπτώσεις οδηγούν στην υποβολή ενστάσεως από εκείνον του οποίου το δικαίωμα δεν αναγνωρίσθηκε, ώστε να αποδειχθεί ενώπιον Ειδικής Επιτροπής, ποιός από τους δύο που διεκδικούν το ίδιο ακίνητο, έχει δίκιο.
Στο Γραφείο Κτηματογραφήσεως Αθηνών θα υπάρχει η δυνατότητα υποβολής έως 3 Οκτωβρίου 2020 αιτήσεως διορθώσεως προδήλου σφάλματος, αλλά και εκπροθέσμων δηλώσεων ακινήτων που βρίσκονται στον Δήμο. Δηλαδή όσοι έχουν υποβάλει δηλώσεις, αλλά προκύπτει ότι στην αποτύπωση του δικαιωμάτων ιδιοκτησίας ακινήτων στην Αθήνα το Κτηματολόγιο δεν έχει καταχωρίσει σωστά τα δικαιώματα αυτά, ή υπάρχουν παραλείψεις κλπ, η προθεσμία είναι μέχρι την 3η Οκτωβρίου 2020 για υποβολή αιτήσεων διορθώσεως ή αποκαταστάσεως των σφαλμάτων. Η ίδια προθεσμία ισχύει και για όσους τώρα ανακαλύπτουν ότι έχουν ακίνητο στον Δήμο Αθηναίων και δεν το είχαν δηλώσει από το 2008 που είχε αρχίσει η διαδικασία. Οι δικαιούχοι συνεπώς εμπραγμάτων δικαιωμάτων επί ακινήτων στον Δήμο Αθηναίων μπορούν ακόμα και μέχρι τις 3-10-2020 να δηλώσουν για πρώτη φορά το ακίνητη ή το μερίδιό τους σε ακίνητο, που είχαν για οιονδήποτε λόγο παραλείψει να δηλώσουν μέχρι σήμερα. Με τον τρόπο αυτόν παρέχεται η ευχέρεια σε όλους αυτούς τους ιδιοκτήτες ακινήτων, ή κληρονόμους να μην χάσουν τα ακίνητά τους και να μην τους τα πάρει το δημόσιο, όπως προβλέπει ο νόμος, εφόσον υποβάλουν δηλώσεις στο Κτηματολόγιο για τον Δήμο Αθηναίων τους επόμενους μήνες και πάντως όχι μετά τις 3 Οκτωβρίου 2020.
Επίσης, από εδώ και στο εξής, κάθε μεταβίβαση ακινήτου που βρίσκεται στον Δήμο Αθηναίων, εκτός των άλλων δικαιολογητικών και πολλών εγγράφων που απαιτούνται στον συμβολαιογράφο, χρειάζεται πλέον και πιστοποιητικό κτηματογραφούμενου ακινήτου. Συνεπώς, εάν το ακίνητο δεν έχει δηλωθεί στο Γραφείο Κτηματογραφήσεως Αθηνών, δεν μπορεί να μεταβιβασθεί, δηλαδή ούτε να πωληθεί, να δωριθεί ή να μεταβιβασθεί με γονική παροχή. .
